2026 Best Business Debt Settlement Lawyers in South Dakota
Reviewed by NYCCriminalAttorneys.com Blogging Team · Last updated
There is no officially sanctioned “best” list of business debt settlement lawyers. The best fit is a South Dakota attorney who handles both bankruptcy and business workout law, not a national debt settlement company. You can try the State Bar of South Dakota’s Lawyer Referral Service, at (800) 952-2333, which gives names of attorneys practicing in areas of business or consumer/debt law. (It confirms good standing of attorneys in its list, but not their skill, so you need to vet them.)
Top 3 Business Debt Settlement Firms for South Dakota (2026 Rankings)
Creditor workout is a general term for agreements to cut, restructure or delay business debt. It can range from a single shot, lump-sum discount on an equipment note, to a multi-year stretch-out of back rent or vendor balances. It sometimes takes in personal guarantees. Unlike bankruptcy, it doesn’t have to be court-based and it can be custom fit to a problem.
First thing a bankruptcy attorney has to do is figure out if you qualify for a Chapter 13 or Chapter 7 and what property you own that would be at stake. He or she explains South Dakota exemptions - what property you can keep through bankruptcy. Those facts give you a floor: it lets creditors know that’s what they’d get if you filed. The lawyer is the person most likely to know what your bankruptcy estate would look like, and most able to back up a buy-out offer by saying: This is all you would get if you pushed.

If you qualify for bankruptcy, you may get better deals: Chapter 7 pays unsecured creditors little or nothing, while a Chapter 13 reorganizes your payments to often only a fraction of what you owe. (It doesn’t matter if you don’t want bankruptcy. This is the threat in the lawyer’s briefcase.) A debt settlement company can’t.
With debt settlement, you stop paying your creditors and instead deposit monthly payments into an account. Accounts eventually go delinquent. Debt rises with fees and interest. The company tries to bargain with creditors, to repay the debt at a discount. You can be sued. Most such firms aren’t law offices, and can’t go to court.
With an attorney, you may not need to stop paying everyone. He or she can tell you what accounts are on the bubble: which of your credit cards or other balances can you keep current. On credit, the settled accounts show as settled for less than you owed, hurting your score. Settlement programs can add months of missed payments before seeing a creditor accept a bargain.
Once collectors know you have a lawyer, the Fair Debt Collection Practices Act generally means they have to talk to the lawyer, and not you. The lawyer also crafts a settlement proposal and may file bankruptcy if settlement talks fail. If you are sued, the lawyer answers the complaint and raises defenses. A default judgment can lead to collection actions such as wage garnishment, or bank levies. A settlement firm can’t stand up for you in court; a law firm can.
A South Dakota creditor has 6 years in general to bring a lawsuit on a contract or loan. A South Dakota judgment can be enforced for as long as 20 years. Collections activity like wage garnishment can be stopped immediately with a bankruptcy filing.
There is an estate created by a bankruptcy, and a trustee sees that creditors split the pot, not one get the cream while the others get milk. If you made a preference by paying one creditor a lump sum of money and then filed within 90 days (one year if the creditor is an insider or close relative), the trustee has legal authority to sue to void the deal, and make everyone share in the total amount you have on hand. A lawyer knows which debts and what timing to avoid this risk.
There is a catch to debt forgiveness: the money that vanished also generally counts as ordinary income. The creditor often sends a Form 1099-C to you and the IRS if the amount is $600 or more. Overlooking this is a mess up, because you may be agreeing to a settlement of the money you owe without knowing that you just agreed to a tax bill in the process. This typically isn’t a problem with bankruptcy. You may also get a partial tax break on money forgiven while being insolvent. A lawyer can document insolvency for your return preparer.
Business Owners
It’s not likely that business owners have a single creditor. A company has a bank, equipment leasers, and a landlord, to say nothing of the IRS, state revenue, and personal guarantees the owner may have made to lenders. A lawyer with experience can see the lay of the land, so to speak, and help you choose among Chapter 13, business liquidation, or continuing operations during a wind-down of the business.
”Subchapter V,” the small business reorganization, has a cap of about $3.4 million in debts. Ask if the lawyer is up on the rules.
South Dakotans have to use the state exemptions, not the federal. Don’t unload what the law already protects. South Dakota has no general limit on home equity, but the tract can only be 160 acres outside a town. Don’t drain retirement plans or homes to pay out debts if you don’t have to. It’s worth a session with a lawyer to plan around these kinds of blunders.
Ask about fees up front. Settlement companies commonly charge 15% to 25% of the principal enrolled. Attorney fees are often quoted up front, less chance of surprise. Under South Dakota’s Rule 1.5, attorneys can’t charge or get unreasonable fees. Also, a lawyer can’t take contingent (success-based) pay without a signed, written agreement.
Just a general rule of thumb for sizing up a small business owner’s situation. Weight toward a workout if they have only a few main lenders, steady cash flow. Maybe the bankruptcy would cause you a problem with a job or trade license. Maybe a co-signer who will be in trouble if you file Chapter 7. Tilt toward filing if they’ve been sued, got tax issues from forgiven debt, more than a few creditors, and if they would wipe out 401(k) or IRA money to settle. An attorney is the likeliest to have the knowledge to get this right.
Start with the State Bar’s referral list. A consultation with an attorney covers the problem, options, and what you might pay. The list does not rate a lawyer’s skill, so ask about business workouts and bankruptcy. Ask about your options, whether a workout or bankruptcy is better. If you don’t get a straight answer, it’s a sales pitch.
