2026 Best MCA Defense Lawyers in Arizona
Top MCA Defense Firms Serving Arizona - 2026
Merchant cash advances are typically sold and structured as a “sale of future receivables.” Terms are set using a “factor rate” rather than an interest rate. The daily ACH debits keep coming even when your sales drop.
Arizona does not have any laws on the books as of August 2026 about merchant cash advances. Arizona’s usury law is especially tricky, since parties here are allowed to agree in writing to any interest rate.
Delancey Street
Important: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company that works with a nationwide network of licensed attorneys - and that distinction matters. Their attorneys handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution for Arizona business owners. Their network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of whether your business operates in Phoenix, Tucson, Mesa, Scottsdale, or Chandler - and the evolving appellate case law that is reclassifying MCAs as loans subject to interest rate caps.
Where Delancey Street separates from every other firm on this list is MCA-specific legal firepower. Their attorneys don’t just negotiate - they challenge. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the Arizona Corporation Commission, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent in funder negotiations. Over $100M in commercial debt settled. No upfront fees. Results-based pricing.
National Debt Relief
Important: National Debt Relief is not a law firm and is not an MCA defense specialist. They’re the largest debt settlement company in the United States - over $1 billion in debt settled, 550,000+ clients served. They handle general unsecured business debts - credit cards, vendor accounts, lines of credit - but they do not challenge confessions of judgment, file usury defenses, or dispute UCC liens. If your Arizona business debt is primarily traditional unsecured debt and not MCA-specific, they’re a strong option. If you’re dealing with MCA funders, COJs, or frozen accounts - you need a firm with MCA-specific attorney involvement.
CuraDebt
Important: CuraDebt is not a law firm and is not an MCA defense specialist. They’ve been in the debt resolution business for over 25 years - handling business debt, consumer debt, and IRS/state tax resolution. If your Arizona financial situation involves both MCA debt and tax obligations - including Arizona Department of Revenue issues - CuraDebt can handle the tax side while a firm like Delancey Street handles the MCA defense. They do not challenge COJs, raise usury defenses, or file legal motions against MCA funders.
Many MCA contracts are written to choose New York law, with mandatory New York state court jurisdiction. This means that an Arizona business can be sued in New York (and forced to answer or defend itself there). You can be in Arizona with zero connection with New York State. These provisions are typically enforced, though are sometimes successfully challenged.
A Judgment Can Be Entered Quickly
Confession of judgment is a device that allows your funder to obtain a judgment against you without a lawsuit, or a hearing, or any notice or warning to you. Not every state allows confessions of judgment. New York has tightened up since 2019, and now the cases must be filed either where the debtor lived when signing or where they are currently living.
If the matter is already in arbitration and there is an arbitration award against you, then the plaintiff just needs to confirm the arbitration award in court. With a judgment, the funder can freeze your business’s bank account or have its sheriff attach any money the company has. This can happen only weeks after default. You usually have twenty days (after the papers are properly served) to file your answer if you are sued in an Arizona superior court. After that, you might get a judgment and a freeze on your accounts. A lawsuit in Arizona based on a written contract that was signed in Arizona must be filed within six years after the claim arises.
Available Defenses
One strong defense when fighting a judgment is the funder’s failure to stick to the terms of the Agreement. Your lawyer might be able to get a vacatur of the judgment based on the funder’s failure to follow some basic court procedure, like proper service or a defective confessional affidavit. Other defects in the funder’s case are also available defenses, such as the plaintiff’s failure to comply with a reconciliation clause.
Many of these cases involve a personal guaranty, which drags your personal assets into the suit. A lawyer may be able to challenge your guaranty in certain cases. A UCC-1 lien as collateral can block new financing. But UCC-1 liens are required to be terminated within twenty days of demand once the advance is paid off.
Having two funders hitting the same bank accounts can easily sink a business. If later funders knew the business was already overextended, or a broker steered you into more deals, that can support defenses.
Many cases on the validity of merchant cash advances as loans have happened in New York State. Whether a merchant cash advance is a sale or a loan is decided on a case-by-case basis, looking at the circumstances of the deal. Courts ask whether there was genuine reconciliation, whether there is an end date, and whether the funder can collect no matter what, even if the business fails.
Collections cases, like many lawsuits, sometimes end in a negotiated settlement where you pay a lower figure than the full amount owing, and in return for the payoff money, you get a release of the lawsuit, and maybe a release of any lien or a new contract with better terms. In very difficult cases bankruptcy can stop collection efforts, though bankruptcy requires its own advice, as it has other repercussions.
Some methods are easy to rule out. One of the most common mistakes is just ignoring the lawsuit. This will give the court a green light to grant a default judgment against you for everything demanded in the Complaint. Sending your bank or service provider a long form letter from a website saying your debt is unenforceable or unauthorized is not going to help. Hiding assets or moving them to a new company can make you worse off.
Shopping for a Lawyer
You can get a list of lawyers from the State Bar of Arizona member directory. Look them up by name, by legal needs, filtering by certified specialization, and city/county. In Arizona you can check the disciplinary record of lawyers on the state bar website. These are reprimands, suspensions, and disbarments. The probation or restitution actually comes off after two years, but the actual infraction remains on a permanent record.
The State Bar of Arizona certifies specialists in 10 areas, including bankruptcy. When shopping for a lawyer, look beyond certified bankruptcy and confirm the attorney’s experience with business cash advances. Ask how many of these cases they have handled in the past year. Ask if they understand confessions of judgment and arbitration. Some cases are filed in New York so ask whether the lawyer is in that state and can file papers there (or has someone who can).
To avoid surprises, before hiring a lawyer, make sure you find out all the costs: the retainer or engagement agreement, and whether they are taking a percentage of any recovery. Your lawyer should explain in writing, in the engagement agreement you get and sign, what the fees and charges will be, how to calculate the balance and what is being done. One critical bit of law is that even when the lawyer’s services are nonrefundable or “earned upon receipt,” the client can still fire the lawyer, and the lawyer can still owe the client a refund. The lawyer must tell you, in writing, that you can still fire your lawyer anytime you want.
Before the first consultation you should gather up copies of all your MCA agreements, your ACH authorizations, and the last ninety days of your bank and merchant statements. Don’t sign any new loan or funding contracts. Don’t stop your ACH or close your accounts on your own.
Before signing with an MCA defense lawyer, ask them about timelines, likely next steps and fees. It is in your interest to begin working with an attorney early in the process, well before the time to answer expires.
