2026 Best MCA Defense Lawyers in Atlanta, GA

Bottom line: Chances are, if you have a merchant cash advance company coming at you, you will need legal help. Each and every business’ situation is different, which means that the most expensive attorney, or the law firm with the best track record, might not be the best lawyer for you. The legal help that you will need will come from a lawyer who has been around the MCA business for a long time, and has been on the front lines of merchant cash advance cases in court.

Top MCA Defense Firms for Atlanta Businesses - 2026

It’s hard to appreciate how important time is to the success of your MCA case. One missed payment can bring a default notice, collection calls, and even a lawsuit within days or even weeks. The single costliest mistake here is ignoring court papers. A default judgment can be undone, but it’s much harder than contesting the lawsuit in the first place. A lawyer who is experienced in merchant cash advance cases, will tell you right away that time is of the essence.

Delancey Street

Attorney-Coordinated MCA Defense & Settlement - $100M+ Settled Nationwide
Here’s what you need to know: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company that coordinates with licensed attorneys who do the actual fighting - COJ challenges, usury defenses, UCC lien disputes, settlement execution. Whether your Atlanta business operates in Buckhead, Midtown, the Westside, or along the BeltLine - their attorney network is built around New York’s dual usury framework and the evolving case law reclassifying MCAs as loans. This is what they do. Their attorneys file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the Georgia Superior Court Clerks’ Cooperative Authority, and use the NY AG’s $1 billion Yellowstone Capital settlement in funder negotiations. For Atlanta businesses - from restaurants on Peachtree Street to tech startups in the Atlanta Tech Village - Delancey Street delivers attorney-coordinated defense with no upfront fees.
Best for: Atlanta business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens

MCA Agreements

MCA contracts often pick New York law and courts, so an Atlanta business can be sued or forced into arbitration in New York. That tends to catch some business lawyers by surprise.

Nobody seems to read the guaranties, but that’s where the real trouble is. Personal guaranties are a part of nearly every merchant cash advance deal. That means the owner’s bank accounts and property are all at risk, and that UCC-1 filings can claim the business assets and block any other financing.

Confessions of judgment let the funder get a judgment with no lawsuit or notice. After 2019, though, no court in New York can accept a confession against a non-resident. Many MCA agreements also have an arbitration clause. An arbitration award can be confirmed into a judgment.

All it takes is a judgment and a bank account is fair game. In Georgia, a garnishment exemption claim may be lost if not filed within 20 days of the garnishee’s answer.

A true sale of future receivables isn’t a loan, so it’s not subject to lending and usury laws. To hold up in court as a sale, though, the contract has to be what it claims to be on paper and have no hallmarks of a loan. Courts look for factors like the reconciliation, a fixed term, and whether the contract has recourse if the business fails. Almost every case turns on its own facts.

Besides the merits of the MCA agreement, there may be other defenses: service, misrepresentations, or other procedural defects. In 2024, the FTC got a $20.3 million judgment against MCA operator Jonathan Braun for deceiving small businesses.

In a law effective in 2024, the Georgia legislature said MCA contracts of $500,000 or less have to come with a breakdown of the fees and costs. Missing that means fines from the state, but it doesn’t mean you can back out of the contract. That’s a start.

When It Comes to Finding a Lawyer

Google’s not too helpful when it comes to finding a lawyer. Things like awards, ads, rankings, even reviews are meant to impress, not inform. There is no ranking or award or ad that can tell you who is the best lawyer for you. The State Bar of Georgia makes a membership directory that it updates daily. That can tell you if a lawyer is current in their standing and has not been disciplined. It won’t tell you whether they have experience in your kind of case, though.

The Atlanta Bar has a referral service, and the first meeting, up to 30 minutes, may cost $45, and sometimes less. Those half hours can tell you if you have a case, if the lawyer has experience in your problem, and what you might want to do next. Fee agreements are subject to a “reasonableness” standard under the Rules of Professional Conduct. A lawyer should explain to a client how the fee is calculated and, preferably, do so in writing.

You’d think finding an MCA lawyer would be easy. It isn’t. A lawyer who is getting in to MCA cases for the first time will be learning on your dime. Questions to ask might include:

  • How many MCA cases has the firm handled in the past 12 months?
  • Have you handled defense of confessions of judgment?
  • What MCA litigation and arbitration cases has your firm handled?
  • What is the timeline on these cases?

Not every merchant cash advance case ends up in court, or ends up going to judgment. At the end of the day, a lot of cases can be settled for a reduced amount, better terms, a lien release, and so on. If you’re sued in New York, you may need local counsel there, too.

Before a Consult

There are a few things you should put together before a consult. Your agreement with the funder, the ACH authorization, and 90 days of bank statements are key. Get every letter, text or email that’s related. The funder may be sending you urgent messages, but don’t sign an advance or a settlement without a lawyer.

Tinkering with the bank account to stop ACH can be treated as a breach. Telling the bank that authorized debits are unauthorized can bring liability and hurt your credibility. Moving assets isn’t an option.

Filing of a case under the bankruptcy code usually means a stop to collection efforts. What the law calls the automatic stay comes into effect with the case filing. A Subchapter V bankruptcy is a small business case for debts that are $3,424,000 or less. A business filing, though, doesn’t automatically clear up an owner’s personal guaranty.

There is no best lawyer. But with a legal specialist who can give you a quick grasp of your case, get you from A to Z, and tells you what you need to hear, not what you want to hear, the bill is money well spent. A bit of research up front can make all the difference in the cost and outcome of your MCA defense case.
