2026 Best Business Debt Settlement Lawyers in West Virginia

Bottom line: Unfortunately, there is no “best lawyer” in West Virginia. Generally in WV, lawyers can’t even call themselves specialists at things except for patent, trademark, and admiralty law. What you need is an attorney licensed to practice law in West Virginia who can meet with you before you owe them anything and discuss your situation. The West Virginia State Bar does have a referral service that might be helpful. If you ask, you get a name and phone number of a lawyer who should be able to meet with you for a 30-minute consultation for no more than $25, and you have no obligation to hire that attorney after the consultation. A listing is not an endorsement, though. You can also call the Legal Connect phone line on Tuesday evenings for free advice from volunteer lawyers.

MCA Default

The danger with an MCA default lies in how merchant cash advance funding works. MCA providers often require an automatic bank transfer each business day (or at least weekly). Soon, rather than helping a business, these daily withdrawals of money sap the business’s revenue until payment becomes impossible. The effective APRs could be over 1000%.

Your choice of lawyer is really important here. West Virginia still doesn’t have a specific law covering MCA agreements. There’s no legal requirement for lenders or brokers to be licensed. That makes it easy for people in the industry to rush or bully small businesses into signing away their futures on the basis of scare tactics and buzzwords. Payday lending laws cover a little bit, but only in consumer situations, which doesn’t cover you. Other states like California, New York, Vermont, and Utah have stood up to secure their small businesses better.

If you default, they’re going to come after you. They have the right to file a UCC-1 lien against your business and file an information subpoena telling your customers to pay the funder not you. They can sue the business and the business owner personally for breach of contract and unjust enrichment. And they can try to freeze or levy your business and personal bank accounts. What doesn’t help is that they can do this all at once.

But not every MCA default is breach of contract. If your receivables had dropped more than expected, and you couldn’t afford to pay, that’s not necessarily a breach of contract on your part.

If your agreement has a confession of judgment, that’s a problem. In general, confessions of judgment let the funder get a judgment against you with no lawsuit and no day in court. But since August 31, 2019, New York funders are barred from using them against out-of-state merchants like West Virginia ones. Some funders have tried to avoid that by renaming confessions of judgment as “agreed judgment.” It’s the same thing.

You might wonder why New York matters. The reason is that most MCA funders are set up in New York to be near the Wall Street investors. Part of why they set up shop there is because before August 2019, New York law allowed them to use confession of judgments against borrowers.

Debts don’t go away automatically. In West Virginia, a creditor has ten years to sue for breach of contract on a signed written contract, or five years for an oral or implied one. Once it wins and gets a judgment, it can issue execution within ten years to execute on the judgment. And that’s where a lawyer’s help comes in.

The Fee Basis or Rate in Writing

When you go see a lawyer, West Virginia rules require them to put the scope of work and the fee basis or rate in writing for you, at or soon after beginning the work, unless you’re a regular client at the same fee. That includes contingency fees, which have to be in writing, signed by you, and say how your lawyer’s fee is figured and which expenses come out of recovery.

A few cautions, though. If someone offers to handle debt pooling for you, West Virginia limits their fees to 2% of each deposit you actually make. It’s a misdemeanor (fine up to $250, jail, or both) to break that limit. Attorneys are exempt.

Subchapter V

But what if settling still won’t be enough to get the relief you need? When talking to your attorney, ask about Subchapter V, the small-business Chapter 11 process. It’s for cases where the business’s total debts are no more than $3,424,000 for cases filed on or after April 1, 2025; Congress passed H.R. 7730 to permanently raise it to $7.5 million, but as of Sept 30, 2026 it still needed the President’s signature.

If you also owe taxes, one way to resolve tax debt is the IRS’s Offer in Compromise program. There’s a $205 application fee. Low-income people can ask the IRS to waive that, but businesses can’t get the waiver. In a lump-sum offer, you send 20% of the proposed offer with the application.

Just because someone has a law degree doesn’t mean they’re right for your situation. Your lawyer should have handled MCA defaults before. Here’s what to do this week: ask the West Virginia State Bar for a lawyer who’ll give you a half-hour consultation for no more than $25. When you meet with them, ask whether your default was breach of contract and what to do about a confession of judgment. Bring all your loan documents to your meeting. If your lawyer sees what you’re dealing with, they can give you much better answers. What you need to do is find out whether this lawyer is the right lawyer to handle your matter.
