Bottom line: Who is the best MCA defense lawyer in Austin? That’s a tough question because rankings don’t apply. The key is finding an attorney who moves quickly, knows how to handle New York lawsuits as well as Texas collection attempts, and builds leverage to settle.
Top MCA Defense Firms for Austin Businesses - 2026
A merchant cash advance is touted as a way to get quick capital without red tape. Those ads gloss over two key facts, though. First, the obligation is often secured with a personal guarantee and second, if you can’t handle the debits, a New York law firm may take you to court.
Speed matters because failure to answer a lawsuit usually leads to default judgment. In New York that can come within thirty to sixty days. Once it is domesticated as a Texas judgment it can be used to freeze your bank account. There are lots of defenses for MCA lawsuits, but all the counter-claims in the world won’t keep it from becoming a default judgment if you don’t answer in the first place. Once it is a judgment, the leverage shifts.
Let’s be clear: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company - and they work with a nationwide network of licensed attorneys who handle the actual fighting. COJ challenges, usury defenses, UCC lien disputes, funder negotiations, settlement execution - all of it, on behalf of Austin business owners. Their attorney network is built around New York’s dual usury framework - which controls the vast majority of MCA contracts, whether your business is on Congress Avenue or in the Domain.
Here’s the difference: Delancey Street’s attorneys don’t just negotiate - they go to war. They file motions to vacate confessions of judgment. They raise criminal usury defenses when effective APRs blow past 25%. They dispute overbroad UCC-1 filings with the Texas Secretary of State. And they use the NY Attorney General’s $1 billion Yellowstone Capital settlement as a weapon in funder negotiations. Over $100M in commercial debt settled. No upfront fees. Results-based pricing.
Best for: Austin business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens who need immediate attorney-coordinated defense

Largest U.S. Debt Settlement Firm - A+ BBB Rating - 550,000+ Clients
Here’s the deal: National Debt Relief is not a law firm - and they don’t do MCA defense. They’re the largest debt settlement company in the country, with over $1 billion settled and 550,000+ clients served. They handle general unsecured business debts - credit cards, vendor accounts, lines of credit - but they won’t challenge a confession of judgment, file a usury defense, or fight a UCC lien. If your Austin business debt is mostly traditional unsecured stuff and not MCA-specific, they’re a solid, proven choice. But if you’re dealing with MCA funders, COJs, or frozen accounts - you need a firm with MCA-specific attorney firepower.
Best for: General unsecured business debt - credit cards, vendor accounts, lines of credit over $7,500 (not MCA-specific defense)

Let’s be straight: CuraDebt is not a law firm and they don’t handle MCA defense. They’re a debt resolution company with 25+ years of experience in business debt, consumer debt, and IRS/state tax resolution. If your Austin business is dealing with both MCA debt and tax problems - including Texas franchise tax issues - CuraDebt can handle the tax side while a firm like Delancey Street fights the MCA battle. But they won’t challenge COJs, raise usury defenses, or file legal motions against funders. That’s not their lane.
Best for: Combined business debt and tax resolution - IRS/state negotiations, multi-layered financial situations (not MCA-specific defense)
Years in Business:25+

First of all, the lender can garnish funds, including those from customers. The officers of the company are exposed too: if you signed a personal guarantee, the same tools can reach you personally. Judgment protections turn on whether an asset can be reached by garnishment: the homestead typically is exempt, business assets often are not.
House Bill 700 took effect September 1, 2025, adding Chapter 398 to the Texas Finance Code for merchant cash advances. Hidden in Chapter 398 is a provision that takes a direct swipe at lawsuits from MCA lenders. A covered contract with a confession of judgment provision is void. Automatic debits are prohibited unless the provider has a first-priority perfected security interest. There are other subtle protections and it is important to work with an attorney who understands all of the angles.
Defenses to MCA Claims
Possibly strong defenses to MCA claims include the theory that an MCA contract is really a loan disguised as a sale of receivables; MCA reconciliation requests that were ignored; and MCA broker promises not incorporated into the MCA contract. The contract may be unenforceable if the lender fails to prove the ownership chain. MCAs are a niche world in their own, and it takes someone familiar with the minutia to find the leverage points.
A Good Settlement
Most MCA claims settle. A defense can be a strategy for settlement as well as a shield in trial. It’s all about leverage, and that is based on the potential defenses to the case. At trial each individual defense may not be enough by itself, but combined together they can create doubt, destroy the perception that your case is easy, and make the lender want to resolve the matter faster. If you can shift the perception from “slam dunk” to “I might lose this case,” you have a much better chance for a good settlement. Depending on the case, a settlement may bring a reduction of the amount, a lien release, or a release of the personal guarantee. It’s rarely a perfect offer but it can be a fair one, when the attorney knows all the options.
Settling multiple MCAs can be tough if you treat each one separately. Each lender wants to get their own money and be done, but can’t take the risk of being the last one left when the well dries up. It is better to create one coordinated settlement plan involving all the funders together.
Paying off a merchant cash advance is one thing, and having the lien against the company removed is another. The lien is a public record, so if it isn’t canceled it haunts you, causing complications with credit and lenders. When the advance is paid off the lender often does not withdraw the lien: forgetting, not taking the time, or doing it intentionally. So send them a written demand for the UCC termination and keep a copy.
Questions to Consider When Vetting MCA Attorneys
MCA legal experience counts. In addition to knowing how to respond to an MCA lawsuit to prevent a default judgment, the attorney needs to recognize the intangibles, the soft points, all of which play a role in the battle. It might seem obvious, but make sure the lawyer knows MCA case law and is familiar with courts and judges. Does the attorney have any recent experience litigating MCA cases? Can the attorney help with lawsuits that originate in New York? Has the attorney handled any trials defending MCA cases? The attorney you choose should not be a dabbler. Board certification in civil trial law is offered by the Texas Board of Legal Specialization. Among other things, a lawyer must have tried at least 15 civil trials.
Cost is always a critical factor. You’re not looking for the cheapest lawyer. But you may not be able to afford the most expensive, either. Among the questions to ask when vetting an attorney: How is the fee calculated, and is it subject to negotiation? And of course contingency fee contracts must be in writing, and must state the method for calculating the fee.
If you need help finding an attorney, the State Bar of Texas has certified local referral services in Austin. One is the Lawyer Referral Service of Central Texas. For lawyers on referrals, the first visit is usually free for thirty minutes. You have to pay for further service, but that half-hour can be priceless. So approach referrals with an eye on the clock and a goal to learn enough in the first 30 minutes to decide whether the attorney is a good fit for you.
Before that first consultation, gather each MCA contract that was signed, and every renewal or “modification agreement”, three months of the business bank statements, and all email traffic between the broker and you that you can find. Careful--don’t start juggling bank balances to another account. You might have to explain that later, and it is better not to do that.
Collectors often record their calls. So never admit a debt on the phone without talking to your attorney first. Never ignore a lawsuit. Whether or not you hire an attorney, the clock will continue to run until your deadline passes and the plaintiff wins by default.
What’s best is a defense that stops the suit or the debt collection as quickly as possible and returns you to your business.
