Louisville Debt Settlement Lawyers: 2026 Best Business Debt Settlement Lawyers in Kentucky

Bottom line: People often ask me who the best attorney is in Kentucky for settling business debt, but I don’t think there’s a clear cut answer to that. In most cases, what you’re looking for is a Kentucky-licensed lawyer who can negotiate settlements for your merchant cash advance (MCA) accounts. Ideally, this would be an attorney who could also defend lawsuits, file bankruptcy if needed, and do so as someone who specializes in MCAs. If you’re looking for just a debt settlement company that isn’t staffed by attorneys, it may be wise to reconsider this option since they don’t have the necessary legal expertise to handle these complex cases.

Top 3 Business Debt Settlement Firms for Kentucky Businesses in 2026

In Kentucky, debt settlement where someone acts as go-between between creditors for a fee is considered debt adjusting. A Kentucky-licensed attorney performing these activities as part of their law practice and not engaging in debt adjusting business mainly are exempt from these regulations.

Settlement companies pitch big savings, payments cut in half, and getting one monthly payment into an escrow account. They downplay their huge upfront fees and make pie in the sky estimates. When you send money, your bank accounts and receivables often get frozen, no progress happens, and no refund is offered. These companies are not law firms and cannot give legal advice or represent you in court.

Funders also like to add fees to the contract when you screw up. They’ll hit you with things like

  • insufficient funds usually $35 each time,
  • stop payment usually $500 to $5,000,
  • changing bank or merchant accounts usually $100 to $2,500,
  • default usually $2,500 to $5,000,
  • third party interference usually $2,500 to $5,000.

A Uniform Commercial Code (UCC) lien can be even worse than a judgment. With a judgment, the funder can freeze your bank accounts, but with a UCC lien, they can freeze your receivables before the money even reaches your bank. This is because you already signed away these rights in the contract when you took out the MCA or business loan.

If the funder has your customer list, trade references, bank statements, or online bank access, expect it to send the UCC lien within a day or two to your processors (Square, PayPal, Stripe, etc.) and customers it knows. The letter tells your customers to pay the funder instead of you. Some customers may take their business elsewhere. This is the most frequent problem I see after default.

Confession of Judgment is when you waive your right to defend yourself if you default. New York stopped funders from doing this against out-of-state business owners back in 2019. Now some funders file their COJs in Texas, Illinois, Utah, and a few other states. In Kentucky, any confession of judgment power signed before a suit is void (except KRS 457.150). Most funders still file regular lawsuits.

Domesticating a judgment is where they take a judgment won in another state and bring it to Kentucky to enforce it. This has been happening more in Kentucky as the MCA industry has grown, more defaults have occurred, and funders have become more aggressive. Written contracts signed after July 15, 2014 can be sued on for 10 years after the claim accrues.

If a lawsuit is threatened or a judgment is entered against you, an experienced debt defense attorney can help. A Kentucky judgment usually earns 6% interest compounded yearly from entry, but a judgment on a written contract earns the rate in that contract. Having an attorney defend the lawsuit can buy you time to raise funds to settle on your terms. They may also be able to negotiate a lower payoff.

A true merchant cash advance is not a loan. The funder buys future receivables and is only paid as money comes in. If nothing comes in, they should collect nothing. Loans must be repaid regardless. Profits of 100% to 200% or more would be usurious by most states’ standards if deemed a loan. Most MCA contracts are not drafted properly. An experienced lawyer can sue to void the contract.

The funders want to be repaid, so they set you up to struggle, not fail. That way they can sell you refinancing. Brokers work on commission and don’t care if you repay. Often they stack you with several funders at once. A common lie is ”pay a month, then we’ll get you a traditional loan.” Brokers can be held accountable with third party complaints.

Most MCAs require a personal guarantee, so be aware of that. Personal bankruptcy can discharge your personal obligation, but the business stays liable. A business bankruptcy does not touch your personal liability. Personal bankruptcies are either Chapter 7 or 13 while businesses can file Chapter 7, 11, or Subchapter V for smaller companies. Bankruptcy should be considered as a last resort.

The debt limit for Subchapter V is $3,424,000 now. Congress passed H.R. 7730 to raise that to $7,500,000, but as of October 1, 2026 it has not been signed yet by the President. The Western District of Kentucky’s Chapter 11 filing fee is $1,738 and there is no option to pay it out in installments. That court also usually insists Chapter 11 can’t be filed without an attorney helping.

Before you hire, get it on paper. Under Kentucky rule SCR 3.130(1.5), a contingent fee agreement must be in writing, signed by the client, and state how the fee and expenses are calculated. And remember: settled debt is generally taxable income. A lender who cancels $600 or more files Form 1099-C with the IRS. You may be able to exclude this to the extent you were insolvent (liabilities over fair market value of assets) just before.

So which business debt settlement lawyer is the best in Kentucky? Settlement is the right call for some owners and a costly mistake for others, and you can’t decide that without knowing the risks. Pick the Kentucky-licensed attorney who can bargain your payout down, defend the lawsuit, and file bankruptcy for you if that’s what it comes to.
