2026 Best MCA Defense Lawyers in Albuquerque, NM

Bottom line: The truth is, there’s no trusted list that can tell you which is the best MCA defense lawyer in Albuquerque. When you’re looking, only ask lawyers who are authorized to practice in New Mexico, who promise to appear in your court, and who will review all your MCAs together. No matter how you choose, make sure you get a written fee statement before you sign anything. And don’t wait until you’ve missed a payment to get help.

Top MCA Defense Firms for Albuquerque Businesses - 2026

Daily or weekly withdrawals from several MCAs can leave little or nothing for payroll and rent and other costs. Bring a picture of the flow on the bank account and all the MCA agreements.

A good MCA lawyer reviews your balances, guarantees, and reconciliation rights. They get an overview of your default and fees. They negotiate payment changes or other settlement. If you’re subject to a judgment, a bank restraint, or a UCC filing, they know where to stand and what to say. What they don’t do is promise that you’ll get a reduction, dismissal, or release of funds.

Delancey Street

Attorney-Coordinated MCA Defense & Settlement - $100M+ Settled Nationwide

Important: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company that works with a nationwide network of licensed attorneys - and that distinction matters. Their attorneys handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution for Albuquerque business owners. Their network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of whether your business operates on Central Avenue or in the North Valley - and the evolving appellate case law that is reclassifying MCAs as loans subject to interest rate caps.

Where Delancey Street separates from every other firm on this list is MCA-specific legal firepower. Their attorneys don’t just negotiate - they challenge. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the New Mexico Secretary of State, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent in funder negotiations. For Albuquerque businesses - from restaurants along Route 66 to tech startups near Sandia Labs - Delancey Street delivers attorney-coordinated defense with no upfront fees.

Best for: Albuquerque business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens who need immediate attorney-coordinated defense
Total Settled: $100M+
Focus: MCA Defense & Settlement

National Debt Relief

Largest U.S. Debt Settlement Firm - A+ BBB Rating - 550,000+ Clients

They’re the largest debt settlement company in the United States - over $1 billion in debt settled, 550,000+ clients served. They handle general unsecured business debts - credit cards, vendor accounts, lines of credit - but they do not challenge confessions of judgment, file usury defenses, or dispute UCC liens. If you’re dealing with MCA funders, COJs, or frozen accounts - you need a firm with MCA-specific attorney involvement.

CuraDebt

25+ Years in Business Debt & Tax Resolution - IAPDA Certified

Important: CuraDebt is not a law firm and is not an MCA defense specialist. They’ve been in the debt resolution business for over 25 years - handling business debt, consumer debt, and IRS/state tax resolution. If your Albuquerque business has both MCA debt and New Mexico Taxation and Revenue Department obligations, CuraDebt can handle the tax side while a firm like Delancey Street handles the MCA defense. They do not challenge COJs, raise usury defenses, or file legal motions against MCA funders.

Best for: Combined business debt and tax resolution - IRS/state negotiations, multi-layered financial situations (not MCA-specific defense)
Years in Business: 25+
Tax Resolution: Yes (IRS & State)
MCA Defense: No

When you’ve got several MCAs that want your receipts, review all of them together instead of one at a time. You should be careful if you get a new MCA offer. Which debts does it close, which stay open? What will be the total cost after all their fees? You need to get it in writing.

MCAs are usually sold as purchases of future receivables. Whether the deal is legally a loan depends on what the terms say, how it operates, and governing law, not on what the MCA provider says it is. The factor rate is a payment multiple, not an APR. Because some MCA’s process anticipated income as estimates and reconcile later, it’s important to compare what the agreement requires with what was actually collected, and how the MCA company responded to requests when sales dropped.

Funders may call your MCA noncompliant and try to renegotiate or take legal action. When a funder says you’re in default, start with the notice itself, the clause it relies on and your payment history. Don’t stop paying, sign a new deal or accept a settlement without talking through what that could set off. In New Mexico, a suit to collect a written agreement must usually be brought within six years. Timing of your default and of the suit is important.

Some MCA contracts have clauses by which you allow judgment to be entered against you. However, even if you agreed, the right of the provider to have a New Mexico court enter a judgment may be limited or defeated altogether. State laws differ. Don’t ignore collection or lawsuit notices when you have a confession of judgment in your MCA, even if the lender’s office is far away and the contract says the judgment should be entered somewhere else.

If the MCA provider has already sued you or your business, go to that court and get the case number and the date the case papers were served. If both you and your business were named, you may both have to respond. Negotiating with the lender doesn’t extend the answer deadline or free the held funds.

To check out a lawyer in New Mexico, start with the New Mexico Supreme Court. Every lawyer authorized to practice gets a Court Authorized Identification number -- called a CAID -- that’s separate from the State Bar number. An attorney’s fees must be reasonable under the rules, judged partly by what’s customary locally. If it’s a contingency fee, there must be a written statement, and the lawyer must make the terms of it clear.

Don’t commit to hiring until you talk to the attorney who will be responsible for your case, confirm whether any litigation or out of town defense is included, and make sure all the affected businesses and owners are included. When you’re looking, the New Mexico State Bar’s referral program once offered a 30-minute consultation with a private attorney for $35.

MCA funders face scrutiny too. New York AG in Jan. 2025 got a $1.065 billion judgment against Yellowstone Capital, canceling about $534.6 million merchants owed and vacating judgments. FTC’s 2022 Richmond Capital case was an example. Though seeing others get relief can be heartening, it doesn’t make your balance or an upcoming deadline go away.

If your MCA debt is too big to settle, ask about Subchapter V of Chapter 11, but know that your total secured and unsecured debts must be $3,424,000 or less. The previous $7.5 million limit expired June 21, 2024. The bankruptcy court is in Albuquerque.

Before an evaluation, gather the signed MCA agreements and any signatures of the owners or guarantors. Create a list of all funders with how much is owed to each. Make sure you put recent communications, such as collection calls and papers, a lawsuit, or a frozen account, on top, or mention them at the start. Getting an evaluation from a MCA lawyer doesn’t pause a lawsuit, stop a bank levy, or push back a court deadline, so alert them if it’s urgent.
