2026 Best Business Debt Settlement Lawyers in North Carolina
Reviewed by NYCCriminalAttorneys.com Blogging Team · Last updated
If you are a business owner in North Carolina and have questions about an overdue debt, your best bet is to talk to a licensed North Carolina attorney, not a debt settlement company. Debt adjusters are subject to the NC Debt Adjusting Act, which says it is a Class 2 misdemeanor to negotiate in exchange for an upfront fee. An attorney licensed in NC, who is not working for a debt adjuster, is allowed to negotiate the debt for his or her client. A lawyer can handle the negotiations and, if necessary, defend a lawsuit over the obligation or file bankruptcy to address it, without being a debt adjuster.
Best Business Debt Settlement Firms for North Carolina (2026 Rankings)
Most people who receive letters from collection companies fear being sued. That fear often drives people to look for a quick fix, which is where the aggressive mailers or internet ads from debt settlement companies offer some hope. Some debt-settlement companies say they can cut your payments “in half,” but those numbers are often misleading. Advertisements for debt settlement play down the large up-front fee the company will charge you, focusing instead on the savings they promise. However, debt settlement companies rarely talk about lawsuits because they have nothing to offer if a lawsuit is filed. If you are sued after agreeing to work with a debt settlement company, you are usually left on your own to deal with the lawsuit. This does not happen when you are represented by an attorney. If the debt settlement company has just taken you halfway through a payment plan, what can it do if the debt holder freezes your account? Probably nothing! Then you are likely to find that the settlement fees aren’t refunded and that the ‘funder’ contracts add some serious fees -- insufficient funds typically around $35, stop payment at $500-$5,000, and default around $2,500-$5,000.
A UCC lien is a useful tool for an aggressive creditor trying to collect a debt. But, it can also be used without a judgment to increase pressure on a debtor. In either case, the lien can be more disruptive to the debtor than the threat of a judgment from a North Carolina court. UCC is shorthand for “uniform commercial code.” A judgment gives the party with the judgment the ability to freeze your accounts. Once you sign the funding company has the ability to show your lenders, customers, and processors a UCC lien, telling them your receivables are encumbered. Your UCC lien notice goes to Square, PayPal, Stripe, and your customers within a day or two. The funder tells these platforms and clients to pay them, not you. The funds are stopped before they ever make it to your bank. This may scare your customers off if they assume your firm will no longer deliver on your promises.

A confession of judgment is a legal contract that gives up certain rights including the ability to have a trial or court hearing to address the debt obligation. New York banned using a COJ against out-of-state defendants in 2019, so many merchant cash advance lenders started filing them in Texas, Illinois, or Utah instead. Most MCA lenders do not file COJ lawsuits but go through the traditional civil complaint filings. Another strategy is for a creditor to file suit in an out-of-state court and get a judgment there. It can then register the out of state judgment in NC. It is possible to defend a merchant cash advance lawsuit.
A Merchant Cash Advance Is Not a Loan
An “authentic” MCA typically buys a portion of future receivables. As a merchant cash advance is not a loan, if a business does not have any revenue or income, the business owes nothing to an MCA provider. By contrast, a traditional loan, including the typical bank, credit union or similar institution-backed loan, must be repaid, regardless of whether your business suffers a setback. An MCA advance can produce a profit to the funder of 100% or even 200% on the funds advanced to the client. Most contracts are not drafted to protect the funder from the accusation that the advance was a loan. If the court called the contract a loan, most likely the rate of interest would exceed the legal usury rates in most states.
Brokers will commonly offer advice to a client that this MCA advance is a temporary deal. The broker typically places several advances at once with separate MCAs, thus multiplying their payday. Lawyers are also filing third-party claims against brokers who placed several merchant cash advances for clients.
Discharge Their Personal Guarantee
Most, but not all MCAs, carry a personal guarantee. A person filing bankruptcy can discharge their personal guarantee, which releases them from all personal responsibility for the obligation, but the business would still owe the MCA. If the person files a business bankruptcy, then their personal liability could remain while the business bankruptcy proceeding deals with other obligations. If business obligations are tied to personal guarantees, then a 1-2 punch may be the right call, filing a personal bankruptcy under either Chapter 7 or Chapter 13, and a business bankruptcy. In Subchapter V, as of June 21, 2024, the debt limit is $3,424,000 for cases filed on or after that date.
Outside bankruptcy, NC’s laws generally allow a creditor three years to sue on a contract debt. Once it has a judgment, it can sue on that judgment within 10 years.
If you do need an experienced bankruptcy attorney and don’t know a good one, don’t rush to hire one. You should treat hiring any kind of a lawyer very seriously, doing your due diligence beforehand to ensure you are hiring someone who will do their best. Ask if the attorney is a board-certified bankruptcy specialist in North Carolina. This means the attorney has averaged 500 hours per year of bankruptcy work during the past five years, with no year under 400. North Carolina’s ethics rules bar fees that are illegal or clearly excessive. The fees in a contingent fee case must be in writing and signed by the client, specifying the percentages applied to settlement, trial and appeal.
The general rule is that when a creditor forgives a debt, it results in taxable income for the debtor. If a bankruptcy discharges the debt, then it is excluded from income. And if your business is insolvent, you can still exclude the cancelled debt to the extent of the insolvency. The taxpayer should file IRS form 982 if the debt is excluded.
All of the legal problems are sometimes overwhelming. An experienced attorney who does litigation, negotiates settlements, and bankruptcy could come up with some options for you. The safest way to deal with merchant cash advances is through your own lawyer, whose role is to get the best outcome for you as the client.
