2026 Best MCA Defense Lawyers in Alabama

Bottom Line: I hear this one a lot: who’s on the list of the best lawyers in Alabama to defend a merchant cash advance suit? No such list exists, and the state doesn’t certify lawyers in MCA defense, either. Best for you will be an Alabama-licensed attorney whose background (business bankruptcy, creditors’ rights, trial work) fits your case.

Top MCA Defense Firms Serving Alabama - 2026

Lawyers in Alabama can’t call themselves a specialist without a state-approved certificate. The Bar recognizes certified specialists in business bankruptcy, creditors’ rights, and civil trial advocacy.

Our state bar has a voluntary lawyer referral service. They only take participants who are Alabama lawyers, in good standing with the bar, and who carry malpractice insurance. Their panel attorneys commit to offering the first 30 minutes of consultation for no more than $50.

Delancey Street

Attorney-Coordinated MCA Defense & Settlement - Serving Alabama Business Owners - $100M+ Settled Nationwide
Important: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company that works with a nationwide network of licensed attorneys - and that distinction matters. Their attorneys handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution for Alabama business owners. This is what they do. Their network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of whether your business operates in Birmingham, Montgomery, Huntsville, or Mobile - and the evolving appellate case law that is reclassifying MCAs as loans subject to interest rate caps. Here's where Delancey Street separates from every other firm on this list - MCA-specific legal firepower. Their attorneys don’t just negotiate - they fight. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the Alabama Secretary of State, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent in funder negotiations. Over $100M in commercial debt settled. No upfront fees. Results-based pricing. But don't just take our word for it - call and see for yourself.
Best for: Alabama business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens who need immediate attorney-coordinated defense
Total Settled: $100M+
Focus: MCA Defense & Settlement

National Debt Relief

Largest U.S. Debt Settlement Firm - A+ BBB Rating - 550,000+ Clients
Important: National Debt Relief is not a law firm and is not an MCA defense specialist. There's no two ways about it - they are the largest debt settlement company in the United States, with over $1 billion in debt settled and 550,000+ clients served. They handle general unsecured business debts - credit cards, vendor accounts, lines of credit - but they do not challenge confessions of judgment, file usury defenses, or dispute UCC liens. If your Alabama business debt is primarily traditional unsecured debt and not MCA-specific, National Debt Relief is a strong, proven option. But if you’re dealing with MCA funders, COJs, or frozen accounts - that's a whole other animal, and you need a firm with MCA-specific attorney involvement.
Best for: General unsecured business debt - credit cards, vendor accounts, lines of credit over $7,500 (not MCA-specific defense)
Clients Served: 550,000+
Fee Structure: 18-25% of Enrolled Debt
MCA Defense: No
BBB Rating: A+
MCA Lender Freezing Your Alabama Bank Account? Delancey Street’s attorney network has settled over $100M in MCA debt. COJ challenges, usury defenses, emergency motions. Free consultation, no upfront fees. Your search is over.

CuraDebt

25+ Years in Business Debt & Tax Resolution - IAPDA Certified
Important: CuraDebt is not a law firm and is not an MCA defense specialist. They've been in the debt resolution game for over 25 years - handling business debt, consumer debt, and IRS/state tax resolution. If your Alabama financial situation involves both MCA debt and tax obligations - including Alabama Department of Revenue issues - CuraDebt can address the tax side while a firm like Delancey Street handles the MCA defense. But here's the thing - they do not challenge COJs, raise usury defenses, or file legal motions against MCA funders. For that, you need a specialist.
Best for: Combined business debt and tax resolution - IRS/Alabama state tax negotiations, multi-layered financial situations (not MCA-specific defense)
Years in Business: 25+
Tax Resolution: Yes (IRS & State)
MCA Defense: No

A common call: daily or weekly debits leave too little for payroll or rent. It’s worse with multiple MCAs and overlapping deductions. If you have an upcoming payment, a default notice, or if you’ve already been sued, you should at least talk to an Alabama MCA defense lawyer. Your attorney will look over agreements, payments, balances, and guarantees; negotiate to get the payment terms changed or bring the case to a settlement; and defend lawsuits. But they can’t promise success; no one can.

Alabama voids confessions of judgment that were signed before a lawsuit was filed. If a court enters a confession of judgment in Alabama, the debtor may challenge that judgment if they act within six months. The judgment must be set aside. New York offers some protection too: since 2019, its courts refuse to apply business confession of judgment clauses against businesses that aren’t in New York. If you have such an agreement, it’s critical that you get copies of the signed document, the judgment itself, all notices, and the docket to a lawyer as fast as you can.

The usury defense rarely helps. Alabama lets parties agree to any rate at all, as long as the debt’s $2,000 or more. The fight is over whether this really was a loan or a receivables purchase. Courts often look at whether there’s a real reconciliation clause; whether there’s a fixed schedule for repayment; and whether the contract makes recourse available against the business, or its guarantor. The contract’s label doesn’t settle the question, however.

A factor rate isn’t an interest rate, and it doesn’t work like an annual rate. The total cost you pay, then, depends on the amount you’re advanced, any added fees, and the timing of your collections. A merchant cash advance may have a security interest or UCC filing attached to it. It’s a mistake to assume you don’t have a security agreement or lien.

In 2022, the FTC banned Richmond Capital’s owner from running an MCA. And the FTC made the company cancel court judgments and discharge liens it had taken against businesses. In 2025, the New York Attorney General successfully sued Yellowstone Capital for $1.065 billion. None of these cases or investigations automatically cancels or pauses your payment obligations.

How Much Time You Have Left to Respond

If you’ve already been sued, then you’ll need to find out the name of the court, the case number, and how much time you have left to respond to the suit. It’s worth noting that, if you’ve signed a guaranty, the merchant cash advance company might have listed you individually, as well. Remember that talking with the other side never automatically extends a response deadline. If they offer to settle your suit, ask them how that settlement deals with any lawsuit filed, any personal guarantee you signed, and any judgments or liens that resulted from the case. And get that deal in writing. A lawyer’s review looks over the whole agreement, the amount claimed, payment credits, reconciliation history, and service issues. They’ll also look at legal issues like court venue, guarantors, and who gets sued.

If you have several different funders, and more than one of them is deducting from your receivables at once, you should be careful. You ought to review each funder’s contracts and repayment history together. Keep a written list of each one that you’re dealing with; include the funder’s name, balance, payment frequency, guaranties, and any upcoming deadlines you know about. If a lawyer gets involved, it’ll be your best starting point. Anytime someone offers to help you consolidate, or refinance, make sure that they know which existing advances this new one pays off, and which ones stay open.

Before you hire an attorney, you should ask who will actually take care of your file, whether they’d handle any negotiations or just go to court, and who appears in court. If an out-of-state lawyer offers to review your MCA agreements or defend your merchant cash advance suit, you should look for three things. Does their engagement letter include Alabama local counsel or admission to our state courts? Who and what does the letter cover? Specifically, which of your businesses or owners? Which funders? Which agreements?

As a general rule, you and your attorney negotiate a fee after the referral consult ends. You should definitely get it in writing. If you agree on a contingency percentage, make sure that it clearly breaks down the percentages for settlement, for trial, and for appeal.

If you’ve gotten a default notice, or you know that one is coming, read the agreement and the default clause that it cites. The notice ought to tell you which part of your contract they’re counting on to win their case. Look at the notice, the contract clause, and your payment history, side-by-side, before you decide. Before you stop payments, agree to a settlement or sign a new agreement, talk to a lawyer. They’ll want to look over your agreements, debit history, reconciliation emails and default notices. Bring these with you.

For review purposes, you can talk to a lawyer for advice while your payments are still current. Just keep in mind that collections activities won’t automatically stop while you’re consulting, and that court deadlines don’t slow down just because you’ve sought help. If you do have a document that looks urgent, make sure to flag it.

So whether it’s an agreement or a commercial funding lawsuit, look for someone who’s familiar with how MCA works in Alabama. If they understand funders, collectors and MCA agreements well, they’ll know what to look for, and what to watch out for. Having trial and creditors’ rights experience will make a difference, especially if the funder or their assignee files suit.
