2026 Best Business Debt Settlement Lawyers in Iowa
Reviewed by NYCCriminalAttorneys.com Blogging Team · Last updated
Bottom line: If your business is behind on merchant cash advances, there is no one best attorney for everyone. The best lawyer in Iowa for settling merchant cash advances for one business owner may not be the ideal choice for another. The right lawyer depends on many factors:
Top 3 Business Debt Settlement Firms for Iowa Businesses in 2026
What kind of business do you have?
Where are you located?
How many advances do you have?
How many other creditors do you owe?
What is your personal situation like (income, assets)?
These are just a few of the factors. The best way to get a clear picture of your options (and find out which attorney is the best for you) is to talk with an attorney (or several of them).

The law may seem the same to a lot of lay people. But one attorney may have a different approach than another. One may be more risk tolerant than another. One may have more experience than the other, etc. You want the attorney that best fits your goals and priorities. You also want to make sure the attorney actually has experience working with this kind of case. That is a vital consideration. Ask the lawyer how many cases they have handled similar to yours, and don’t hesitate to ask follow up questions.
Companies sometimes claim they are the best option for settling merchant cash advances. The bottom line is, they do not represent you as an attorney represents you. A company cannot practice law. Only an attorney can. An attorney is accountable to their bar license. Non-attorneys cannot give legal advice. Lawyers can (and do). Attorneys can enter a formal court appearance on your behalf. Non-attorneys cannot.
If a settlement company tries to solicit your business, there are few things you need to be aware of. First, the sales pitch you get is a one sided version. They will push their service, and they will do their best to make the benefits stand out. It does not show the alternatives, and it leaves out the downsides to their service (or, at best, glosses over them). In fact, they may tell you the exact opposite about the risks that go along with settling the advance for less.
Companies may charge thousands up front, even if you have not settled any of your advances. The charges can leave you in the hole even before the settlement company accomplishes anything. Meanwhile, funders are freezing bank accounts and taking ACH receivables while the settlement company just ‘works on the paperwork’.
The upfront fee typically is not refundable. And there are often further charges. Insufficient funds charges are typically $35 per occurrence. Funders add default fees ranging from $2,500 to $5,000. Federal rules say that debt relief companies cannot charge consumers before a debt has been settled and the debtor has paid. But this rule does not appear to be intended to extend to business debt relief, so do not count on it.
Often the bigger danger with an MCA is the UCC lien the funding company asserts against the business’ receivables. The creditor mails its lien to credit card processing companies that work with the defaulting debtor as well as the merchant’s customers who get some kind of product or service from the debtor. The creditor demands payment of the receivables the debtor is owed. The effect is that the cash never reaches the debtor’s bank account to get paid from. It is routed to the creditor directly. A merchant cash advance is based on a business’ receivables, and the customer list and bank statements you gave up front during the underwriting let the funding company know who pays you and where your money goes (your business bank account). The funding company can send out letters to your customers in a matter of days. Before you know it, some or all of your customers are paying your funder instead of you. Some customers may remain loyal, but others may jump ship.
Many funding agreements include a ‘confession of judgment’. By signing these, a merchant may have waived most of their defenses (right to due process in a court case). In New York, the state banned confession of judgments against out-of-state businesses in 2019, and now funders are now just filing them in Texas, Illinois, and Utah. The past few years have seen a rise in the default of merchant cash advances in Iowa. The funder who got a judgment against you can domesticate the judgment in Iowa to enforce the order (essentially, reach your assets here). Iowa puts time limits on how long a creditor has to sue you for not paying (statute of limitations). The time limits for most written contracts in Iowa is 10 years (there are shorter time limits on some). Iowa enforces judgments for up to 20 years. The mere passage of time is no guarantee your debt will go away.
With a merchant cash advance, a funder is basically buying something you may have in the future: your receivables. The basic legal definition of a loan is that it requires repayment. You have to pay no matter what your sales are. With a true advance, if there are zero sales, you may have no obligation to pay. Your obligation to repay is conditional (ie contingent) on your sales. If these were loans, 100% to 200% profits would be usurious by most states’ standards. There is a side that funders do not tell you: you may have rights a lawyer can help you with that you are not aware of. Some funding agreements are seriously flawed, and an experienced attorney can spot the difference.
When you signed your funding agreement, you likely signed a personal guarantee. This means that you guaranteed to pay personally if the business did not. The personal guarantee means that you cannot simply “dissolve” your business and walk away. The creditor may still go after you. Personal guarantees sometimes create incentive for you to file a Chapter 7 bankruptcy. Filing a personal bankruptcy under Chapter 7 discharges your personal obligation to pay, but leaves your business with its obligations. Filing a business bankruptcy may handle your business’ obligation but not yours. Subchapter V is a section of bankruptcy code set up to expedite small businesses. Subchapter V imposes a debt limit (currently about $3.4 million since April 2025). A bill to amend the debt limit (increase it to $7.5 million) passed Congress but is not law yet as of early October 2026.
If you settle your merchant cash advances and it results in a significant reduction in what you owe, that may trigger taxable income. A creditor may issue a 1099-C (cancellation of debt income) for canceled debt of $600 or more. In the eyes of tax officials, not having to pay a business debt is income to the debtor. There may be exceptions to the cancellation of debt income. For example, if you were insolvent at the time the debt was discharged, the amount forgiven may be considered tax-exempt to the extent you were insolvent. If you want to claim the insolvency exception, you have to complete Form 982 from the IRS and submit it with your tax return. Make sure to get a tax professional’s opinion.
The Lawyer’s Credentials
Before you hire a lawyer to negotiate your merchant cash advance, you may want to check the lawyer’s credentials (disciplinary history, real-world experience, etc.) to see if it fits your case. You can search attorney licensing status through the licensing division of the Iowa Supreme Court. While the Iowa State Bar Association does have a Find-A-Lawyer page, an attorney is not automatically included just for being licensed. The Iowa Supreme Court has a search function for public attorney discipline (reprimands, suspensions, revocations and disbarments). It’s not enough to be aware that disciplinary actions exist. Actually check to make sure your lawyer has a clean record before you hire.
Here in Iowa, the first attorney consultation through the bar’s directory was $25 or less for up to 30 minutes as of 2023, so it is a very affordable way to get some peace of mind. Talk with more than one attorney and compare their answers before hiring one. Take steps to preserve your options before your bank accounts freeze.
