2026 Best MCA Defense Lawyers in Alaska
Top MCA Defense Firms Serving Alaska - 2026
The Alaska Bar Lawyer Referral Service lists attorneys who are Alaska Bar members in good standing. It does not rate or rank them, nor give information about their backgrounds. It is up to you to ask any other questions you want answered: How experienced is your candidate? How much of the MCA work is done personally and how much by others? Does the lawyer work with merchant cash advance cases in general, or in negotiations or lawsuits specifically? If the attorney is not admitted where the lawsuit is, ask whether the engagement will include a local lawyer or extra court admission. And ask to confirm which business entities, owners, agreements, and lawsuits are covered before hiring the lawyer.
At your first meeting, bring your signed MCA agreements and personal guarantees to review, the names of your funders, account balances, daily or weekly withdrawal amounts, and bank statements. Remember to bring default notices and lawsuit papers if you’ve gotten any. Your lawyer will need to see the whole picture to help you best.
Delancey Street
Important: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company that works with a nationwide network of licensed attorneys - and that distinction matters. Their attorneys handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution for Alaska business owners. This is what they do. Their network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of whether your business operates in Anchorage, Fairbanks, Juneau, or Wasilla - and the evolving appellate case law that is reclassifying MCAs as loans subject to interest rate caps.
Here's where Delancey Street separates from every other firm on this list - MCA-specific legal firepower. Their attorneys don’t just negotiate - they fight. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the Alaska Department of Commerce, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent in funder negotiations. Over $100M in commercial debt settled. No upfront fees. Results-based pricing. But don't just take our word for it - call and see for yourself.
National Debt Relief
Important: National Debt Relief is not a law firm and is not an MCA defense specialist. There's no two ways about it - they are the largest debt settlement company in the United States, with over $1 billion in debt settled and 550,000+ clients served. They handle general unsecured business debts - credit cards, vendor accounts, lines of credit - but they do not challenge confessions of judgment, file usury defenses, or dispute UCC liens. If your Alaska business debt is primarily traditional unsecured debt and not MCA-specific, National Debt Relief is a strong, proven option. But if you’re dealing with MCA funders, COJs, or frozen accounts - that's a whole other animal, and you need a firm with MCA-specific attorney involvement.
CuraDebt
Important: CuraDebt is not a law firm and is not an MCA defense specialist. They've been in the debt resolution game for over 25 years - handling business debt, consumer debt, and IRS/state tax resolution. If your Alaska financial situation involves both MCA debt and tax obligations - including Alaska state tax issues - CuraDebt can address the tax side while a firm like Delancey Street handles the MCA defense. But here's the thing - they do not challenge COJs, raise usury defenses, or file legal motions against MCA funders. For that, you need a specialist.
If your business has taken several merchant cash advances at once, the funders’ payment withdrawals compete against each other for the same receipts. If you owe money from several MCA agreements, look at all of them together rather than dealing with one at a time. Write out which funder is taking what amount from your account how often, and the balance claimed by each. Total withdrawals against gross revenue, payroll, and rent. When you get a new advance offer, ask exactly which agreements will be repaid and which will stay open, and what the full cost of the financing really is - making another MCA or cash advance arrangement is not the same as fixing the problem.
A lawyer can review your reconciliation rights, past and present balances and fees, see if there’s a personal guarantee, and check for alleged default. Your attorney can negotiate for payment changes or a written settlement and defend a lawsuit and review any judgment. Other issues the lawyer can help with include a bank account restraint and UCC filing. The best lawyer, though, won’t promise to get your balances reduced, your lawsuit dismissed, or your frozen funds released.
Usury Laws
Alaska law matters, but unfortunately not on the right points. The state usury limit protects only debt of $25,000 or less. Payday lenders also come in for scrutiny by the state but only for personal loans, again not for business lending.
Taken as written, the documents typically define the business deal as a purchase of future receivables, not a loan. It’s possible for the arrangement to be a loan even without calling it that way, but whether an MCA is a loan legally depends on the particulars: the terms of the contract, the law that applies to it, and how the parties act. The label “Merchant Cash Advance” does not make the arrangement exempt from usury laws. The “factor rate” is different from an APR.
Some MCA providers estimate withdrawal rates, and some come with reconciliation provisions that account for ups and downs in receipts; what matters is what the written agreement says, and also what has actually been collected from you and how the provider responded when your revenues dropped.
Depending on the state, funders and brokers must tell you some things but not others. The FTC has brought a few enforcement actions, including one in 2022, the Richmond Capital case. Nevertheless, a suspected violation does not wipe out your balance, and it will not delay a court deadline.
You Are in Default
If a funder says you are in default, start with the actual notice, the provision of the contract it claims you broke, and your payment history. Bring guarantees, UCC filings, notices to your bank or payment processor or customers, and ask about consequences before you stop payments, sign a new agreement, or accept a settlement.
If the funder has sued, get the court, case number, names of defendants (both the business and its owner may appear), and deadline for the response. Talking settlement does not extend the deadline or release restrained funds. Contacting a lawyer does not pause the lawsuit.
That a confession of judgment is in the merchant cash advance documents doesn’t mean it can be used lawfully. Whether it is any good depends on the state and the facts of the case. In Virginia, confessions in covered sales-based financing are unenforceable in court. Under New York law since August 2019, a confession of judgment in the MCA papers generally cannot be entered in New York courts against an owner living outside New York. Get the MCA paperwork, judgment, court docket and notices reviewed promptly and ask about challenges and deadlines. Also remember that Alaska contract lawsuits generally have to be filed within 3 years unless the contract waives it or another law says otherwise.
Written Fee Agreement
Once you have picked someone, set up a written fee agreement, especially if the cost looks like more than $1,000. The agreement should set out the basis or rate of the fee, and the scope of the work to be done. The bar also offers a fee arbitration process that could decide a dispute over more than $5,000. The decision of the 3-member panel, which must include a non-lawyer, is final and binding on both of you.
Do not wait too long to get help if you are facing mounting pressure, even if you are paying as agreed. Talk to a lawyer about all your advances so you can see and get advice on their effect together.

Delancey Street is not a law firm, but their attorney-coordinated model delivers the legal firepower of one combined with the settlement expertise of a dedicated debt resolution company. National Debt Relief
Not an MCA defense specialist - and that's an important distinction. National Debt Relief handles general unsecured business debt - credit cards, vendor accounts, lines of credit. No COJ challenges, no usury defenses, no legal motions. If your Alaska business debt is primarily traditional unsecured debt (not MCAs), they are a proven option with massive scale.
CuraDebt
Not an MCA defense specialist - let's be clear about that. CuraDebt handles business debt and IRS/state tax resolution. No COJ challenges, no usury defenses. Best used alongside an MCA defense firm if your Alaska business also has tax obligations to resolve.
