2026 Best MCA Defense Lawyers in Charlotte, NC

Bottom line: If you have a Merchant Cash Advance (MCA) problem, I’ve fielded plenty of calls from North Carolina business owners looking for the best MCA defense lawyer in Charlotte or any other city there in the state. In 2026, the honest answer is the same: there is no officially ranked list you can find online and trust. The North Carolina State Bar has said on its web site it cannot recommend a lawyer. You should, instead, focus on finding an MCA defense lawyer who is NC licensed, has lots of experience dealing with MCA funders and enforcement, is covered by insurance, and makes clear what their fees will be.

Top MCA Defense Firms for Charlotte Businesses - 2026

An MCA attorney can litigate. A settlement company just negotiates. You need an attorney if any of these happen:

  • a confession of judgment is filed;
  • your bank account is frozen or restrained;
  • you are sued;
  • receivables are seized by court order.

Delancey Street

Attorney-Coordinated MCA Defense & Settlement - $100M+ Settled Nationwide

Let’s be clear: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company that works with a nationwide network of licensed attorneys - attorneys who handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution for Charlotte business owners. Their attorney network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of whether your business is in Uptown Charlotte or University City.

For Charlotte’s banking-adjacent businesses, hospitality companies, and growing tech sector - Delancey Street’s attorneys don’t just negotiate. They fight. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the North Carolina Secretary of State, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent. Over $100M in commercial debt settled. No upfront fees.

CuraDebt

25+ Years in Business Debt & Tax Resolution - IAPDA Certified

Let’s be straight: CuraDebt is not a law firm and is not an MCA defense specialist. They handle business debt, consumer debt, and IRS/state tax resolution. If your Charlotte business situation involves both MCA debt and North Carolina or federal tax obligations, CuraDebt can address the tax side while a firm like Delancey Street handles MCA defense. They don’t challenge COJs, raise usury defenses, or file legal motions against MCA funders.

Best for: Combined business debt and tax resolution - IRS/state negotiations, multi-layered financial situations (not MCA-specific defense)
Years in Business: 25+
Tax Resolution: Yes (IRS & State)
MCA Defense: No

A settlement company cannot go to court or file a motion to vacate. An MCA defense lawyer can make motions, challenge confessions of judgment, and attempt to vacate a confession of judgment. They may also challenge any UCC liens. If a bank account is restrained by order, they can also move to vacate that restraint. All of these actions take place through the courts.

Legal Protections for Businesses

In North Carolina, where Charlotte is, there are legal protections if you have trouble repaying a merchant cash advance. Under Rule 68.1 in NC law, a confession must be in writing and signed by the defendant. The defendant must swear to it or verify it in some way. It can only be entered into a court in the NC county where the defendant lives, has property, or where the plaintiff lives. Attorneys may boast about using a usury defense against MCA funders in North Carolina, but usury claims cannot be used as defense to loans made to “non-natural” borrowers like LLCs or corporations, under NC Section 24-9.

In 2019, NY also made a change to the CPLR that matters for NC borrowers. Now, confession of judgment filings can only be processed in NY counties where the defendant actually lives. So, if a funder tries to use a New York confession judgment on an out-of-state borrower, including NC ones, it won’t fly. If you get sued on an MCA, and a foreign judgment gets filed against you in North Carolina, you have 30 days from notice to seek relief.

Due Diligence

To do proper due diligence vetting any lawyer anywhere in North Carolina, you can check the attorney’s disciplinary record by searching the database of disciplinary orders from the North Carolina State Bar, found online. You can also call them at (919) 828-4620. The State Bar keeps a list of factors everyone should look at, including:

  • does the lawyer have an active NC license?
  • Does the lawyer have experience doing work in this practice area?
  • Does the lawyer have malpractice insurance?
  • Do they have clear billing policies for fees? Staff fees? Expenses?

If bankruptcy is on the table, business bankruptcy lawyer choices in North Carolina include those board-certified as specialists. They passed a 6-hour, extensive exam and get recertified every five years. To qualify for Subchapter V restructuring in 2026, debt of the filing debtor must be $3,424,000 or less. This does not apply to debts of insiders or affiliates. To be counted as debt, it must be non-contingent and liquidated.

Negotiation vs. Litigation Approach

Legal fees can stack. If there is one MCA funder suing you, it might be $3,000 to $10,000 in legal costs. But if you have 5 MCAs, it could be $25,000 to $50,000 in legal fees before any cash goes toward the debt. And under a typical settlement company agreement, they’ll take 15 to 25% of the total debt involved as their fee.

If you get sued over an MCA, it can take six to 18 months or even longer for the litigation to drag out. A settlement firm is not a law firm, but it can typically get done faster, from 30 to 90 days per account. Despite talk of such firms being a saving grace in MCA debt problems, there are red flags to note. There’s no legal licensing needed to set one up.

One of the first things lawyers tell clients with MCA problems is to block the ACH (Automated Clearing House) debits. Virtually every MCA agreement deems you in default once you block or hinder the payments being made under your MCA. It’s a basic piece of strategy for both the settlement approach and the lawsuit approach in most instances. On the settlement side, the ACH stop is often joined with a settlement offer right away, or sometimes even before, in part to try keeping the legal process out of the picture.

The big difference between a negotiation vs. litigation approach when it comes to stacked MCAs comes down to approach and cost. A lawyer has to treat each one as a separate suit and, depending on who the funders are, they may be in different jurisdictions (court areas). And there are separate retainers per funder often demanded. Most negotiation settlements handle the different funders all in one shot. The negotiation team also prioritizes which funder to start with by which one is closest to suing and who is most aggressive in their demands for payment.

It can often be a good idea to hire a lawyer to fight the lawsuit filed by one MCA funder, while retaining a settlement firm to deal with the other funders you have not been sued by yet. This is more common than you might think. The ideal time to settle an MCA debt problem is before a suit is filed. It costs more money once a suit is in motion.

But the main point is never to sit and wait for the ball to drop. MCA funders don’t operate with long pauses or gentle reminders. If you wait, the MCA funders will escalate within days, not weeks. It’s time to pick a path now, not later.
