2026 Best MCA Defense Lawyers in New Mexico
Top MCA Defense Firms for New Mexico Businesses - 2026
When someone says “we handle MCA debt” it can mean different things. One company might only talk to your funder about paying off what you owe. Another might offer you a new advance or try to collect money so they can make a settlement offer. But just because a company offers to negotiate doesn’t mean you’re in an attorney-client relationship.
Legal help may be important if there is a lawsuit, disputed personal guarantee, restraint on funds, UCC demand or question about what the MCA contract means. But remember that “attorney backed” answers nothing. What is the arrangement? Are litigation and court appearances included, or does it end when the informal conversations do? Also, never forget to ask to verify that a lawyer who claims to be acting on your behalf is licensed and in good standing with the New Mexico Bar.
Delancey Street
Let's be clear - Delancey Street is not a law firm. They're a specialized MCA debt settlement operation that works with a nationwide network of licensed attorneys who handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution on behalf of New Mexico business owners. Their network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of whether your business operates in Albuquerque, Santa Fe, or Las Cruces - and the evolving appellate case law that is reclassifying MCAs as loans subject to interest rate caps.
Where Delancey Street separates from every other firm on this list is MCA-specific legal firepower for New Mexico businesses. Their attorneys don’t just negotiate - they challenge. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the New Mexico Secretary of State, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent in funder negotiations. Over $100M in commercial debt settled. No upfront fees. Results-based pricing.
National Debt Relief
Important: National Debt Relief is not a law firm and is not an MCA defense specialist. They’re the largest debt settlement company in the United States - over $1 billion in debt settled, 550,000+ clients served. They handle general unsecured business debts - credit cards, vendor accounts, lines of credit - but they do not challenge confessions of judgment, file usury defenses, or dispute UCC liens. If your New Mexico business debt is primarily traditional unsecured business debt and not MCA-specific, they’re a strong option. If you’re dealing with MCA funders, COJs, or frozen accounts - you need a firm with MCA-specific attorney involvement.
CuraDebt
Important: CuraDebt is not a law firm and is not an MCA defense specialist. They’ve been in the debt resolution business for over 25 years - handling business debt, consumer debt, and IRS/state tax resolution. If your New Mexico financial situation involves both MCA debt and tax obligations - including New Mexico Taxation and Revenue Department issues - CuraDebt can handle the tax side while a firm like Delancey Street handles the MCA defense. They do not challenge COJs, raise usury defenses, or file legal motions against MCA funders.
If you have been served, tell the law firm your deadline to respond, and give them the full court papers, summons, proof of service and any other documents you received. Setting up a lawyer meeting or signing up for a settlement program does not change the deadline for you to answer the Complaint.
What New Mexico Law Adds
If a New Mexico court is faced with a judgment from another state in which a “confession of judgment” clause, in the underlying contract, was used to confer jurisdiction, it will not enforce it. The judgment also may not become a lien on New Mexico real estate. New York made a crucial change in 2019 to CPLR 3218; a private creditor filing a confession of judgment may do so only in the county where the debtor lived at signing or lives at filing. In practice, this has the effect of blocking filings against debtors from a different state. Government agencies are exempt.
In New Mexico, a lawsuit on a written contract must be filed within six years after the cause of action accrues. Confession of judgment clauses also draw federal scrutiny: in February 2024 a federal court ordered MCA operator Jonathan Braun to pay $20.3 million. His business was charged with misusing confession of judgment clauses in its contracts, in an FTC case. It matters that you choose a lawyer who understands those rules. If bankruptcy comes up, subchapter V is generally only available to a debtor with noncontingent, liquidated debts of $3,424,000 or less as of January 1, 2026.
Check a Lawyer for Your Case
In New Mexico you can easily find and check a lawyer for your case online, using the State Bar of New Mexico’s online member directory. If you know you need a specific type of legal help, you can select that to narrow the search. You also can search for lawyers by county or if you need someone who speaks a language other than English. Check them in advance, because as of November 2023 the State Bar did not offer a lawyer referral service.
In New Mexico you can call the Disciplinary Board and ask about any public formal discipline on a lawyer. Formal charges are public record and hearings are open. Check the individual lawyer that you are thinking of hiring, even if he or she mentions being part of a “team” or “network.”
Questions Before Signing
Who am I a client of? Which MCAs, funders and contract types are covered? Is it just me, or is my business included? Ask to verify in writing the terms you are hiring and especially the scope and limitations on the service, who is paying the fees and where the payments go. If there is a suit, find out if the lawyer or company you hire will defend you against it. Ask what it includes: reviewing service, going to court, writing, filings, phone calls, research and appeals if needed. If different from the MCA service, which law firm is on your file?
Get the fee structure, payment dates, costs and cancellation terms in writing. In New Mexico, for a case charging a contingency fee, you need to sign an agreement showing how the fee and expenses will be calculated. Ask the law firm for updates, and request copies of any proposals or filings.
If the company wants one payment covering different MCAs, get a breakdown for how the money will be divided. If some will be held for settlement offers, verify how much for whom, who holds the account, in whose name, who can withdraw and the basis and date for refund of unused funds.
Paying into a program is not payment to your creditor; a creditor getting a check is not proof of a settlement; and debt negotiations, as such, don’t make your funder stop collection or lawsuit actions. When you are relying on a settlement proposal or payment plan, make sure to get the terms in writing, who and what accounts are covered, and how payments will be scheduled, and what happens in the event of missing or late payments; also, what liens, guarantees or obligations will be released. For a payment plan or promise, be sure to keep proof of making your payments, so you can verify the funder got them and that they were credited as promised.
An offer of a low “limited scope” service (like reviewing a Complaint or writing one filing) may save money but only if you know what’s in it; the fee for that may not cover hearings, discovery or negotiations. A higher price doesn’t guarantee a better outcome either. Compare services, responsibility, experience, communication and the total cost, then set up a clear arrangement. No honest lawyer should promise a particular amount of time for “safety” just because of a filing. Procedures, judges and outcomes vary. Litigation should answer real legal issues; not sold as guaranteed delay.
Warning signs: you are promised a guaranteed settlement percentage, before the contract has been reviewed; told to stop all payments without discussion; told enrollment ends any lawsuit or restraint of funds; you’re never told which attorney is taking responsibility.
While you’re listening to a sales pitch, you don’t need to decide on the spot whether to accept it or hand over money. Find out what they offer; the best ones will commit it to writing, with questions answered. If someone won’t do that, or a promise is what matters most to you, press for specifics on where it appears in the agreement and the scope of what it includes.
