Bottom line: Want the best MCA defense attorney in Tennessee? Rule number one is to expect marketing, not a reliable list. Search instead for an attorney with an active Tennessee law license, regular Tennessee practice, and a good record of New York legal representation. In Tennessee, there is a free online lawyer directory at the Tennessee Board of Professional Responsibility. It tells you whether someone is licensed to practice in Tennessee, and whether they have received any public discipline. Remember that the Tennessee Bar Association does not refer lawyers directly, but sends you to local referral services in Nashville, Knoxville, Memphis, and Chattanooga.
Top MCA Defense Firms for Tennessee - 2026
If you agreed to a contract that named New York as the exclusive venue and New York law as the choice of law, this is the court and jurisdiction where the case will happen. You will usually need to call a New York attorney or try to find a Tennessee lawyer who can associate a New York lawyer.
Here's what you need to know: Delancey Street is not a law firm. They coordinate with a nationwide network of licensed attorneys who do the actual fighting - COJ challenges, usury defenses, UCC lien disputes, funder negotiations. Their attorney network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of whether your business operates in Nashville, Memphis, Knoxville, or Chattanooga. This is what they do.
Their attorneys don't just negotiate - they challenge. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the Tennessee Secretary of State, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent in funder negotiations. Over $100M in commercial debt settled. No upfront fees. Results-based pricing.
Best for: Tennessee business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens who need immediate attorney-coordinated defense

Not an MCA defense specialist - and they'll tell you that straight up. National Debt Relief is the largest debt settlement company in the United States, with over $1 billion settled and 550,000+ clients served. They handle general unsecured business debts - credit cards, vendor accounts, lines of credit - but they don't challenge confessions of judgment, file usury defenses, or dispute UCC liens. If your Tennessee business debt is traditional unsecured debt and not MCA-specific, they're a proven option. If you're dealing with MCA funders, COJs, or frozen accounts - you need a firm with MCA-specific attorney involvement.

Default Happens Fast
Merchant cash advance lawsuits move fast. This means a clock is running in the lawsuit, from the day you were served. Your time limit depends on the court and state law. In New York, default can come in as little as 30 to 45 days from the date of service. In Tennessee, you have thirty days to file a written answer after you are served with a lawsuit. Tennessee law also requires that in chancery or circuit court, the side wanting judgment must give notice of a default hearing at least five days in advance. You must react quickly.
If you do not respond in time, a default judgment will likely be entered against you. The lawsuit process is not over, but the other side has won and has a paper from the court saying that you owe the money. Once there is a judgment, your bank accounts are fair game. A restraining notice to your bank is sent, and the bank typically freezes your accounts within hours. An account freeze is often how you realize you were sued. Undoing a default judgment takes both a real excuse and a legal defense.
Most MCAs have a personal guarantee. This means a judgment against you individually, brought to Tennessee, can be enforced by garnishing your wages. Federal law puts a cap on what can be taken from a paycheck, though. It is either 25 percent of disposable earnings or whatever is above 30 times minimum wage, whichever is less.
Whether a merchant cash advance company is trying to collect, or has already sued you, your lawyer is going to be focused on the first days. Which payments are going out, and how much? Are payroll and other essential expenses protected? The MCA lawyer needs to find out if you’ve received service of a lawsuit in New York or Tennessee. If you did, did you respond in time? Have you been served with a judgment? Is there time for an emergency stop to the lawsuit?
A Usury Defense
One of the best defenses to an MCA claim can be a usury defense, if this is really a loan in disguise. The advance contract often contains a reconciliation clause. The reconciliation clause is what your lawyer will read first, because it is how you check whether the deal was set up as a loan and not an MCA. Courts usually look at a number of other signs besides the reconciliation clause, such as whether the contract has a fixed term, and whether you will still have to pay if your business goes bankrupt.
Confessions of judgment in MCA deals are getting harder to use. In Tennessee, a confession of judgment signed before suit is void, under a law that protects borrowers from losing their case before the lawsuit even begins. Before August 2019, New York had few limits on getting someone to agree, in advance, to a judgment being taken against them. Since then, a confession of judgment can be filed only in the county where the debtor lives or does business. The old confessions can still come back. A payoff that adds a new confession should also get a hard look from your attorney. Many cases where the person denies receiving the paperwork need a review for good service. The registered agent may no longer exist, or the plaintiff may have sent it to an old address.
Settled Out of Court
MCA lawsuits are settled out of court a lot. If you decide on a settlement, this can happen almost any time during the case. You can save by filing an answer and making the other side bargain. Settlements often involve lump sums that are 40 to 70 percent of the balance owed. When you settle, insist on getting a form called a UCC-3 termination.
When you get an advance, the funder usually files a UCC-1 lien against your business receivables, meaning that they can go after them if the advance is not paid. This blocks most business loans, SBA loans, and bank lines of credit. Even after you pay or settle, the lien can stay on file unless the other side files a UCC-3 termination.
To save your company and keep your house, sometimes settling is not enough. Stopping collections without bankruptcy is a good idea when you can do it. The automatic stay halts almost all collections in bankruptcy. Paycheck garnishment and asset seizure (levies) both stop when you file. Subchapter V gives small businesses more options for Chapter 11 cases, making them faster and cheaper.
If you hire a lawyer on contingency, contingent fees in Tennessee must be in writing, signed by you, and say what the lawyer’s percentage is, and how expenses are handled. You need to read this carefully before you sign it.
Call a lawyer first. Do not try to cancel the ACH yourself. You can trigger a default and a lawsuit by changing the terms on your own. Many of the most powerful defenses in an MCA fight are time-limited. Make a list of all funders, contracts, and lawsuits, with dates.
