2026 Best MCA Defense Lawyers in New Jersey
Top MCA Defense Firms in New Jersey - 2026
That clause is often buried in the fine print. That means you need a lawyer licensed and familiar with New York law and New York courts.
Courts in this country will usually enforce these clauses, and New Jersey treats them as presumptively valid. There are only three narrow exceptions where they don’t:
Delancey Street
Let's be clear - Delancey Street is not a law firm. They're a specialized MCA debt settlement operation working with a nationwide network of licensed attorneys. Their network is built around New York’s dual usury framework and the evolving case law reclassifying MCAs as loans.
For New Jersey business owners, Delancey Street’s attorneys face a unique challenge: New Jersey allows confessions of judgment, meaning lenders can obtain judgments in New Jersey courts without notice. The defense strategy combines COJ vacatur motions in New Jersey Superior Court with usury challenges under both N.J.S.A. 2C:21-19 (30% criminal cap) and New York’s 25% criminal threshold. The New Jersey Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) provides treble damages and attorney fees without requiring proof of intent - a powerful settlement lever. The New Jersey Division of Consumer Affairs provides regulatory oversight. Over $100M settled. No upfront fees.
National Debt Relief
Not an MCA defense specialist. Handles general unsecured business debts but does not challenge COJs, file usury defenses, or dispute UCC liens.

CuraDebt
Not an MCA defense specialist. If your New Jersey situation involves both MCA debt and tax obligations - including New Jersey Division of Taxation or IRS issues - CuraDebt can address the tax side while Delancey Street handles MCA defense.
- fraud or the other side’s overpowering bargaining power;
- a serious conflict with strong New Jersey public policy; or
- serious difficulty and inconvenience if the case is tried in the place the contract says it has to be.
Those are very high standards.
Answer deadlines depend on where a lawsuit is, not where you are. A lawyer must know how and when to answer for you wherever the other side starts an action. The New York rules are normally going to control your case here. Courts there generally allow you 20 days to answer if you were served in the state, 30 if you were served any other way.
Funders sometimes choose to sue in New Jersey. If so, you probably have 35 days to answer. You’ll get an extra five days if you were served by regular mail. It used to be three extra, but it changed on April 1, 2022. Check with a lawyer to make sure.
A New York judgment does not automatically collect from your accounts in New Jersey; the New York creditor still has to go to the trouble of filing an authenticated copy in the New Jersey Superior Court. There is just one Clerk for the whole state. Once it does, the judgment can be enforced like a New Jersey one.
You get a notice of the filing from the Clerk, after it happens. There’s no deadline when it has to come. You don’t get an execution until at least two weeks from the filing. The clock doesn’t run from when you get it, but from the time it’s filed.
If you ignore the lawsuit in New York, you make things easier for the other side. The judgment travels easily to New Jersey and is hard to get out of there.
At this stage you don’t normally re-argue the facts. You’ve got to stick with a very small group of defenses. If you did argue that the New York court had no power over you, but they decided it did, that claim is over. It is only good if you defaulted and didn’t argue it.
New Jersey does not have a homestead exemption. Your house may be in danger. In New Jersey, they can attach up to 10% of an individual defendant’s income. You don’t get these protections unless you’ve signed a personal guaranty. They’re for people, not businesses. If you signed one, the risk shifted to you, and the New Jersey limitations will kick in. The business operating account can be emptied.
New Jersey has a civil usury limit of 16 percent and criminal usury rates above 30 percent for individuals, and above 50 percent for corporations. It is a second-degree crime, with a fine up to $250,000, to knowingly run a business of lending above those limits. An MCA isn’t considered a loan on its face, but it can be if you look beyond the name.
Yellowstone settled the New Jersey Attorney General’s lawsuit in January 2023, for over $27 million. The attorney general said its fixed-payment MCA contracts were really small-business loans at far more than the allowed interest rate, and Yellowstone would give $21.7 million in debt relief. In January 2025, the New York Attorney General’s office struck a deal with Yellowstone, cancelling $534 million in small-business debts nationwide and keeping it out of the MCA business forever.
A confession of judgment can’t be entered in New Jersey, except by a motion with notice, with the original paper and an affidavit of the total amount due. One that does get entered in a different state can still be enforced here. There is no commercial financing disclosure law in New Jersey. There’s a bill, but it’s pending. That means what’s in your agreement counts for a lot.
Attorney Ethics
Before you hire a New Jersey lawyer, it’s a good idea to look at the New Jersey courts site for Attorney Ethics and Discipline. There, you can look up past cases of discipline, find the right district ethics committee, and file your own complaint. To be certified as a New Jersey civil trial attorney, you must have five years in good standing with the bar, and take a written exam, among other conditions.
New Jersey Rule of Professional Conduct 1.5(b) changed on April 1, 2025. This says a lawyer has to put it in writing near the beginning what they’ll charge you, whether it’s by the hour or some other way. It also says they have to put later changes in writing too. In a fee dispute, you can ask the District Fee Committee to arbitrate your case. There’s a $50 fee to file, but they won’t go to work until they get it. The lawyer may inform you of your right to go to arbitration before suing you. If they do, you only have 30 days to go for it, and lose your chance after that.
Whoever you hire, never ignore a lawsuit. If you don’t answer before the deadline, the other side can get a “default judgment” against you. In some courts and some cases you can undo a default judgment, but the best way is to answer on time, in the right place. Get a copy of everything you agreed to, as soon as you can. What it’s going to take to defend or cut down the case will partly be in the MCA agreement and things that go with it. You should talk to a lawyer before you make a decision. The best is one who practices in the court where your case will be.
