A UCC lien is a public filing that gives a creditor a security interest in your assets - it is not an enforcement mechanism. What actually freezes your account is a restraining notice, an execution, or a levy issued after the MCA funder obtains a court judgment. If your account is frozen, there is almost certainly a judgment behind it - either from a lawsuit or a confession of judgment (COJ). Call (888) 559-0156 for emergency help unfreezing your account."

A restraining notice is a post-judgment enforcement tool - served on your bank under CPLR §5222 - that orders the bank to freeze your account up to the judgment amount. The restraining notice is what actually stops you from accessing your money. Two completely different legal instruments with completely different effects."

If you negotiate a settlement that includes a release of the restraining notice, the bank typically releases funds within 1-3 business days after receiving the release. The key is getting an attorney involved immediately - every day the account is frozen, your business bleeds."

In MCA cases, judgments are typically obtained through one of two paths: (1) a confession of judgment (COJ) - a document you signed as part of the MCA agreement that lets the funder obtain a judgment without a lawsuit; or (2) a default judgment from a lawsuit you were never properly served with. Either way, the judgment can be challenged. COJs can be vacated under CPLR §3218. Default judgments can be vacated under CPLR §5015."

They monitor public records and can serve restraining notices on any bank where you hold funds. Opening a new account without addressing the underlying judgment is a temporary fix at best - and it does not solve the problem. The real solution is to challenge the judgment, negotiate a settlement, and get the restraining notice released."

Doing nothing is the worst possible strategy. Every day you wait, the damage compounds."

Bank account frozen? It is not the UCC lien - it is a restraining notice. Get help now.

Best Companies to Help If a UCC Lien Froze Your Bank Account - 2026

Bottom line: When a business account is frozen the most common explanation from owners is that “someone sued and won a judgment,” or that a UCC lien filed by an MCA caused the bank to freeze the account.

Top Companies to Unfreeze Bank Accounts and Fight MCA Judgments - 2026

A UCC lien alone does not trigger a frozen account. If you think a UCC lien triggered the frozen account, the first thing to ask is whether you have signed a “confession of judgment.”

A business debt settlement program that works with attorneys and asks the right questions helps here. At no extra cost to you, your debt settlement company can assign an attorney as soon as a lender files a UCC lien or lawsuit against you.

#1

Delancey Street

Emergency Bank Unfreeze & MCA Judgment Defense - $100M+ Settled Nationwide

Important: Delancey Street is not a law firm. They are a specialized MCA debt settlement company that works with a nationwide network of licensed attorneys - attorneys who file emergency motions to unfreeze bank accounts, vacate MCA judgments, challenge restraining notices under CPLR §5222, and settle MCA debt at 30-60% of the outstanding balance. When your bank account is frozen, their attorney network moves within 24-48 hours.

Here is exactly how it works. You call Delancey Street. Their team identifies the judgment behind the freeze - is it a COJ or a default judgment? They determine the court, the county, and the funder. Then their attorneys file an emergency Order to Show Cause with a request for a temporary restraining order to lift the bank freeze. Simultaneously, they attack the underlying judgment - challenging defective COJs under CPLR §3218, improper service under CPLR §308, or lack of jurisdiction.

While the legal fight unfolds, the settlement team opens negotiations with the funder. Frozen bank accounts give the funder leverage - but a vacatur motion takes that leverage away. Funders prefer to settle at 30-60% rather than risk losing the judgment entirely. That is the play. That is how your account gets unfrozen and the debt gets resolved.

Best for: Business owners with frozen bank accounts who need emergency court relief and MCA debt settlement
Total Settled: $100M+
Emergency Motions: 24-48 Hours
Judgment Vacatur: Yes

A UCC-1 is a public filing with the secretary of state in which a lender claims your future receivables, often a blanket lien on the assets of the business. It is not a lawsuit or judgment. It stays until a UCC-3 is filed or the original filing lapses, generally five years later. It makes it harder to get new financing for the business.

A UCC-1 filed against a bank account does not perfect a lien. To perfect the lender needs “control,” and there are three ways to achieve that.

  • 1) Lender is the bank that holds the account.
  • 2) Lender gets a signed control agreement with debtor and bank.
  • 3) Lender becomes the bank’s customer on the account.

A Court Judgment Without Filing a Lawsuit

A confession of judgment signed at funding lets the creditor obtain a court judgment without filing a lawsuit the debtor has a chance to answer. In New York, the freeze commonly comes as a restraining notice, issued by the court clerk or the creditor’s attorney after the creditor gets the judgment, and served on the bank. Confessions of judgment have a long history in New York, and a tradition of getting used in agreements with out-of-state businesses. That practice was narrowed recently. They still show up in MCA agreements, and rules vary by state. Not every MCA agreement has one.

Money pressure from a lender usually falls on incoming money. Customers or processors may say that the funder contacted them, or you find that some funds you expected simply never hit your account. Under an account freeze, it is your own bank that tells you of the freeze. If what arrived is a lawsuit, a summons, that is a third category of paper, and one that demands its own deadline to respond in. A lawsuit is not a judgment and it is not a lien.

If your funder was Yellowstone Capital, the good news is that the New York Attorney General negotiated a settlement: all outstanding balances automatically cancelled. The last judgement against a Yellowstone debtor was vacated in December 2025.

How Bad a Frozen Account Is

A freeze or restraining notice does not reach everything you own. If it hits a bank, it just hits money in the bank account. It does not grab your house or your car. In New York, a restraining notice lasts 1 year from service unless the judgment that brought it gets satisfied or vacated. If the bank holds twice the amount of the judgment, the other money is not bound. How bad a frozen account is depends on how much you keep there. If the account is nearly empty, the business can open a new account and keep going. If the account holds cash that your operations need, you face a real emergency.

If the account has already frozen, there are usually two ways. One is to settle that position now, because now the lender has leverage so it usually wants more, closer to the original balance. Another is to stabilize first with cash through a new account, letting leverage rebuild, because even a lender that can’t collect now will want a deal eventually. The right path for you depends on how much cash is frozen and how long your operations can run without it. Discuss the situation with your representative, and with your debt settlement company’s assigned attorney.

After default the lender can send notices to your customers and payment processors demanding they pay the lender instead of you, and some of them will. While a real threat, it is only a demand notice, not a court order. Some keep paying you. Others put money on hold, waiting for things to get sorted out. Others redirect payment to the funder. Often when notice goes out to the customer, the call goes to counsel, and often customers continue paying you after that. Facing notice to a payment processor, some owners added a backup processor, or moved to another one. Some changed where customers send payment. What is worth trying, and what works, depends on agreements in the specific case. These things are general patterns, not instructions.

Normally the passage of time is the main force in settlement. A lien choking the money that keeps your business breathing changes that. Settling that position can be moved up, sometimes within weeks. When a position settles, the settlement can include a UCC-3 termination, so that public record matches what is already settled.

Find Out Early

If you know about your confession of judgment early, you usually do better than if you find out after the freeze. Some moved the operating account to a smaller bank or a credit union before the freeze. That is manageable if you have months, but not so much when you have a week. If you get paid by Medicare or Medicaid or some other government payer, it is worse: it can take 60 to 90 days to change where that payment gets deposited. Raise the question of a COJ in your very first conversation with any company. You do not want to be learning about this for the first time when the bank calls about your account.

Sometimes the right help is a bankruptcy lawyer. A bankruptcy petition triggers an automatic stay that prohibits collection actions, including ones on bank accounts. There is a petition for small business cases called “Subchapter V” with a $3,424,000 debt limit.

When most money comes in from a few places, a funder can send notice to the big ones, and they will notice that. No one cares about the guy running the deli around the corner. When payers are small and dispersed, then collection pressure usually shifts to card processing, which tends to be more manageable. Some merchants are not good fits for a settlement program:

  • merchants who get paid mainly by private health insurance;
  • floor-plan automobile dealerships;
  • marketplace sellers advanced money by the marketplace.

Whether or not you had a confession of judgment, a business lien is one stage you are going through. It is not a verdict. The right company tells you straight up if the program will not be a fit.
