2026 Best Business Debt Settlement Lawyers in Charlotte

Bottom line: If your Charlotte business is behind on merchant cash advances, the short answer is: hire a law firm. But which one? First things first: hire a lawyer licensed in North Carolina. Whatever you do, make sure that your law firm is able to do all three things: negotiate your balance down to a lower payoff, fight lawsuits to earn you time, and even file bankruptcy if need be. Debt settlement companies rely on their employees and non-lawyers who don’t have such expertise. Negotiating with a lender is just a tiny, small part of what a real law firm has to do.

NC Debt Settlement

NC debt settlement is actually called debt adjusting, and so-called debt settlement companies are forbidden to charge fees to individuals in NC before a settlement is completed. In other words, you shouldn’t pay for NC debt settlement until all the work is done. The law exempts a lawyer who’s licensed in NC, who is also not employed by a debt adjuster.

The sales pitch: the people you’ve communicated with, who call themselves NC debt settlement professionals, are really good at selling their services and embellishing on their expertise in debt and collections. They try to get you to sign on the dotted line and give them money before anything is done.

What often happens next: Soon your bank accounts are frozen. Still no results. Ultimately, you move on to someone else, and can’t get the money you already paid to the debt adjuster back. The up-front fees are no longer yours. On top of that, your funder will make you pay thousands of dollars in fees under your contract.

Legal Battles

If your lending agreement has UCC language in it, expect your funder to ask your payors to dish out payment to the funder instead of you. The scary part of this legal strategy is not the bank account freeze you might have seen already. Creditors can also grab your receivables when the money is still “in flight.” If you gave them a customer list, the funder sends form letters asking for payment directly from them. A lien notice also goes to your merchant processors, including Square, Stripe, PayPal, or whatever services you use to process credit and debit card transactions. Your customers may take the service of a lien notice as a sign of weakness on your part. They may take their business elsewhere. Whether you pay the debt is secondary to who controls your receivables.

A confession of judgment is a scary piece of paper. Sign one, and you give up the right to mount a defense in court. New York banned confessions of judgment against out-of-state business in 2019. To evade the new law, so-called New York funders file them in “friendly” jurisdictions including Texas, Illinois, Utah. Out-of-state funders try to “domesticate” their confession of judgments in the state where the small business “debtor” is located. A Charlotte debt negotiation law firm can help you if your funder domesticates your judgment in NC, or you are sued in state court. Legal battles take time to play out. This process will buy you time to keep your business going and raise funds to settle or fight.

Loans and merchant cash advances are not the same thing. What advances usually are, or at least try to be, is a simple sale of future income. With a true advance, the “loan” does not have to be repaid to the funder on any fixed schedule. The funding company’s money will be returned only from the business’s revenue, so such a sale of future receivables is not a true loan: the funder is taking a gamble on the future in the same way you are. Also, there is no way a loan can legally accrue profits in the range of 100% to 200% because of usury limits in most states, and some advances do. When one is really a loan, a skilled lawyer can find evidence the funder’s contract is void.

Brokers don’t make money unless you get funded. A broker’s job is to get as many deals signed as possible. Brokers are also happy to stack different funding contracts onto each other to make their commission check that much bigger. A lawyer can also file claims against brokers during litigation.

Settlement offers are quoted as a percentage of the debt paid back. So a “40% settlement” means you pay 40% of the debt and the rest is forgiven.

Most advances carry a personal guarantee, and personal bankruptcy wipes out your own liability to the funder but the business’ responsibility will continue. Likewise, a corporate bankruptcy leaves you personally liable: the personal guarantee remains. Small business Chapter 11 (Subchapter V) is a good option for businesses with qualifying debts of $3,424,000 or less. The filing fee is $1,738.

SBA 7(a) or 504 loans: The only real solution is an Offer In Compromise, also known as SBA Form 1150. You must submit the offer together with a complete financial statement. For SBA EIDL loans that go to Treasury Cross-Servicing, the U.S. Treasury conducts collections, not the SBA.

Your Attorney Must Be Licensed in NC

One: as mentioned, your attorney must be licensed in NC. Two: make sure the lawyer has debt litigation experience. Find out whether the lawyer has previously handled cases like yours. Three: feel comfortable with the lawyer’s fees. Discuss payment arrangements with the lawyer and make sure you understand the terms of paying for services. According to NC ethics rules, lawyers have to inform you, normally in writing, how their fees are calculated, what their rates are, and the scope of the work. The amount must not be clearly excessive. To charge contingent fees, NC lawyers have to give you a writing, signed by you, showing how it will be calculated. To earn NC certification in bankruptcy, a lawyer has to have averaged 500 bankruptcy hours a year over five years, and never less than 400 hours.

In North Carolina, most contract claims have to be filed within three years. If you’re in trouble, you should take action as early as you can. Create a list of all loans and cash advances (and brokers). Go through the loan agreements and highlight the personal guarantees and UCCs. If you’re behind on payments, talk to a lawyer today.
