2026 Best Business Debt Settlement Lawyers in Denver
Reviewed by NYCCriminalAttorneys.com Blogging Team · Last updated
Bottom line: There is no single best business debt settlement lawyer in Denver. Start with a short list of firms whose attorneys are licensed to practice law in Colorado. With each, ask for a written estimate that includes all fees and expenses. Select a firm whose practice includes both debt resolution and bankruptcy. That way, you’ll get advice about which path is more effective without regard to what services the lawyer has to sell.

A Share of Future Receivables
A merchant cash advance is a little hard to grasp. The funder gives you cash today for a share of future receivables. That’s spelled out in an agreement that also gives the funder access to the receivables and defines how they’ll collect their share. Often it’s through daily or weekly payments in an amount so high the cost of the cash advance would break Colorado’s usury laws, and that’s why they call it a purchase of receivables not a loan. When your business takes an MCA, it’s usually because your firm has struggled for a while. The repayment terms seem ok at first, but you quickly learn they’re far beyond the cost of a normal loan and often more than the business can pay. Most MCA borrowers soon regret ever taking that money.
When you fall behind on a merchant cash advance, your funder has different options to pressure you into payment than a conventional lender. You put the funder in position to pull their payment from your bank account, or have your merchant processor collect receivables and send them straight to the funder. If you stop paying altogether, they might even contact your customers to reroute payments straight to the funder. Nobody wants customers knowing they’re in debt. Most MCA funders set up in states whose court system permits them to get a judgment against you without even letting you know about the lawsuit. It looks like a violation of due process.
State-licensed Debt Settlement Lawyer
Before you hire a lawyer, make sure they have a license and it’s in good standing. Use the Colorado Attorney/LLP Search on the website of the Office of Attorney Regulation Counsel. That shows an attorney’s status (Active and Good Standing is the bare minimum) and any public discipline. Beware: paraprofessionals licensed by the state appear there too, but their registration numbers are all in the 600000 range.
In Colorado it pays to use a state-licensed debt settlement lawyer. Providers are covered under the Colorado Uniform Debt-Management Services Act, but law firms and attorneys are exempt if they’re licensed to practice law in Colorado and providing legal services in an attorney-client relationship. If you speak to a debt relief company by phone, the federal Telemarketing Sales Rule since October 27, 2010 says they can’t charge you fees until they settle or reduce at least one unsecured debt. There’s no general exemption for lawyers, but those who meet clients face-to-face before signing them up likely are exempt from most of the rule.
That’s why you look in the state rules of professional conduct for what a fee should look like. In Colorado Rule 1.5(b), lawyers have to give new clients their fee basis or rate and scope of work in writing before or soon after starting work. Rule 1.5(h) applies to flat fees, and the lawyer has to lay out the fee terms in writing. Contingent fees are covered in Rule 1.5(c), which says the deal must be in writing and signed by the client, listing the percentage if the case settles, or if the case goes to trial or appeal.
Settlement or Bankruptcy
Settling an advance usually starts with you stopping the daily or weekly payments and saving that money instead for a lump-sum payoff. You’ll probably need a new bank account and merchant processing account so the funder can’t help themselves to the receivables they expect for “purchasing” the receivables. If you save about half what you owe, they’ll often take it after a few months of missed payments. You’ll probably pay near 50%, but what’s important is that you end the daily payments and go on to pay a fraction. If you don’t stop the daily or weekly payments, you won’t have the settlement fund you’ll need. Stopping the payments and saving that money is often what lets a business survive.
If you can’t afford to settle a merchant cash advance, a bankruptcy lawyer will probably advise against a business bankruptcy. The fees are substantial, and nearly all MCA agreements have personal guarantees from the business owner. That means the owner will owe any balance even if the company gets its debts discharged. Personal bankruptcy is often the better way out. Can you operate the business after closing the company? Many entrepreneurs do. They dissolve the LLC or corporation and operate as a sole proprietor and leave the debt behind. They then try to protect up to $60,000 of business assets permitted by Colorado’s tools of the trade exemption. For many it’s their second life. You might consider a small-business Subchapter V case instead. For cases filed on or after June 21, 2024, the total debts of a small-business case must be under $3,424,000.
Whether debt settlement or bankruptcy, always ask a tax professional if you’ll owe tax on the canceled balance. The IRS generally treats debt forgiven for less than the full amount owed as taxable income. The Form 982 you may file excludes canceled debt to the extent you were insolvent.
Time limits on collecting your debt aren’t so simple in Colorado. Your funder has six years to sue you on a debt of a fixed amount, but a Colorado judgment generally grows 8% a year until it’s paid.
Whichever path you take, make a short list of candidates, ask lots of questions, and hire the firm you’re confident will help you reach the future you want.
