2026 Best Business Debt Settlement Lawyers in Baltimore
Reviewed by NYCCriminalAttorneys.com Blogging Team · Last updated
Bottom line: People ask me all the time who the best business debt lawyer in Baltimore is, and the honest answer is that there isn’t one name I can give you. The best business debt lawyer for your company is the one who is licensed in Maryland, who is ”active” on the Maryland Attorney Listing, who handles business debt with merchant cash advance companies, and who puts their prices in writing. You can check an attorney’s license and listing on the state attorney search engine, and you should, before anyone claims they can reduce your company’s debt.
Best Business Debt Settlement Lawyers in Baltimore for 2026
A good one, when dealing with your cash advance debts, is going to negotiate down the balance as much as possible with the advance company, is going to represent you in court cases when you can’t pay the cash advance companies, and is going to represent you in Bankruptcy proceedings.
Every lawyer who’s ever been admitted to the Maryland bar is on the Attorney Listing. An “active” status means the lawyer’s in good standing. No listing means you have to call the Supreme Court of Maryland Clerk at 410-260-1500 and ask, but at least you didn’t just take the salesman’s word for it.

So you don’t have a name yet. No problem. Baltimore City Bar referral is $35 for a half-hour consult. If you’re in the county, the Baltimore County Bar Association’s referrals are free, and the attorney explains their fees after the meeting.
What’s with debt settlement companies? Their sales reps cannot give legal advice and cannot represent you in court if sued. The sales rep at ABC Settlement Corp. is not a lawyer. If ABC gets a paper from a creditor, they can’t file a response or go into court for you.
You may get settlement pitches that sound great. They promise big savings. And there are times when the numbers do pan out. Sometimes the better question isn’t whether to settle, it’s whether to risk the lawsuit, and sometimes that really is best dealt with by a lawyer in Maryland who knows these issues cold.
The Funder Responds by Filing Lawsuits
Stopping your payments might be the easiest option, but the funder responds by filing lawsuits, which often lead to frozen bank accounts. One of the things a contract allows companies to charge are fees. A non-sufficient funds fee of $35 isn’t likely to break the bank, but stopping payment can cost $500-$5,000, while default fees can be $2,500-$5,000.
As a judgment creditor, the funder can freeze your company’s bank account. Worse, the funder sends your customers and processors a UCC lien, which freezes receivables before they even get to your bank. The lien is the funder’s way to tell your customers and processing companies to stop paying you, and pay the funder instead. That’s embarrassing, and some customers may take it as a sign of weakness and take their business elsewhere.
Who sees the lien depends on what you gave the funder. Did you hand over your customer list or trade references? Within a day or two of a UCC filing, anyone it knows of who transfers funds to your company, Stripe, Square, PayPal, may see the lien.
A confession of judgment is a contract whereby you waive the right to fight the lawsuit. Funders have confessed-of-judgment contracts, which were banned in New York for out-of-state owners in 2019. Some of them have begun filing those in Texas, Utah and Illinois. But most of them just file regular lawsuits.
After notice of confessed judgment, you have 30 days to move to vacate it in Maryland District Court, stating your defense. Talk to an attorney.
Domestication of the judgment means the out-of-state funder brings the judgment to Maryland to go after the assets here. In Maryland, contracts are generally subject to a three-year limit, while court judgments are good for a dozen years.
True Merchant Cash Advance Contract
A regular loan requires repayment with interest, regardless of your cash flow. A true merchant cash advance contract allows the funder to advance cash today against a portion of your future sales. That means that if no money comes in, nothing should be collected.
Some funders I’ve seen take 100 percent to 200 percent or more profit. That’s usurious by the legal standard of most states if you try to call it a loan. Most of the MCA paperwork is badly drafted. An experienced lawyer will know what’s common in these contracts, and what’s bad. If you’re sued, he or she can point out defects and make a defense based on those.
Brokers are in business for themselves, not the funders. They’re paid on commission. A broker finds lenders for you, and will stack you with multiple creditors. Scammy brokers will tell you to pay the MCA until the loan comes through. The loan never funds. Some lawyers file third-party complaints on behalf of their clients, accusing brokers of unsavory practices.
If it comes to bankruptcy, most MCAs are personally guaranteed, so your personal bankruptcy discharges your personal obligation but the business still owes the full amount. If you file for the company, it’s vice versa - the business liability is discharged but your personal guarantee stays in effect. The personal bankruptcy is either Chapter 7 or Chapter 13. A business can use Chapter 7 or Chapter 11, and the Subchapter V streamlining is available for debts of less than $3,424,000.
Fee Agreement
MD law says for contracts where the fee is calculated as a percent of the debt saved, you have to sign a written agreement. That agreement has to show how the fee is calculated and which expenses you pay. Everyone likes a flat fee. But a lawyer can charge by the hour or on a per-job basis, provided the client is informed of the basis of the fee and the expenses for which the client may be responsible. The attorney can’t charge an unreasonable fee. The best course is to simply get the deal in writing.
Many people are surprised to learn that if you settle your business’s debts for less than full value, the balance is usually taxable income. If it’s a business debt of $600 or more, the lender usually files a Form 1099-C with the IRS. Don’t think that if you don’t get a form in the mail, you’re off the hook. If you were insolvent just before the debt cancellation, you can exclude the cancelled debt up to the amount you’re insolvent. You can also escape paying taxes if the debt was canceled in bankruptcy. There is a form for that, Form 982, and it must be filed with your regular tax return.
Debt settlement can be great for some owners and disastrous for others. Either way, know the risks beforehand, and check the lawyer’s license and state attorney listing. Read the fee agreement, and make sure you get it in writing. And above all else, get it done now, while things are just starting to turn.
