2026 Best Business Debt Settlement Lawyers in Georgia

Bottom line: People in Georgia often want a list of the best business debt settlement lawyers. There isn’t an official ranking. The right lawyer for your merchant cash advance debt is the one who knows Georgia MCA law, moves quickly before garnishment starts, and gives you a fee agreement in writing before they get started.

Top Business Debt Settlement Firms Serving Georgia in 2026

Georgia law changed in January 2024. Georgia wants MCAs to be clear about how much they cost. Funders have to show you the dollar amount you pay, even if they still don’t have to show you an APR. Georgia’s Attorney General is the only one who can enforce the law. Businesses can complain, but they don’t have a lawsuit for it, and a missing disclosure still lets the company enforce the contract if you fall behind. You could report it to the Attorney General’s Consumer Protection Division. When it’s time to settle, it may be useful to a good lawyer who knows about MCAs, but you won’t win your case on it.

Usury applies only to loans. Usury under GA law does not apply to a real sale of your company’s receivables. MCAs claim to be purchases. However, if a merchant cash advance agreement resembles a loan more than it resembles a true purchase, it may be a loan under usury law. In 2019, the Atlanta bankruptcy court found one MCA to be a sale and another to be a loan, based on the contract’s terms, not its label. Criminal usury in Georgia is charged above a rate of 5% per month. If the interest is too high, the company that got your money could lose the interest, but you must pay back the principal you received.

Lawyers who know MCAs read the reconciliation clause, account-balance covenants, and what happens to the merchant if the business goes bankrupt. Most merchant cash advances say New York law applies, which doesn’t let a business raise the claim of criminal usury, unless the rate is above 25% per year.

Someone Who Will Represent You Quickly

It’s also a good idea to look for someone who will represent you quickly. There is only 30 days from the time you are sued to answer and defend your case. Once they have a judgment, the MCA company doesn’t need your permission to empty your company’s bank account. Georgia bank garnishments get any money in the account and five days of deposits. You can ask the judge to reduce the amount taken if it’s more than you owe. You have twenty days after the bank answers the garnishment to do it.

Most MCAs file suit against a Georgia business in New York. If they win, they file the judgment with a Georgia court clerk. When that happens, the clerk will mail you a notice. You should contact a lawyer right away. The Georgia court must stay the enforcement of the judgment if an appeal is pending in New York, and you have posted security. The case itself generally has to be won or lost in New York.

Referral Services

The State Bar of Georgia will not refer you to a particular lawyer. There are local and voluntary bar associations who run referral services in the state. The Atlanta Bar, for example, may charge $45 for a first 30-minute consultation as part of their service. Another source you may want to try is the State Bar’s online “Find a Lawyer” directory.

Once you have a few lawyers to look at, you can ask each one how much MCA work they’ve handled. Do they defend lawsuits and garnishments, not just negotiate? Complaints about a Georgia lawyer can be filed with the State Bar of Georgia.

Georgia law requires agreements with contingency fees to be in writing and to say how the fee is calculated, including the percentage. Debt adjusting companies cannot charge more than 7.5% of monthly payments under the Georgia Debt Adjustment Act. However, the cap does not apply to lawyers.

Lawyers do three things in Georgia MCA disputes. They ask the funder to adjust to a lower payment. The trick here is to make the request in writing and to keep a copy. They negotiate a settlement. They defend a lawsuit or garnishment.

Personal Guaranty from the Business Owner

Nearly every merchant cash advance includes a personal guaranty from the business owner. That makes the owner “jointly and severally” liable. That means the MCA company can sue both the business and the owner at the same time. Waivers in guaranties are often enforced. And moving cash to a new entity or account to avoid collection can be undone.

Your MCA settlement should require the funder to file a UCC-3 termination statement within 10 to 20 days. If they don’t, a written demand gives them 20 days, and if they don’t file, they owe you $250 plus damages. The forgiven balance may be taxable income, so ask before you sign. Lenders file a Form 1099-C if they cancel $600 or more, and you may exclude canceled debt if you were insolvent at the time, using Form 982.

Chapter 11 bankruptcy’s automatic stay will halt collection activity, including lawsuits and garnishments, but it generally won’t protect the owners who signed a personal guaranty. It costs $1,738 to start a Chapter 11 business bankruptcy case. Subchapter V, for small businesses with debts of $3,424,000 or less, is a faster, less costly reorganization.

Look for a lawyer who is familiar with the terms and defenses in merchant cash advances and the right way to settle a Georgia MCA dispute. You don’t need a top-ranked lawyer. Don’t ignore notice of a lawsuit. Don’t ignore a notice of garnishment.
