2026 Best Business Debt Settlement Lawyers in Chicago, Illinois
Reviewed by NYCCriminalAttorneys.com Blogging Team · Last updated
Bottom line: Forget ranked lists of top firms. The best business debt settlement lawyer in Chicago is an Illinois-licensed attorney who understands the legal and financial strategies of defending against an MCA attack and can challenge debt collectors in court. Merchant cash advance funders don’t work like other lenders. A lawyer can help you understand what MCA funders are, what they do, how they do it and how to defeat them.

Illinois Debt Settlement Law
Anyone settling debts on behalf of others in Illinois must have a professional license from the state. It is a Class 4 felony to do it without that license. Any contract made without it is void. Illinois debt settlement law doesn’t cover lawyers who are licensed here and practicing law.
Don’t be fooled by slick ads promising to cut your payments in half and save you money. They don’t mention the lawsuits, UCC liens or their own upfront fees. Then bank accounts and receivables are frozen. No progress is made. Fees paid aren’t refundable. Meanwhile, contract fees stack up: NSF fees typically run $35 each; stop payments can be $500-$5,000; changing banks or merchant accounts, $100-$2,500; defaulting, $2,500-$5,000. Professional debt settlement companies are no substitute for an attorney. They cannot give you legal advice, and if you get sued they can’t help you in court.
Lien Rights Under the Uniform Commercial Code
An MCA gives the funder lien rights under the Uniform Commercial Code that come before your bank account, so receivables can be frozen before the bank ever gets involved. Then, you have no operating funds. Within days, the funder will send lien notices to card processors and customers it found in your bank statements, telling them to pay the funder. It’s embarrassing. Some customers may stop doing business with you, causing revenue drops.
A confession of judgment isn’t a legal finding against you, it’s a promise to hand your funder a win automatically if you default on payments. By signing one, you waive your right to defend yourself in court if you default on payments. In 2019, New York outlawed them against out-of-state businesses, so MCA funders just started filing them in Illinois and other states instead. If you never signed a confession of judgment, the funder must first file a lawsuit to sue for the money. Lawyers can defend you or settle the case, depending on what your interests are. Funders also domesticate out-of-state judgments here, extending their reach to seize assets in Illinois. An Illinois judgment against a business earns 9% interest a year until paid.
The idea of merchant cash advances was born in the 2008 financial crisis, when banks stopped lending to small businesses. In a true MCA, there is no repayment unless money comes into the account. If it remains open but idle, nothing is owed. In contrast, loan repayment must be made regardless of the borrower’s financial state. Some MCA funders make 100-200% profit. If they had loaned that money, it would be usurious in many states. Also, their contracts are often poorly drafted, so a lawyer can sue to void them.
Your broker earns a commission from the funder, so its incentives are to stack as many advances on the business as possible, even if the situation becomes unmanageable for you. Beware if your broker claims the advance is temporary, lasting a month or so, then they will transfer you into a traditional loan. The loan never comes, and the high-priced MCA stays. Attorneys can use third-party complaints against brokers and counterclaims against the funder itself.
Personal Guarantee
Even if a merchant cash advance is too expensive to keep paying, remember that an MCA usually carries a personal guarantee. While a personal bankruptcy could discharge that guarantee, the business would still be liable on the contract. On the other hand, a business bankruptcy could eliminate the business debt, but not discharge your personal guarantee. You’ll use Chapter 7 or 13 for yourself. A business can file under Chapter 7 or 11, including Subchapter V if total debts are $3,424,000 or less.
Settled and forgiven debt is generally treated by the IRS as taxable income, except if it is discharged in bankruptcy or while insolvent (up to the amount of insolvency). To claim the exclusion from your taxes, you must use IRS Form 982.
Business debt settlement can be a great solution for some businesses and a terrible one for others. Before you hire anyone, ask the lawyer to explain your options and pros and cons of each, since settlement is not your only option. If you agree to pay a percentage, sign a written contract stating the percentage and how expenses are deducted.
