2026 Best Business Debt Settlement Lawyers in Jacksonville

There is no single best law firm. You may be surprised to learn that not all attorneys offer business debt settlement, and even fewer are good at it. Regardless of whatever glowing lawyer reviews you find on Google, if your lawyer is not talking to you candidly about the best options available to you and your business, they are doing you a disservice. Your case is unique, so you will want to speak with several attorneys that have business debt settlement experience before choosing. You’ll have a chance to weigh different opinions and solutions, and you’ll be able to get a sense of the fees each attorney will require.

Top 3 Business Debt Settlement Firms for Jacksonville (2026 Rankings)

If you have debt, you’ll soon learn that there are business debt settlement companies ready to offer you their assistance. A debt settlement company employs individuals that will negotiate with creditors on your behalf. Lawyers, on the other hand, negotiate with creditors and can also defend you against creditor lawsuits. You’ll need a law firm that can competently handle your case.

If you worry only about lawsuits and judgments then you should pay more attention to UCC liens. A judgment can freeze a bank account, but a UCC lien can prevent that money from reaching the bank. Funders will look for business bank accounts and customer lists. Once they have them it takes maybe a day or two to send out notices. The funder will dispatch the lien to the company’s payment processors and customers. Then customers may receive letters asking them to redirect payment. Some customers leave rather than take sides.

As for judgments, New York’s legislature banned confessions of judgment against out-of-state owners in 2019, and funders have largely replaced them with suits, but some still file COJs in states like Illinois or Texas. A case starts in another state, and later the party with a judgment - usually the funder - files it in Florida to try and reach the assets here. Florida has a rule that a creditor needs to commence a lawsuit within five years after a breach of a written contract.

A settlement company’s goals may be at odds with your goals. Settlement companies don’t normally start out by describing the risk of lawsuits and judgments. They make promises that look great. Halve your payments. Some firms ask a big upfront fee, with claims about big savings. Some give you monthly estimates that don’t make clear how big a check they want from you at first, or how it’s being spent. Others promise savings they can’t possibly make come true.

After you sign the paperwork you might expect to hear the wheels turn. Then a funder puts a freeze on the company’s bank accounts and receivables. You call the settlement company and learn that not much has happened. Some will not refund the fee. Ask yourself who benefits from all this. Meanwhile, most funder agreements come packed with an assortment of fees that tend to go unnoticed, like fees for insufficient funds and stop payments, typically ranging from $35 to $5,000; and default fees that range around $2,500-$5,000. They pile up.

MCA Agreements

A true merchant cash advance is not a loan, but an agreement where the funder buys a portion of the merchant’s future receivables. The funder takes the risk. If money isn’t coming in, it shouldn’t collect. Some MCA agreements do look more like a loan than a purchase. Some funders profit 100 to 200 percent or more. The amount that most states allow can be much less than what some funders charge, and many contracts are poorly drafted. A lawsuit might be able to void a contract like that. So there are times when a settlement is not the appropriate avenue and pursuing litigation may be your best option.

Most MCA brokers are paid on commission. Some stack several advances at once. Some promise an MCA only until they can find a real loan. A lawyer can file claims against the broker.

Most merchant cash advances come with a personal guaranty. An individual’s bankruptcy wipes out that personal liability, but does not affect the company’s obligation. A business bankruptcy leaves the person behind it on the hook. Chapter 11 gives businesses breathing room. The subchapter V option is good for businesses with debts of no more than $3,424,000, but Congress has passed a bill to raise that limit to $7,500,000, and the President is expected to sign the bill into law. Only the business files a plan, and it’s due within 90 days. A trustee is appointed to help reach agreement. There are no quarterly trustee fees, and the court filing fee is $1,738 in the Middle District of Florida, which covers Jacksonville.

Before hiring, look up the lawyer in the Florida Bar’s Find a Lawyer directory. Each profile shows a 10-Year Discipline History that says None or Yes. Yes links to the documents. Ask the lawyer. How long have you practiced? Have you handled cases like this before? Ask what courts a lawyer has worked in and ask if they practice law in courtrooms. The Florida Bar offers 27 board certifications. You get one after passing a written exam, getting good peer reviews and judicial reviews, and practicing for five years. For lawsuits, look for board certifications in business litigation; for business bankruptcy, see the American Board of Certification.

You should never assume your first talk with a lawyer is going to be free unless the lawyer has told you that it will be. The Florida Bar has a lawyer referral service. The bar caps the fee for the first half hour at $25. This service is only available when there is not a referral service offered by a local bar association. Don’t let money keep you from calling around and getting opinions from a couple places.

A settlement can work well for some, and be terrible for others, and you won’t be able to decide until you know the bad news. The first thing you need to learn is the risk of lawsuits and of liens, not about saving money. The quality of legal help varies widely, and you’ll want to listen most for who does the best job explaining the risks. Anyone who won’t talk about lawsuits and liens is not offering a complete picture.
