2026 Best Business Debt Settlement Lawyers in Idaho

Bottom line: There is no single best lawyer for business debt settlement in Idaho. But if you have an Idaho-licensed attorney who handles your kind of debt, which these days often means knowing SBA EIDL loans, you’re on the right track. Start at the Idaho State Bar Lawyer Referral Service, which for a $35 referral fee will put you on the phone with one for a free half-hour consult. Fees are negotiated from there.

Top Business Debt Settlement Firms Serving Idaho in 2026

The kind of debt matters more now than it used to. If you have a COVID EIDL loan, you need a business lawyer who has done them in the trenches. The SBA’s authority to service defaulted COVID EIDLs in-house expired March 31, 2026, and about 500,000 of them have been sent over to Treasury for collection, which means you will not be dealing with the same SBA agents you used to. And unlike the more generous PPPs, EIDL loans are not forgivable.

A Personal Guarantee

The first question any lawyer answers in an EIDL debt negotiation is whether you signed a personal guarantee. Loans for $200,000 or less generally do not require a personal guarantee, while loans for more than that generally do. Each case depends on the documents you signed. But check your loan documents carefully, and if you have any doubt, talk to an Idaho lawyer sooner rather than later.

Loans for more than $25,000 usually have a UCC-1 lien on business property, such as receivables, equipment, and inventory. A UCC-1 filing on business assets does not by itself make you personally liable for a business debt. That is the purpose of a personal guarantee. A mid-sized loan may have a lien but no personal guarantee. And even if you do not have a personal guarantee, federal offsets can sometimes reach you.

Timing, Especially with EIDL Loans

The big issue now, more so than dealing with any one government agency or IRS regulation, is timing, especially with EIDL loans. First you miss a payment, then there will likely be demand letters. Around 120 days past due, the debt is eligible for the Treasury Offset Program, which means they can garnish it from any money the federal government owes you, like a tax refund. At around 180 days, it may get sent over to Cross-Servicing, which kicks off a new collection process. There is a 28 to 32% collection charge typically added to debts that are sent to Treasury. If you’ve recently gotten demand letters, it’s time to find a lawyer.

Once your EIDL has been sent to Treasury, it is eligible for a range of collection tools. No court order is necessary to do a tax refund intercept, and they can garnish Social Security. One of the most common tools is wage garnishment, where they take money right from your paycheck. It commonly runs up to 15% of your disposable income, but even that often hurts a lot.

The old COVID-era Hardship Accommodation Plan expired, but it was not the only SBA option available to cut payments on your EIDL loan. There is still a provision for temporarily cutting payments by up to 50% for up to six months, as long as you can show a hardship. You may only use it once every five years. It does not actually reduce the principal of the loan, but it can offer temporary breathing space if things are tight.

If you can qualify for an Offer in Compromise, it’s a way to settle the loan for less than the full balance. There are SBA forms 1150 and 770 to fill out, all under oath. It’s not a write-off, because they settle for part of what you owe, but it can be a solid way out of the morass. Usually the business has ceased operations, and any collateral it held has been liquidated. Generally, the offer must be for close to what the SBA could collect from you if you did not pay, so it is usually a last resort. Nothing says you need a lawyer, but I will be honest and tell you that you should have an attorney review the paperwork, if not fill it out for you.

Bankruptcy can also sometimes stop Treasury collection efforts, including the Offset Program. The automatic stay stops them in their tracks, even if they had already hit your paychecks. In some cases, it can also get rid of debts you guaranteed, like an EIDL loan. And if your business is eligible for Subchapter V, the debt limit is $3,424,000. Idaho’s homestead exemption is $175,000, so up to that amount of your home is protected from creditors. It’s not the right choice for everyone, but it may be worth consulting a lawyer to see if it fits you.

Before you hire a credit counselor or financial advisor, make sure they are legit: state law says anyone offering debt or credit counseling in Idaho needs a license from the Idaho Department of Finance. Lawyers are exempt, but only when they are providing it as part of practicing law, not a separate business.

Red flags to watch out for: the FTC says any for-profit debt relief outfit that calls you cannot charge a fee until you have actually settled at least one debt, you have agreed to the settlement, and you have made a payment on the settlement. Anyone promising EIDL forgiveness is likely a scam, because those loans are not forgivable, as a general rule.

Fees for lawyers are not set in stone and you can always negotiate. It never hurts to ask. But if you do not see eye to eye, there is a free way to resolve the issue. The Idaho State Bar’s Fee Arbitration program handles disputes without cost to either side. Lawyers do not have to agree to be bound by the results, though.

Normally in Idaho, you have to go after a debt within five years if it is written, or four if it is unwritten. But federal law lets the government use the Treasury Offset Program indefinitely, so waiting will rarely solve the problem.

IRS will generally treat canceled debt as income in the year they canceled it, as if you got paid in money. That does not sound fair to me either, but it is the rule. There are exceptions, like if you were in bankruptcy when they canceled it, or if you were insolvent. And if it was $600 or more, they will issue a Form 1099-C.

Look up the current status of your loan online. Find copies of the paperwork you signed, especially a personal guarantee, if any. Don’t ignore letters from SBA or Treasury. Don’t sell business assets without SBA authorization.
