2026 Best Business Debt Settlement Lawyers in Oklahoma City

Bottom line: There is no official ranking of the best debt settlement lawyers in Oklahoma City. The Oklahoma Bar Association does not rank lawyers or law firms; it points people to its online Find a Lawyer program. The only way to find the best debt settlement lawyer for your specific situation is to do your own research. You can start by looking for lawyers who have experience in debt settlement, preferably with a proven track record of success. You can also check with the Oklahoma Bar Association to find out if any complaints have been filed against a particular lawyer. It’s important to remember that debt settlement is not a one-size-fits-all solution, and the best lawyer for one person may not be the best lawyer for another. The key is to find a lawyer who is experienced, knowledgeable, and willing to work with you to help you achieve your goals.

How MCAs Work

The length of an MCA contract is often 3 to 12 months, and the APRs can range from 40% to 350%, so it is essential to have a lawyer who knows how MCAs work.

Payments are daily or weekly debits straight from your bank account. This can make it difficult to cover other expenses. Be sure to read your MCA terms carefully.

Defaulting on an MCA can lead to the lender withdrawing larger amounts from your account or suing you for breach of contract. You may also face additional fees and damage to your credit. If you have signed a personal guarantee, this means that you are personally responsible for repaying the loan, which could put your personal assets at risk.

A lender cannot freeze your bank account without a court judgment first. This means that the lender must sue you in court, present evidence of your debt and your failure to pay it, and win the case before they can begin taking your money. An exception is if you signed a confession of judgment, which waives your right to defend yourself and allows the lender to collect on the debt without going through the legal process first. Once the lender obtains a judgment, they can immediately seize assets or garnish wages or bank accounts. You may have signed a confession of judgment without fully understanding its implications. However, a lawyer may be able to challenge its validity or negotiate a settlement. It’s important to note that no matter what, ignoring a lawsuit is never a good idea.

The statute of limitations is the time limit for a creditor to sue on a debt. A good lawyer checks this before doing anything else. In Oklahoma, it is generally five years for a written contract and three years for an oral one.

Negotiate a Settlement with a Merchant Cash Advance Company

It’s often possible to negotiate a settlement with a merchant cash advance company without going to court. Many MCA companies prefer to settle because it’s cheaper than going through the legal process. To settle, you’ll need to show them that the original deal is impossible and that you’re unable to pay the full amount. Usually, you’ll pay less than what you owe, and you’ll stop the daily debits from your account.

Revoking your ACH authorization in writing, using certified mail, and following the steps in your contract is important. However, be aware that a simple phone call may not be enough to stop ACH debits. Also tell your bank to stop the payments. If the lender keeps withdrawing after a proper written revocation, it can violate electronic fund transfer regulations. This shows bad faith on their part, giving you leverage in negotiation or a lawsuit.

If you hire a lawyer to help, a lawyer in Oklahoma must explain the scope of work and the fee rate. Ideally, this will be in writing. If a lawyer takes a case on a contingency basis they must have a written, signed agreement with you that says the percentage they get. Under the FTC Telemarketing Sales Rule, using attorneys does not automatically exempt a telemarketing debt relief provider. This means they cannot charge you until they have settled at least one of your debts and you have made a payment under that settlement. Calling the fee a “retainer” does not exempt the debt relief company from this rule.

The IRS generally treats canceled debt as ordinary income in the year you settle. But you may be able to exclude it if you were insolvent or in bankruptcy at the time. If you can exclude the debt, report it on Form 982 with your tax return.

If you settle an MCA, it’s possible that it will not appear on your credit report. However, if you default on an MCA and get a judgment, it can damage your credit. And once that daily payment is gone, bank statements look stronger to lenders.

If settlement fails, you may want to consider bankruptcy. In the Western District of Oklahoma, the filing fee for Chapter 7 is $338, and for Chapter 11 is $1,738. For Chapter 11 Subchapter V, the debt limit is $3,424,000. In a Subchapter V case, a trustee helps you reach a plan with your creditors. There are no U.S. Trustee quarterly fees.

MCA Liens

Once an MCA lien is filed, it becomes public record. MCA liens can also be packaged and sold to brokers who then cold call the people on the list. Applying for an MCA may also pull your personal credit and several inquiries can hurt your score. Be very careful about signing up for another MCA while you are already trying to pay off an existing one. There are some red flags to look out for. These include:

  • pressure to sign right away,
  • no clear terms of repayment or APR,
  • a “confession of judgment” clause,
  • no review of your ability to repay,
  • and bad reviews online.

Whether you need a lawyer to help you settle an MCA, set up a bankruptcy plan, or defend a lawsuit, finding the right lawyer can make a huge difference in your legal situation.
