2026 Best MCA Defense Lawyers in New Orleans, LA
Top MCA Defense Firms for New Orleans Businesses - 2026
MCA agreements almost always involve automatic debiting of a company’s business bank account. Depending on the size of the payments, this can create a hardship for a business. For one business, it started with one cash advance, but meeting the daily payments was a challenge. So they took a second to make payments on the first. But the double withdrawals were more than what they took in every day, and they fell behind. Their remedy: a third MCA. With cross-default clauses, defaulting on the first triggers a default on the others.

No upfront fees.

A Legal Attack
When a merchant receives a summons and complaint from a funder, speed decides everything. Most merchant cash advance contracts pick New York courts, so a delay just gives them 30 to 60 days to get a default judgment. With a judgment, they can freeze business bank accounts and garnish receivables, making it hard to meet other bills. The summons and complaint is the merchant’s wake-up call.
That is because most MCA agreements have a forum selection clause. So disputes about the MCA loan will likely be filed in New York and decided under New York law, even for a business headquartered elsewhere. Each clause must be reviewed by an experienced lawyer to check for defenses based on substantive, procedural and jurisdictional grounds. A New Orleans business needs a New Orleans lawyer who knows Louisiana law. Or you may need to hire lawyers in both states.
The best defense against a legal attack is awareness. Since August 1, 2025, Louisiana law requires a written disclosure of 6 items to an MCA customer at or before the time of signing an MCA. No limit is placed on the amount that can be automatically debited from a business bank account. And an MCA is presumed not to be credit, so Louisiana’s interest rate limits do not apply.
Confession of judgment clauses are dangerous. These agreements signed by merchants allowed funders to skip the court process in New York if a merchant stopped paying on their business financing. But in August 2019, New York changed its law. And merchants with a physical location in Louisiana that do not have an office or address in New York cannot be subjected to one filed there. Still, older judgments are not erased.
Every MCA contract is different. Almost every MCA agreement is a long, confusing document containing many pages of terms and conditions. Did the merchant receive proper disclosure of the terms of financing as the law requires? Is the contract for sale of receivables or a finance? Calling it a “merchant cash advance” or a “purchase of future receivables” is no excuse. An agreement can still be a credit obligation in disguise. MCA companies that use deception or misrepresentation should be confronted with it. When a funder has frozen a merchant’s bank account, a lawyer can often help with an emergency application for release of a bank freeze.
The temptation is to stop the debiting by closing a bank account. Stopping the debits could be used by a lender to accelerate the balance and declare the entire balance as due immediately, depending on the language of the agreement. But most MCA agreements also include a personal guaranty signed by the business owner(s). As individuals, they can be named personally as defendants. If you ignore legal papers, they can get a default judgment. Now the funder has the power of a court to seize personal assets, including money in personal bank accounts.
Hiring a Lawyer
Try calling several lawyers, and compare how they respond to the information you give them. Ask them questions to test their understanding of the law. An important question to ask when hiring a lawyer is: How many merchant cash advance matters have you handled? You need someone who does not scare easily. Do not shop based on price alone. Some attorneys may speak to you free of charge. Other law firms may charge for the first meeting.
As of 2022, the New Orleans Bar Association had an attorney referral service. All lawyers were members in good standing and carried malpractice insurance. It offered an initial consultation of up to an hour for no more than $75. Louisiana lawyer rules say that when a lawyer works on contingency, the agreement must be in writing, signed by you, and state the percentage the attorney will get at settlement, trial or appeal.
Remember that funders are in the business of finding people to finance and getting the money back. They prefer not to incur the cost of a trial. Lawsuits can cost the funder time, money, and attorneys fees. Settlement agreements usually involve a lump sum payment or a payment plan. Details of the plan should be agreed on and confirmed in writing. Try to get your funder to restructure your payments and release the UCC.
UCC1 liens are a problem because it can make getting business financing more difficult. It also makes you appear less creditworthy. Any new potential lender will see the UCC lien. When the financing is paid in full, the funder should file a UCC-3 (the proper form for withdrawal). If the lender fails to do so, the merchant should send the funder a written demand that they file it. A lawyer can make sure a lien is properly cancelled.
Bankruptcy is a tool, but not the first one. Subchapter V bankruptcy can stop collections and restructure debts, and the current limit on total debt is $3,424,000 for cases filed on or after June 21, 2024. But bankruptcy has serious consequences that you should discuss with a lawyer.
Once you find a lawyer you want to meet with, have your MCA documents in hand for the meeting. Check with your bank and make sure you have a record of all debits and credits on your account. One way to start is to write a rough timeline of events. Then support it with documents to illustrate the entries. Look at a copy of the papers the funder sent you. The summons will probably have a case number and the name and address of the court.
There are some actions you can take to help your situation. You can also do some things that will make your situation worse. The following are things you should not do:
- (1) ignore the lawsuit;
- (2) move money out of your business bank account to hide funds.
Contacting the lender may be helpful, but proceed with caution because anything you say can be recorded and used against you. Deleting texts and emails can be a mistake. You don’t have to handle this by yourself.
