2026 Best MCA Defense Lawyers in North Carolina
Top MCA Defense Firms for North Carolina Businesses - 2026
When your MCA funders start calling to say your payments are past due, new ads and cold calls suddenly appear, all promising they will “handle your MCA debt.” Some will negotiate with your existing lenders, while others offer a new advance to start over. One outfit may offer to collect payments and fund a settlement of your original loan, while another will defend a lawsuit for payment. These are not all the same, and not all of them will help you in the end. Ask what is included before you say yes to anything.
Delancey Street
Let's be clear - Delancey Street is not a law firm. They're a specialized MCA debt settlement operation that works with a nationwide network of licensed attorneys who handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution on behalf of North Carolina business owners. Their attorney network uses both North Carolina’s strict 8% usury cap and New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of whether your business operates in Charlotte, Raleigh, or Asheville.
Where Delancey Street separates from every other firm on this list is MCA-specific legal firepower for North Carolina businesses. Their MCA debt lawyers don’t just negotiate - they challenge. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the NC Secretary of State, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent in funder negotiations. Over $100M in commercial debt settled. No upfront fees. Results-based pricing.
National Debt Relief
Important: National Debt Relief is not a law firm and is not an MCA defense specialist. They’re the largest debt settlement company in the United States - over $1 billion in debt settled, 550,000+ clients served. They handle general unsecured business debts - credit cards, vendor accounts, lines of credit - but they do not challenge confessions of judgment, file usury defenses, or dispute UCC liens. If your North Carolina business debt is primarily traditional unsecured business debt and not MCA-specific, National Debt Relief is a strong, proven option.
CuraDebt
Important: CuraDebt is not a law firm and is not an MCA defense specialist. They’ve been in the debt resolution business for over 25 years - handling business debt, consumer debt, and IRS/state tax resolution. If your North Carolina financial situation involves both MCA debt and tax obligations - including NC Department of Revenue issues - CuraDebt can handle the tax side while a firm like Delancey Street handles the MCA defense.
When a Creditor Sues
Often, a lender will file suit against a merchant to collect an unpaid debt. Make sure your lawyer actually appears in that case. Your best defense in that case may actually be in your contracts. In North Carolina, the statute of usury normally applies only to individuals. A business debtor normally cannot use North Carolina’s usury law to dismiss or avoid a debt. You may also be able to use Chapter 75 to raise a claim of unfair and deceptive trade practices. Chapter 75 gives a debtor a claim for triple damages. In North Carolina, the statute of limitations on contracts is normally three years.
Once you are sued, you have a limited amount of time to respond in court. Enrolling in a program or consulting with someone about one will not normally stop a legal proceeding.
Licensed in North Carolina
Make sure the attorney you hire is actually licensed in North Carolina. If you don’t see a licensed attorney handling your case, you may not be working with a lawyer. In North Carolina, you can check to see if an attorney is licensed, and whether the attorney has ever been suspended or disciplined. Check your lawyer’s record of discipline at the North Carolina State Bar by calling (919) 828-4620. Lawyers in North Carolina can seek to be certified in “Business Bankruptcy” by the North Carolina State Bar. To qualify, a lawyer must spend at least twenty-five percent of their practice in that particular area. Don’t make an assumption about a lawyer just because they advertise they “handle MCAs.”
Through the North Carolina Bar Association lawyer referral service, a referred lawyer’s first half-hour consultation costs no more than $50 if you mention the referral. During the first thirty minutes, ask about the lawyer’s experience in business litigation and their retainer to represent you.
Ask for the name of the lawyer who will handle the case. Will this attorney use their own office and their own staff? Or will this attorney refer your case to someone else? Will the attorney give you an engagement letter showing what will be done? If your case goes to court, will the attorney appear on your behalf? What can you expect to pay in total, for the entire project? Will you be informed of any progress?
North Carolina attorneys are subject to ethical rules that apply to any fee charged. Under Rule 1.5 of the Rules of Professional Conduct, a fee cannot be clearly excessive, and the amount of a contingent fee, and the scope of representation covered by the contingent fee must be clearly spelled out and explained in writing that you sign.
What Portion of Your Money Goes Where
It is your business to know where the money goes. Ask, and insist on a statement clearly spelling out what portion of your money goes where. Find out the name of the bank and account that holds the money. Is it held in trust for you, or are they collecting money you never see? Is it clear who will get to keep that money?
A program deposit is normally not the same as a payment on your debt. It may not reduce your total debt at all. A payment to a funder is not proof your debts have been settled, or will be settled at all. Get a detailed written statement explaining exactly how much money you need to pay, when, and what the effect will be. Does the money you pay reduce your debt, or does your debt remain in place?
A suspiciously “low” fee does not necessarily mean a good deal. Does the lawyer’s fee include everything necessary to do the job you expect? A lawyer cannot guarantee you the results of any legal dispute, and no one should promise you a settlement without even knowing the facts of your case. Promises and “guarantees” are risky assumptions.
Some filer services say they can “buy” you a delay of several months before a court will let a creditor proceed. Is this true? Court schedules are not fixed or guaranteed. Make sure your lawyer is actually presenting your case in court, rather than just stalling the court.
Some of the following may suggest caution: “We will reduce your debt by x percentage with a small fee.” “Just pay us first and we’ll get you a cash advance and pay your debt for you.” “We can deal with the debt collectors and prevent legal action.” Another is a seller who can’t tell you the name of the person who will handle your case. Before you commit to any form of refinancing, be sure you are not simply changing the form of the debt without actually reducing it in the end.
Insist that you have a chance to think about the offer, and never feel pressured to make a decision in a rush. Ask for a written contract outlining the scope of the work, the fee structure, and all costs before you sign anything. And make sure any promises are in that written agreement.
Delancey Street
The only firm on this list that provides true MCA defense for North Carolina businesses: COJ challenges, usury defenses under both NC’s 8% cap and NY’s 25% criminal threshold, UCC lien disputes, and emergency motions to unfreeze bank accounts - all coordinated through a nationwide network of licensed attorneys. Over $100M settled. No upfront fees. All 50 states including North Carolina.
National Debt Relief
Not an MCA defense specialist. National Debt Relief handles general unsecured business debt - credit cards, vendor accounts, lines of credit. No COJ challenges, no usury defenses, no legal motions. If your North Carolina business debt is primarily traditional unsecured debt (not MCAs), they're a solid option - but if you're dealing with an MCA, this is not your firm.
CuraDebt
Not an MCA defense specialist. CuraDebt handles business debt and IRS/state tax resolution. No COJ challenges, no usury defenses. Best used alongside an MCA defense firm if your North Carolina business also has tax obligations to resolve with the IRS or NC Department of Revenue.
