2026 Best MCA Defense Lawyers in Oakland, CA

Bottom line: There is no ranked list of the best MCA defense lawyer in Oakland. The one you want is the lawyer who’s handled cases like this before and knows the first deadline for your papers. Start with the Alameda County Bar Association’s lawyer referral service. For $40, you can have a short consultation with a screened lawyer, who can tell you whether or not the lawyer can take your case.

Top MCA Defense Firms for Oakland Businesses - 2026

An MCA defense lawyer can stand in for the business and its owners in every part of an MCA dispute: the lawsuit, the arbitration, the confessions of judgment, bank restraints and levies, liens, and settlement talks at the end. An MCA defense is a niche. It is not a routine debt collection case, and a lawyer has to understand commercial litigation, contract law, and UCC Article 9. Many contracts involve New York law and courts, which is its own world, with its own timeframes and procedures. General business lawyers who “do contracts,” and debt settlement companies, often miss these. You don’t want to be a guinea pig for someone else’s first case.

Merchant cash advance defaults escalate fast. The funder expects prompt payment, and when an ACH debit fails, the processor usually retries the debit a day or two later. Failed debits and overdraft fees bring quick calls for “cure.” Within weeks, the funder can send the case to its lawyers. A demand letter can go out, and weeks later a lawsuit can follow. Depending on the contract terms, the suit might be in state court, in New York, or in arbitration.

Delancey Street

Attorney-Coordinated MCA Defense & Settlement - $100M+ Settled Nationwide
Important: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company that works with a nationwide network of licensed attorneys - and that distinction matters. Their attorneys handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution for business owners across all 50 states - including Oakland and throughout the East Bay. Their network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of where your business operates - and the evolving appellate case law that is reclassifying MCAs as loans subject to interest rate caps. For Oakland business owners, Delancey Street’s attorneys use California’s strong protections alongside New York law. California’s SB 1235 disclosure requirements, the state’s constitutional usury cap of 10% for non-exempt lenders, and CCP §1132-1134 restrictions on confessions of judgment all provide additional defense layers. Their attorneys file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the California Secretary of State, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent in funder negotiations. Over $100M in commercial debt settled. No upfront fees. Results-based pricing.
Best for: Oakland business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens who need immediate attorney-coordinated defense
Total Settled: $100M+
Focus: MCA Defense & Settlement
Attorney-Led: Yes
COJ Challenges: Yes

Where your business is matters. If it’s in California, the state’s law has a few protections that businesses in many other states don’t get. Since January 1, 2023, California courts can no longer enter or enforce a confession of judgment. COJ’s previously obtained or entered are not affected. In 2019, New York stopped letting courts use COJ’s against non-residents. A funder can still register a judgment in California from another state and attempt to enforce it, but the defendant has 30 days to object after being served with notice of entry of the out-of-state judgment.

California since December 9, 2022 has required MCA providers to give clear disclosures. Since October 1, 2023, it has been illegal for them to treat small businesses unfairly, deceptively or abusively. The Department of Financial Protection and Innovation takes complaints online. Noncompliance with disclosure laws usually doesn’t void the contract, though.

Stop the ACH

When the funder starts pulling money every day from your bank account, you may want to stop the ACH or just close the account and walk away. A funder may treat either as breach and trigger the personal guaranty. A lawyer can see if the funder followed regulations in setting up its ACH authorization, and protect the bank account without creating new liability.

Can the funder freeze your bank account? Generally not until there’s a judgment - a COJ, a court ruling, or a confirmed arbitration award. Only then can a restraining notice go to the bank or a sheriff’s levy served on the bank. A lawyer can challenge an improper restraint or free exempt funds.

Whether an MCA is a purchase of receivables or a loan is a big question, and courts look at the business’ right to reconciliation, and whether there is a finite term, or recourse if the business fails. If a court decides an MCA is a loan, usury laws may apply, but not every MCA is a loan. It’s a fact question decided case by case.

MCAs often file a UCC-1 to put their interest into the public record. Once the deal’s paid off, a written demand can generally force them to terminate the filing within 20 days.

Most MCAs require a personal guaranty. If the business doesn’t pay, the funder can sue the owners directly. Owners’ personal property is on the line. Many MCAs require arbitration. Once a funder has an arbitration award against an owner, it files it with the court, and asks the court to confirm it as a judgment. In New York, there is generally a 90-day window to move to vacate the award.

A lot of MCA disputes end in a negotiated settlement. The business can wind up paying less than was originally owed, on new terms, and with liens released. A bankruptcy filing, of the business or the owner, will usually stop a funder from trying to grab money, since the “automatic stay” bars most collection efforts during the bankruptcy case. For a business, it doesn’t automatically resolve a personal guaranty. This is a whole different strategy with its own pros and cons to consider.

Where an MCA dispute ends in court, a judge sees certain defenses come up again and again, and many just don’t work. Sovereign citizen arguments won’t stop collection of an MCA. Neither do those Internet MCA “form letters” that tell the funder it’s wrong. Telling your bank the funder’s authorized debits were unauthorized won’t work. Transferring property to another entity, in order to keep the funder from reaching it, can be a fraudulent transfer. These and more create new problems of their own and usually don’t stop an MCA.

Typically Charge $400 to $500 an Hour

According to the Alameda County Bar Association, lawyers in its referral service typically charge $400 to $500 an hour, and some also charge a $3,000 to $5,000 retainer up front. Some lawyers may charge a flat fee for tasks like document review or filing motions to vacate. California requires a lawyer to put the fee agreement in writing if the bill is likely to exceed $1,000. If not, the client can cancel the deal. This rule doesn’t apply if the client is a corporation, though.

During the consultation, ask how many MCA cases they’ve done in the past 12 months. Have they ever dealt with confessions of judgment, arbitration, or litigating an MCA in court? If they’ll file or defend a lawsuit, in which courts, and will they use local counsel if the court is not in California? How quickly can they respond if a bank levy or notice of a levy shows up? What’s a realistic timeline for your case?

To prepare for your consult, pull together your MCA agreements and your ACH authorizations, the last 90 days of your bank statements, and any letters you’ve had from the funder or the broker. Don’t sign anything new while you’re waiting to see your lawyer, and don’t ignore court papers or demand for arbitration. Once you default or get a default judgment, it’s much harder to undo.
