2026 Best MCA Defense Lawyers in Oklahoma City, OK

Bottom line: Sadly, many well-meaning and solid businesses find themselves locked into a predatory MCA agreement that they can’t get out from under. The best “MCA defense” lawyer in Oklahoma City is not certified by the bar association; there is no official ranking. One thing a good one does is read your merchant cash advance contract carefully. You can select someone whom you believe is honest and knowledgeable, and in doing so, you will have the best chance at a good outcome.

Top MCA Defense Firms for Oklahoma City Businesses - 2026

Delancey Street

Attorney-Coordinated MCA Defense & Settlement - $100M+ Settled Nationwide

Important: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company that works with a nationwide network of licensed attorneys - and that distinction matters. Their attorneys handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution for Oklahoma City business owners. Their network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of whether your business operates in Bricktown, Midtown OKC, or out in Edmond - and the evolving appellate case law that is reclassifying MCAs as loans subject to interest rate caps.

Where Delancey Street separates from every other firm on this list is MCA-specific legal firepower. Their attorneys don’t just negotiate - they challenge. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the Oklahoma County Clerk, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent in funder negotiations. For Oklahoma City businesses dealing with stacked MCAs - common among oilfield service companies, restaurants in Automobile Alley, and contractors across Oklahoma County - Delancey Street coordinates multi-funder settlements that address all advances simultaneously.

Best for: Oklahoma City business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens who need immediate attorney-coordinated defense
Total Settled: $100M+
Focus: MCA Defense & Settlement

COJ Challenges: Yes

National Debt Relief

Largest U.S. Debt Settlement Firm - A+ BBB Rating - 550,000+ Clients

Important: National Debt Relief is not a law firm and is not an MCA defense specialist. They’re the largest debt settlement company in the United States - over $1 billion in debt settled, 550,000+ clients served. They handle general unsecured business debts - credit cards, vendor accounts, lines of credit - but they do not challenge confessions of judgment, file usury defenses, or dispute UCC liens. If your Oklahoma City business debt is primarily traditional unsecured debt and not MCA-specific, they’re a strong option. If you’re dealing with MCA funders, COJs, or frozen accounts - you need a firm with MCA-specific attorney involvement.

Best for: General unsecured business debt - credit cards, vendor accounts, lines of credit over $7,500 (not MCA-specific defense)
Clients Served: 550,000+
Fee Structure: 18-25% of Enrolled Debt
MCA Defense: No

CuraDebt

25+ Years in Business Debt & Tax Resolution - IAPDA Certified

Important: CuraDebt is not a law firm and is not an MCA defense specialist. They’ve been in the debt resolution business for over 25 years - handling business debt, consumer debt, and IRS/state tax resolution. If your Oklahoma City business situation involves both MCA debt and tax obligations - common among OKC energy companies managing Oklahoma Tax Commission obligations alongside MCA payments - CuraDebt can handle the tax side while a firm like Delancey Street handles the MCA defense. They do not challenge COJs, raise usury defenses, or file legal motions against MCA funders.

Best for: Combined business debt and tax resolution - IRS/state negotiations, multi-layered financial situations (not MCA-specific defense)
Years in Business: 25+
Tax Resolution: Yes (IRS & State)
MCA Defense: No

The Terms Within the MCA Contract

MCA providers are not banks. They are not lending institutions. As such, they claim they are not bound by the same rules as lenders. Oklahoma has very few, if any, special rules for MCAs. There is no licensing requirement either. If you are tangled up in an MCA, generally, the rules for most of that agreement are the fine print. Most agreements pick New York law and courts. Therefore, the terms within the MCA contract truly make a difference.

One of the major questions is whether a court will find that the agreement was a loan in disguise. Disguised loans are subject to all the laws applied to other loans. Perhaps a judge will look at the true nature of the deal, find it was always a loan, and say usury laws prevent the company from recovering on the MCA at all.

MCAs always claim that they are buying some of your future sales. But if they debit you every single day the same amount, then that’s not investing in you - that’s a loan. That may mean the MCA overstepped the bounds of its claimed non-lender status and jumped straight into “usury,” which is charging too much interest on a loan. Keep the bank statements showing that, no matter what your sales may have been, the daily debit from your account never changed.

Look out for the reconciliation clause promising to cut your payments if sales drop. Those agreements often either have a reconciliation window so narrow that no busy small business can meet it, and/or give the funder discretion to skip it altogether. Also, a true purchase of future sales should not have a settlement deadline. And you should seek proof of any reconciliation requests denied or ignored by the funder.

Beware the factor rate on the MCA agreement. So you get $100K on a six-month term and have to repay $135K. With the numbers, you are paying $35K to get $100K for half a year: a factor rate of 1.35 and an annualized interest rate approaching 70%. Meanwhile, the criminal interest cap in New York is 25%. With these deals, it can reach triple digits APR, and it can make a judge take a really serious look at the whole document.

A blanket UCC lien on all your business assets, and a personal guarantee on any balance owed: both are red flags that may turn your fast cash into a high-interest loan. Remember, the MCA claims that it’s buying your future business income. They have you sign this because they mean to collect from you directly, and never mind the “we’re buying future income” bit. And you better check that guarantee in your merchant cash advance agreement closely. Sometimes it’s limited to promises like truthfulness and cooperation.

A confession of judgment lets the other side get a judgment just by filing some forms; no lawsuit or notice to you needed. Since 2019, New York has barred anyone from filing a confession of judgment there against out-of-state companies. Confessions are still deadly as far as they go, though.

You’ll also want to check the default section of the agreement. Look out for a default clause that says you are in default as soon as you get another advance, or change your bank, or dispute the MCA; or even talk to a lawyer. When any small detail or simple mistake can make the MCA jump all over you, that could be an “unconscionable” or shockingly bad contract. A jury waiver or an arbitration clause can still get challenged.

The Deadline

If you are in Oklahoma district court, you normally have 20 days to answer. The clock usually starts running with service of the petition. The best time to hire a lawyer is before your response runs out. As a temporary stopgap, a reservation of time buys you 20 more days to answer, but it gives up some defenses, like jurisdiction and service of process. Ask your lawyer first, if you have one; if not, see one.

Almost every claim has a deadline, called a statute of limitations. In Oklahoma, the time to sue on a written deal is usually five years. The deal’s choice of law clause may affect the deadline. Check your contract’s choice-of-law clause and then look up that state’s statute of limitations on written contracts.

A Good Lawyer

When you go to a good lawyer for help with a merchant cash advance, bring the contract. They’ll look at signs that it was really a loan all along; one is daily debits from your account. They’ll look for signs of criminal loan interest rates. You’ll also want to ask about the court’s deadline for answering the petition.

Lawyers usually bill by the hour, by the outcome, or at a flat rate. Different cases lend themselves better to one fee agreement or another. All those fees must also be reasonable for the case’s situation. Charges for filing the answer and serving it on the other side are usually extra. With some clients, lawyers may agree to a monthly or annual retainer. But any lawyer-client fee arrangement should get spelled out and put in writing, and each side should keep a copy.

Look through your agreement, find every point that is fishy or looks wrong, make a note of it, and hand it to your lawyer when you meet. Every one of them is a defense, and a bargaining chip, and the more there are, the more likely it is the MCA company won’t sue, and the more likely it is to settle for a fraction of the amount you owe.

Remember also that the funders are not untouchable. In January 2025, the New York Attorney General announced a settlement requiring Yellowstone Capital to cancel over $534 million owed by more than 18,000 small businesses. It goes to show no one is too big to get called out for wrongdoing. Don’t let anybody tell you nothing can be done.
