2026 Best MCA Defense Lawyers in Iowa

Bottom line: When you have Merchant Cash Advance (MCA) loans and find yourself in over your head, you look for the best attorney in the country to defend you. The truth is, there is no official ranking of the best business litigation attorneys, and you have to narrow your list to lawyers licensed to practice in Iowa who specialize in handling commercial cases for business owners, such as merchant cash advance lawsuits, confession of judgment defenses, and bank levies. Every case has some distinguishing facts, and a proper response takes those into account. Always start by having all documents reviewed by a merchant cash advance attorney before any response deadline passes.

Top MCA Defense Firms for Iowa Business Owners - 2026

When dealing with litigation, experience matters, but industry-specific experience matters even more. Avoid litigation attorneys who claim to handle every business case because MCA cases are simply a different animal than the run-of-the-mill business litigation cases. Many merchant cash advance contracts call for disputes to be settled in New York state, under New York law, and in New York courts. When commercial debtors fall behind, lenders swoop in with confession of judgment or arbitration demands with little warning and seek to collect large sums on threat of bank levies and collection suits.

Delancey Street

Attorney-Coordinated MCA Defense & Settlement - Serving Iowa Business Owners - $100M+ Settled Nationwide

Important: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company that works with a nationwide network of licensed attorneys - and that distinction matters. Their attorneys handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution for business owners across all 50 states, including Iowa. Their network is built around New York’s dual usury framework and they also use Iowa’s exceptionally low 5% legal interest rate under Iowa Code §535.2 when arguing for MCA reclassification as a loan.

Where Delancey Street separates from every other firm on this list is MCA-specific legal firepower. Their attorneys don’t just negotiate - they challenge. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the Iowa Secretary of State, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent. Over $100M settled. No upfront fees. Results-based pricing.

Best for: Iowa business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens who need immediate attorney-coordinated defense
Total Settled: $100M+
Focus: MCA Defense & Settlement

Iowa Law

In New York, confession of judgment filings generally are not allowed against non-New York business owners with no place of business in New York. Iowa, by contrast, lets a court clerk enter a judgment based on a written statement of facts, signed by the business owner, and verified. A qualified merchant cash advance attorney will check all the steps that led to the judgment and look for mistakes or omissions. They may also look at the agreement itself, the advance, and the amount claimed.

A creditor with a judgment in another state can file it in Iowa, and collection actions can take place in the state. The filing clerk will mail notice of that filing to your company, but collection actions do not happen until 20 days later. Iowa courts must delay enforcing an out-of-state judgment if an appeal is pending or the other state issues a stay, as long as you prove it and pay any security bond the other state requires.

Iowa lets a creditor with a written contract sue for 10 years, and if they get a judgment, they have 20 years to enforce it, even if the judgment is from another court. Waiting for a lender to forget is rarely a smart strategy, and even less so here.

Iowa’s take on whether MCA transactions are loans makes a difference. If Iowa law governs the contract, a business that agreed in writing to the rate cannot raise usury as a defense. The main issue in such cases is whether the advance is a loan or not, which courts look at on a case by case basis. In New York, courts weigh factors like how the contract handles reconciliation, whether it has a fixed end date, and whether the funder can collect even if the business fails.

When the lender comes calling for payment, your first instinct might be to protect the bank account they drew on every week. Stopping the ACH payments, closing the account, or moving to another bank can be a breach of the contract that triggers your personal liability. A more conservative approach is to talk to a lawyer first, who can advise you on what you can do to protect your accounts without creating additional liability.

Many merchant cash advance agreements include a provision letting the funder file a UCC-1 financing statement, which gives them a lien on business assets. Such a lien can have a big impact on the business’s ability to get other financing, and once the debt is paid off, the funder usually must file a termination to release the lien within 20 days of your written demand.

Just about every contract has a personal guaranty that makes the business owner personally responsible, and can put a personal bank account and home at risk. A lawyer can try to cut it down or bargain for a settlement that caps your exposure. If the dispute goes to arbitration instead and you lose, New York generally gives you 90 days after receiving the award to move to vacate it.

What can a debt settlement company do for you? Could they give you legal representation when the MCA lender obtains a judgment against you or your business and starts to levy your bank account? Will they represent you in court if your business is sued? An attorney takes those actions. Iowa’s debt-settlement licensing law only protects individuals, not corporations or other businesses.

Public records mean anyone can check any lawyer’s status. Look up the lawyer’s name on the Iowa Supreme Court’s Office of Professional Regulation public list of licensed lawyers. If you cannot find the lawyer listed or they show up as anything other than “Active,” call the Office of Professional Regulation at (515) 348-4670.

It is a good idea to be open when first meeting a lawyer, and to ask many questions. Be sure to ask how many similar MCA cases the lawyer has handled in the past year, if they have fought a confession of judgment, whether they handle arbitration cases, and how fast they respond to bank levies. The total cost of handling legal issues varies from case to case. Some lawyers charge a flat fee to review your documents, while others bill for hours spent on it. In Iowa, a contingency fee deal must be written, signed by you, and specify how the percentage is calculated and any expenses, as well.

Before going to your first meeting with your lawyer, gather your merchant cash advance agreements, bank statements for the last three months, and every text and email related to the advance. Do not agree to any settlement or new advance until your attorney has reviewed it. Ignoring any legal papers is the worst mistake you can make, whether court papers or an arbitration notice. A default judgment is harder to undo than it is to avoid in the first place. Do not tell your bank you did not authorize a valid debit or give any other false reason.
