2026 Best MCA Defense Lawyers in Kentucky

Bottom line: People ask who the best merchant cash advance defense lawyer in Kentucky is, and there is no ranking that can tell you. What matters is that the lawyer is admitted in Kentucky, handles MCA cases, sits down with you with each agreement, explains what they will do and what they will not, and gives you a straight-up estimate of their fees.

Top MCA Defense Firms for Kentucky Business Owners - 2026

To find a lawyer, a good place to start is with the Louisville Bar Association’s Kentucky Lawyer Referral Service, which you can reach at (502) 583-1801. The first consultation is free for up to 30 minutes. You should talk to more than one lawyer before hiring anyone. Meet with them and ask them questions about your specific agreements. If they can not answer them or show you how they would develop a strategy to defend you, you need to look for another lawyer.

Delancey Street

Attorney-Coordinated MCA Defense & Settlement - Serving Kentucky Business Owners - $100M+ Settled Nationwide

Let's be clear - Delancey Street is not a law firm. They're a high-powered MCA debt settlement operation that works with a nationwide network of licensed attorneys who fight for you. Their network is built around New York’s dual usury framework and they use Kentucky’s 8% legal interest rate under KRS §360.010 to beat MCA funders into submission.

Here's what their attorneys do - they file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the Kentucky Secretary of State, and use the NY AG’s $1 billion Yellowstone Capital settlement as precedent. Over $100M settled. No upfront fees.

Best for: Kentucky business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens
Total Settled: $100M+
Focus: MCA Defense & Settlement

Confessions of Judgment

In Kentucky, an advance agreement that gives the plaintiff’s lawyer the power to appear in court for you and admit the debt is void, with one exception, if it is signed before the suit is filed. No person may represent a defendant under such an agreement (KRS 372.140(2)).

In 2019, New York amended CPLR § 3218 to bar clerks from entering confessions of judgment against non-New York residents. This included business debtors outside New York. For you as a Kentucky owner, a New York confession of judgment does not prove that the plaintiff can use it to take your money. The fastest way to find out is to have a lawyer review all the documents, including the docket entries and notices of hearing, with you.

Whether an Advance Is a Loan

You may enter into a merchant cash advance agreement with the understanding that you are selling future accounts receivable, not taking a loan. Whether an advance is a loan usually depends on the terms, the agreement’s governing law, and the operation of the deal. Labeling the agreement a purchase does not settle the matter. A 2020 New York appellate court cited three factors: whether an agreement has a reconciliation provision, is for a finite term, or gives the funder recourse if the merchant goes bankrupt. A merchant cash advance is not always unsecured or collateral free; these instruments may include a security interest or a UCC filing. And the factor rate is a payment multiple, not APR.

Merchant cash advances are also regulated, with disclosure rules at the state level and registration in some areas. The FTC has sued companies. However, not every MCA is exempt from usury laws, and a suspected violation does not cancel what you owe.

A good MCA lawyer can review each agreement and tell you what to look for, like UCC financing statements, personal guarantees, default clauses, and the courts where disputes must be decided. They can negotiate settlements and defend you in lawsuits. If you already have a judgment, they can look at how it was obtained and how it is enforced through bank restraints and collection. Still, a lawyer cannot promise you a settlement for pennies on the dollar, that you get to keep the frozen funds in your bank account, or that they will dismiss the lawsuit. What is possible depends on the law, the contract, and the evidence, and good lawyers will discuss them with you.

When a funder declares a default, start with the notice they sent, the provisions they cite, and the payment history. Talk it through with a lawyer before stopping payments or signing new paperwork. Do not rush into signing something just to get the calls and messages to stop.

If you or your business have been sued by a merchant cash advance funder, your documents should show the name of the court, the case number, and who is being sued. The business or corporation may be named separately from you personally. You must know where you were served and the deadline for answering. Negotiating does not extend the deadline or release restrained funds.

When you have several merchant cash advances pulling from the same source of receivables, don’t review one in isolation. The receipts are all the same, so they must be reviewed together. On one page, list each funder, the amount the borrower received, what the current balance is, how often the funder collects and how much they collect. Add the weekly withdrawals and compare them to your operating costs.

When you hire a lawyer, Kentucky requires that every fee be reasonable, and any fee contingent on the outcome of a suit must be in writing, signed by the client, stating how it will be calculated and any expenses to be deducted. See Kentucky Supreme Court Rule 3.130(1.5). Ask who will be responsible for your case, what businesses and owners are involved and covered, whether the fee covers negotiation or litigation or both, and who will appear for you in court. If you will need local counsel in another state or city, get this in writing.

Calling a lawyer does not pause a lawsuit or collections, so mention any deadline in the first conversation. You can get help even if you are still making payments. Bring each merchant cash advance agreement, bank statements, notices, and lawsuit papers.
