2026 Best MCA Defense Lawyers in Michigan
Top MCA Defense Firms in Michigan - 2026
A licensed attorney’s licensed status enables them to represent you in court and to make legal arguments before a judge. A debt settlement company is not licensed, and is not permitted to argue before a judge. So if a confession of judgment has already been filed, a bank restraint is already in place, if a lawsuit is already active against you, or if an order granting MCA lender the right to tap your receivables is in effect, you will need an attorney to have that undone. The part people miss is timing. The best moment to settle is when no lawsuit is pending. Once the funder’s attorney is involved and they are drafting motions for the court, the cost of resolution rises dramatically on both sides.
Delancey Street
Let's be clear - Delancey Street is not a law firm. They're a specialized MCA debt settlement operation that works with a nationwide network of licensed attorneys who handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution on behalf of Michigan business owners. Their network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of where your business operates - and the evolving appellate case law that is reclassifying MCAs as loans subject to interest rate caps.
For Michigan business owners specifically, Delancey Street’s attorneys use the state’s prohibition on confessions of judgment to block domestication of New York COJ-based judgments, while simultaneously challenging the MCA contract under New York’s 25% criminal usury threshold. Michigan’s own usury cap of 25% under MCL § 438.41 aligns with New York’s criminal threshold, creating a consistent defense framework. The Michigan Attorney General’s office has also been increasingly attentive to predatory commercial lending practices, adding regulatory pressure to settlement negotiations. Over $100M in commercial debt settled. No upfront fees. Results-based pricing.
National Debt Relief
Important: National Debt Relief is not a law firm and is not an MCA defense specialist. They’re the largest debt settlement company in the United States - over $1 billion in debt settled, 550,000+ clients served. They handle general unsecured business debts - credit cards, vendor accounts, lines of credit - but they do not challenge confessions of judgment, file usury defenses, or dispute UCC liens. If your Michigan business debt is primarily traditional unsecured debt and not MCA-specific, they’re a strong option. If you’re dealing with MCA funders, COJs, or frozen accounts - you need a firm with MCA-specific attorney involvement.
CuraDebt
Important: CuraDebt is not a law firm and is not an MCA defense specialist. They’ve been in the debt resolution business for over 25 years - handling business debt, consumer debt, and IRS/state tax resolution. If your Michigan financial situation involves both MCA debt and tax obligations - including Michigan Department of Treasury issues - CuraDebt can handle the tax side while a firm like Delancey Street handles the MCA defense. They do not challenge COJs, raise usury defenses, or file legal motions against MCA funders.
Whether an MCA Product Was a Loan or Not
The very first thing a good MCA defense lawyer will want to know is whether your MCA was an advance or a loan. In a 2020 case, LG Funding v United Senior Properties, the New York appeals court looked at three factors to determine whether an MCA product was a loan or not: whether there is a reconciliation provision, whether the advance has a fixed term, and whether a lender can keep collecting from a merchant who goes bankrupt. A label can’t determine legal character. In In re Kossoff PLLC, a bankruptcy court looked at 19 merchant cash advance contracts and treated every one of them as usurious loans under New York law, even though the contracts said they weren’t loans. A good MCA defense lawyer will look for weaknesses in any contracts or agreements that were signed.
It matters because in Michigan, knowingly charging above 25% simple interest a year on a loan without legal authority is criminal usury. The penalty is up to five years prison, a $10,000 fine, or both. There’s a catch, though. Under MCL 450.1275 a corporation can agree in writing to pay interest above the legal rate, and the corporate entity is barred from raising usury as a defense. Fine print doesn’t always save the funders either. In Soaring Pine v. Park Street (2023) the Michigan Supreme Court said a usury savings clause does not save a note that is usurious on its face.
Since August 30, 2019, New York CPLR 3218 bars filing a confession of judgment in New York against a non-resident. A business is not a New York resident unless it maintains a place of business in New York. No place of business there, no confession filed there. Time matters too. Under MCL 600.5807 the general time limit to sue over a breach of contract is 6 years.
None of this is cheap. MCA defense attorneys usually bill hourly or have you advance a flat retainer, and can require $3,000 to $10,000+ to deal with each funder. Paying for a lawyer doesn’t mean that the debt itself won’t have to be paid as well. Michigan’s rules say a lawyer needs to have a contingency fee agreement in writing, and it has to say how it’s calculated. Debt settlement companies usually charge 15-25% of enrolled debt, or a flat fee per account. Some of those are monthly, as well. Read all fee agreements before you sign them.
Being sued by MCA funders can take 6 to 18 months, sometimes more, from initial filing to resolution. A negotiated settlement deal, though, can close in 90 days or less per account, sometimes in two weeks. If the business is bleeding cash daily, that gap is all that matters.
This is where the slope gets slippery. An attorney will often tell you to block the daily ACH, but blocking it is itself a default trigger under virtually every MCA agreement you’ve signed. When you do that, you’ve started the legal fight. The same move can be part of a different plan entirely. A settlement company usually recommends blocking ACH too, but typically contacts the funder before or right after and frames the hardship with a specific settlement offer that’s designed to keep it out of court.
If you’ve got several stacked MCAs, a lawyer has to fight each funder separately. Attorneys usually need a separate retainer for each funder, especially if they are in different jurisdictions. By contrast, if the total debt on the MCAs is less than $200,000 or so and you have three or more, a debt settlement company will often be able to negotiate with all of the funders in a sequence, at lower cost.
Before you hire anyone, check them out. A licensed attorney has ethical duties, is regulated by the bar association, carries malpractice insurance, and answers to a state disciplinary board if something goes wrong. The Michigan Attorney Discipline Board will tell you whether a lawyer has ever been put on probation, reprimanded, suspended or disbarred. The Board has a form for requesting a certificate of an attorney’s disciplinary history. The other side of that coin is that there is no licensing requirement for debt settlement companies. Some are run by ex-MCA industry people who know the funders, others are glorified call centers. You have to vet them harder and more thoroughly because there’s no bar association backing you if things go wrong.
Settlement usually makes sense if you’re behind on payments but nobody has filed in court yet, if you’re stacked with multiple MCAs and can’t keep up, if you want to resolve the issues quickly without litigation, and you have some cash for lump-sum or structured payoffs. Sometimes you need both. When one funder has sued while others haven’t, the lawyer can handle the suit and the settlement company can keep working on the rest. This happens more often than you’d think, and it’s often the smartest play.
The critical point is, don’t wait. Don’t treat this like an overdue phone bill. The worst thing to do is to ignore it. They won’t send you a second, polite reminder a week later. They’re going to escalate quickly, usually within days not weeks.

If your Michigan business debt is primarily traditional unsecured debt (not MCAs), they're a solid option - but if you're dealing with an MCA, this is not your firm.
