2026 Best MCA Defense Lawyers in Maine
Top MCA Defense Firms for Maine Business Owners - 2026
That 20-day deadline generally applies to any summons and complaint, including an MCA lawsuit, in Maine state court. If you miss the deadline, a court can enter a default judgment against you. As the defendant, you could lose the case without the ability to tell the court your side of the story. It’s easier to file your answer right away instead of trying to undo the default judgment later.
Once the lender obtains a judgment in an MCA lawsuit, they can use it to enforce the judgment and collect any unpaid debts. This can include freezing the business’s bank accounts, enforcing liens on equipment or inventory, going after the owner personally under a personal guarantee, and contacting customers.
Delancey Street
Let's be clear - Delancey Street is not a law firm. They're a high-powered MCA debt settlement operation that works with a nationwide network of licensed attorneys who champion your case. Their network is built around New York’s dual usury framework and they use Maine’s 6% legal interest rate under 9-B M.R.S.A. §432 to beat MCA funders into submission.
Here's what their attorneys do - they file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the Maine Secretary of State, and use the NY AG’s $1 billion Yellowstone Capital settlement as precedent. Over $100M settled. No upfront fees.
National Debt Relief
Not an MCA defense specialist. Handles general unsecured business debts only. If your Maine business debt is primarily traditional unsecured debt, National Debt Relief is a strong option.

CuraDebt
Not an MCA defense specialist. If your Maine financial situation involves both MCA debt and tax obligations, CuraDebt can address the tax side - including Maine Revenue Services issues - while Delancey Street handles MCA defense.
The Maine Consumer Credit Code excludes credit mainly for business purposes and is generally based on the purpose of the loan, so it probably does not apply to your merchant cash advance. In August 2026, a 50-state survey found that Maine had no laws specifically covering MCAs. Because many contracts choose New York law and New York courts, a lawyer in Maine must understand New York law, which may control the case and make a difference to your business.
Contract Defenses
Defenses depend on your contract, your payment history and which state has jurisdiction over the case. An experienced attorney reviews all of them before the answer is filed, because defenses left out are often waived for good.
The strongest argument is usually that the deal is really a loan, not a purchase of receivables. In 2020, a New York appeals court decided LG Funding. The LG Funding court considered three specific issues to assess whether a funding transaction should be categorized as a loan or a sale of future sales:
- a reconciliation provision,
- a finite term, and
- recourse if the merchant goes bankrupt.
Why does it matter? New York law says charging more than 25% a year on a loan is criminal usury, a class E felony. Some MCAs have effective interest rates in the triple digits. That may make the contract unenforceable in New York. Regulators agree: in January 2025, the New York Attorney General won a $1.065 billion settlement judgment against Yellowstone Capital. The AG described the advances as disguised loans with rates up to 820% a year and canceled $534,552,724 owed by more than 18,000 businesses.
The second defense focuses on an underappreciated part of most MCA contracts, the reconciliation provision. This part usually says that if your business revenue drops, you can notify the funder and adjust the payments. Many providers stall or ignore those requests. If the contract calls for reconciliation, and the lender ignored it, keep proof.
Then look at what the funder actually did. Did they take unauthorized withdrawals, keep debiting your account after you asked it to stop, charge undisclosed fees, or have their broker quote a number much different than the contract says? If so, that can support a defense and possibly a counterclaim.
There are a few more worth knowing. Since August 30, 2019 a funder can’t file a confession of judgment in New York courts against a business with no place of business in New York, like a Maine business. If the address for papers is wrong or out of date, a court may throw out the case or judgment. If you signed a personal guarantee, you might be able to use those same contract defenses to fight the lawsuit.
A Local Maine Attorney
Some law firms know enough to answer a summons but don’t know MCA contract terms. Some litigators win lawsuits but can’t counsel you on all the options to avoid litigation. Search for a local Maine attorney who understands the law of merchant cash advance contracts. Confirm that the lawyer is able to file an answer for you before the 20-day deadline.
If you don’t know where to start, the Maine State Bar Association has a lawyer referral service. A $35 referral fee gets you a 30-minute consultation with a local lawyer. As the new defendant, you should gather documents to hand over to your lawyer. Bring copies of any signed contracts and every addendum or change. Bring bank statements for the whole repayment period, transaction reports, account statements from your card processor, any texts or emails with the funder, and the lawsuit and summons documents (or postmarked envelope if served that way).
Get a clear understanding on pricing. What do the legal fees include? And if you fight about the legal bill, the Board of Overseers of the Bar’s Fee Arbitration Commission will hear the dispute for free, in front of three people: two lawyers and one non-lawyer.
While you’re waiting for the Maine lawyer, don’t empty bank accounts, move money to a relative, or open a new account to hide deposits (those can look like fraudulent transfers). If you find yourself on a collections call, don’t say anything to the company or its lawyers, because anything you say, like admitting you owe the full balance, can be used against you.
A Deal May Be the Smarter Move
This does not have to be all or nothing. Often, a powerful answer is what prompts the funder to the discussion table. If reconciliation failure is documented, the lender often has reason to discuss a reduced payoff. If your paperwork is thin, a deal may be the smarter move. And check the contract for any arbitration clause right away.
Two things to remember. Any new agreement with the funder is its own contract and some contain confession of judgment language, so don’t sign under pressure and review anything with a lawyer first. And don’t take another advance to pay this one; stacking usually makes it worse. The clock on your papers can’t be stopped or reversed, so the sooner a lawyer reviews your agreement and payment history the more options stay open.
