Business Debt Settlement in Nevada
Top 3 Business Debt Settlement Firms for Nevada (2026 Rankings)
But picking the right lawyer is like matching the attorney and the client. An ad or online ranking cannot tell you whether an attorney is right for a business loan gone bad. It depends on what the company owes, to whom, and whether you signed for it personally. The commercial debts these lawyers typically handle include lender claims, vendor bills, commercial leases, equipment finance, personal guaranties, and multiple creditors at the same time.
Cut, Restructure or Otherwise Resolve What It Owes
When a business settles a debt, it means reaching a negotiated deal to cut, restructure or otherwise resolve what it owes. That could include a discounted payoff, longer repayment terms or other arrangements. Whatever form the settlement takes, the aim is to protect cash flow and keep the doors open.
A million-dollar debt may sound like doom. When the claim is large enough, and enough leverage exists, it’s often possible to reach a structured settlement, workable to all sides. And defending such a claim through counterclaims can cut its size or even defeat it entirely.
Debt-settlement companies may contact you after you fall behind on payments. NRS Chapter 676A regulates debt-management firms, but excludes Nevada lawyers doing legal work for their clients. People who do debt-settlement work may be licensed under Nevada NRS Chapter 676A but not licensed to practice law. The State of Nevada requires that no settlement fee be collected until at least one debt has been settled and the client has made the first agreed-upon payment. But for a lawyer handling debt work, that rule does not apply. The lawyer’s fee timing comes from his or her engagement terms and the state bar’s rules, which makes the fee terms matter more.
In reorganizing a small business with lots of debt, a lawyer’s first job is to read the loan papers, find out about collateral and guaranties, and what the owner needs to keep running. Then start asking creditors for a payoff discount or better terms, preferably with a standstill period until a plan is set. The point of that first step is to create a strategy to protect and stabilize the company, not just set up a payoff of one debt.
When settling debts with several creditors at once, coordinate everything so that a lawsuit by one does not trigger actions by the rest. If you cut a deal with one of them, make sure that deal is completely closed. If you settle, get a release; if you need extra time, get a forbearance agreement or a stipulation.
Cutting a deal with someone you intend to keep doing business with can be tricky. The key is a creative bargain where both sides can still do business.
Say a commercial supplier presses you for money for goods that didn’t work. That may support claims for breach of warranty, failure of consideration or deceptive inducement. The lender could be wrong: did it accelerate improperly, or sell collateral in a commercially unreasonable way? If you know this, you can even sue first to challenge debts that may not be enforceable. And even if your creditor sues first, you can keep your defenses with an answer, use discovery to find any necessary information, bring motions, and use the court’s mediation to work out a settlement.
If you signed a personal guaranty for your business loan, then your own assets may be on the line. How much it reaches, and whether it’s even enforceable at all, will turn on what the guaranty says and what happened to the company loans it supported. So in debt settlement the lawyer reads the guaranty wording, seeks a full release, or puts a dollar cap on what you personally might owe. And often restructuring the company debt shrinks or ends your own exposure.
Nevada Rule of Professional Conduct 1.5(b) requires every attorney to explain up front what the fee covers and how much it will cost, preferably in writing, before starting work or as soon after as possible. Your lawyer should also make clear what’s included and what’s extra. If there is a contingent fee deal, it must be in writing, signed by the client, with the key terms shown in boldface type.
A Tax Side to Every Debt Settlement Deal
The IRS usually treats forgiven or canceled debt as income in the year the cancellation occurs. When this happens, banks, credit unions, and finance companies file Form 1099-C when $600 or more is canceled. Getting a settlement discount is not all savings.
If none of the people you owe will negotiate, a lawyer can weigh Subchapter V small-business Chapter 11. For filings on or after June 21, 2024 the debt limit is $3,424,000.
Statute of Limitations
If you’ve failed to pay a past-due debt, first ask a lawyer about the statute of limitations before you pay anything. Nevada law gives a creditor six years to sue on a written contract. A late payment restarts that clock, but only if it arrives before the 6 years has run out. So a small good-faith payment on an old bill can hand the creditor a fresh six years. Find out where the clock stands first.
Bring questions to the first meeting. Has your lawyer handled your kind of case? How many? Will the attorney go to court if talks fail? If there’s a personal guaranty, what’s the plan for it? How does the fee work? Often there will be more questions, but those are usually a good place to start.
The best time to talk to a lawyer is the minute you get a demand letter, default notice, lawsuit or threat to lock you out. The same advice fits a supplier’s chase for payment for goods that did not perform, or if several creditors come at once. How long it takes depends on the creditors, the paperwork and the court calendar. Starting sooner typically gives you more options.
