2026 Best Business Debt Settlement Lawyers in Montana

Bottom line: Some people want to know who the best business debt settlement lawyer in Montana for merchant cash advance debt is. The reality is that nobody is necessarily best. You need someone who is a licensed attorney who can settle your debt, stand up for you in court, and even file a bankruptcy case if it comes to that. Just hiring a settlement company is not enough to protect you. Pay a debt settlement company and you are gambling.

Top 3 Business Debt Settlement Firms for Montana (2026 Rankings)

In Montana, that difference is written into the law. Lawmakers here say that anyone who works to “settle” a debtor’s debts is offering debt settlement services, but a lawyer in ordinary practice isn’t a “debt settlement provider”.

Debt settlement companies will say they can settle your MCA debt. But here’s what they don’t tell you. They don’t tell you they will not help you if you get sued. If you hire a debt settlement company, they cannot give you legal advice or even appear for you in court. These guys talk all about savings, how they’ll cut your monthly payment in half by sticking your payments in an escrow account. But where are the upfront fees? And just how unrealistic are the estimates? And there is no way to get that money back. One day, your bank accounts and receivables are frozen, and you have no money to operate. You call the debt settlement company, and they tell you no progress has been made.

The Penalties Can Start Piling Up

When your Merchant Cash Advance agreement defaults, the penalties can start piling up. They can have a security interest on your bank account or even your receivables. Funders start stacking NSF fees, $35, every time your ACH doesn’t go through. Then, if you decide to issue stop payments on those ACHs, those are added fees, $500-$5,000. Default itself can cost thousands, too. $2,500, $5,000.

A UCC lien can be worse than a judgment. Where a judgment would freeze bank accounts, a UCC lien freezes your receivables. Worse, they will send it to your payment processors and to your customers, which can cost you your ability to bring in income. If you signed a contract or gave the funder a customer list or bank statements, you may be unpleasantly surprised. Your funder may have sent UCC lien copies to anyone paying you. You may have clients or customers who would go elsewhere if they found out.

A confession of judgment (COJ) used to be the big problem. It gives you no ability to fight the lawsuit. New York outlawed them in 2019 for out-of-state borrowers, but funders still sue where they can. They have started filing in Texas, Illinois, and Utah.

Domesticating a judgment is a bigger issue now. This is bringing an out-of-state judgment into Montana to reach assets here. Funders are getting more aggressive about it. And it’s another reason you need an attorney.

True MCAs

Merchant cash advances give you leverage. True MCAs are not loans but buy receivables, and when nothing comes in, nothing is owed. But a good lawyer can also spot when an MCA contract is really a loan disguised as a purchase agreement.

Whether your contract is a loan or a buy/sell makes a big difference. When legal issues do happen with MCAs, it matters that some funders profit 100% to 200% off agreements. That is usurious in most states if it is a loan. And many buy/sell contracts are written so badly that the confusion makes for a stronger argument against enforcing them.

But what is often hardest is the dishonest broker. A lot of brokers work off commission, and they can line up multiple advances for you. The thing is, a lot of them lie about it, too. They will tell you this is temporary, that they will get you a bank loan. Lawyers are taking on MCA funders and brokers.

Settlement Is a Strategy

A settlement is often expressed in percentage of debt. In a 40% settlement, that means a 40% repayment, with the remaining 60% to be forgiven. Going to court gives you some breathing room as you struggle to get the resources together.

Waiting it out is a strategy, but it can be a gamble. You have six years to be sued for a written agreement. Five years if unwritten.

Usually, a merchant cash advance is personally guaranteed. It’s important to resolve a personal guarantee when you are settling a merchant cash advance. Bankruptcy can help with an MCA. If you file bankruptcy personally, it wipes your own personal liability, not the liability of the business. Even if you file a business bankruptcy, it will leave your personal guarantee intact, leaving you still owing the debt. In Montana, you can file a personal Chapter 7 or 13, or a business Chapter 7 or 11. Chapter 11, with an option called “Subchapter V”, helps you reorganize, with filing fees alone at $1,738. That’s not even attorney’s fees.

Writing off debt is a taxable event, and usually the forgiven debt is taxable income to you. A lender reports it on a 1099-C if it amounts to $600 or more, and you pay taxes like it was income. You can exclude forgiven debt that was “discharged in bankruptcy”, or, up to an amount by which you’re insolvent. You claim these exceptions on Form 982. Including bankruptcy in your strategy can do double duty, getting rid of your debt and potential taxes.

Settlement is a strategy that is amazing for some, and horrible for others. A good lawyer is the difference, sitting down with you and telling you the pros and cons of each option. You should shop around before hiring anybody. Montana’s SBDC network provides free counseling and analysis services. They have 10 centers around the state.

When you choose the right lawyer in the beginning, you avoid hassles throughout the process. Make sure you have someone who can help from start to finish. If you hire a settlement company instead, how do you pay an attorney if you gave up all your money on upfront fees? And who can help you then? When you’re sued in a Montana court, and your lawyer cannot even enter the case in that Montana court, you’re in a world of hurt.
