2026 Best Business Debt Settlement Lawyers in Alaska
Reviewed by NYCCriminalAttorneys.com Blogging Team · Last updated
Bottom line: The best business debt settlement lawyer for an Alaska company is one who helps you understand your situation, like it or not, offers honest and solid advice to resolve it, cares about your best interests, makes you feel like an important client, not a case number, and creates a reasonable plan to resolve your issues. Above all, what you need is a credible opponent your funder will negotiate with. So look for a lawyer who has the required court admissions and credentials. Expect to speak with more than one. You might end up hiring the first one you like. But don’t rush. I don’t suggest buying the most expensive one. Just the best one for you.
Top Business Debt Settlement Firms Serving Alaska in 2026
Settlement companies are not lawyers. Even where they are friendly to their clients, they can only go so far. And when the funder sues you or freezes your bank account to collect the money, the company cannot represent you in court. Then the funder has all the leverage.

MCA Deals
An MCA provides a lump sum in exchange for a fixed share of future card sales. It is repaid through daily debit from the merchant account. This can get pricey. The downside of these advances is that they can make it difficult to afford rent when sales are down.
Another interesting thing about MCA deals is how the contracts are written. Often, they are written so that your supplier of operating capital can sue you in New York, even if the business is in Alaska, simply because of how the contract is written. So check whether the lawyer has experience in New York courts, and ask about recent cases, similar to yours. That experience can make a real difference.
If you are sued in Alaska instead, small claims court may be used for up to $10,000. District court hears disputes up to $100,000. Superior Court is where bigger cases are heard. After you are served, the clock is ticking. Missing the deadline can lead to default judgment against your company. Contract claims in Alaska generally can be brought within three years.
Setting up a litigation defense in Alaska starts with your lawyer identifying critical dates, like the service date, any default notice, and the last filing date. Gather your bank statements to see where money actually went. Your lawyer is looking for data to defend the case. When sued, a lawyer will look at whether you were properly sued. If you were sued or lost money to a funding company, a lawyer can seek to dismiss claims, or challenge the contract terms. If you have a confession of judgment, if your account was restrained, or if you have a judgment against your Alaska company, consider talking to a lawyer to see if you have any defenses. You may be able to get the freeze lifted, and/or void the judgment in some cases.
A predatory MCA contract might have large fees and not match your ability to pay, have unclear or misleading terms, feature hidden costs, feature pressure to sign quickly, or have different terms than you were promised. But the industry is largely unregulated by the federal government.
One area your lawyer will examine is whether the payments are tied to sales, and how the funder bears risk if the business fails. One factor in whether the contracts are subject to usury laws is the question whether the contract is a loan or an investment. In the loan v. investment debate, it doesn’t matter how many times the funder says it’s not a loan, or that they never lent money and the only thing they bought was the right to payments from the future business account.
A Negotiated Deal
When collecting on daily amounts, funders sometimes negotiate to accept monthly payments. In a given case, it may be possible to fold several funding partners into a single payment. Your lawyer can gather data and make projections on what each creditor could likely recover by pursuing the case versus a negotiated deal. Another way of describing this is to ask what the upside and downside is for the creditor. At first glance, the creditor assumes they will get everything. But if all they do is drive your business to bankruptcy, everyone is out of luck. Your lawyer works with your accountant or tax preparer so that your plan has a budget and a realistic chance of working. The plan has to be tailored to your case, to fit your revenue cycle. One way to create stability is to prioritize what bills have to be paid every month, so that the business can keep its essential vendors.
As for your lawyer’s own fees, in Alaska, Rule 1.5 says for fees over $1,000, the basis or rate must be in writing. Fees to be paid contingent on a recovery must be in writing and include the percentage. When a client believes they are overcharged by their lawyer, the client may start an Alaska Bar Association fee arbitration. The lawyer must participate in the process. If the amount is $5,000 or less, a single arbitrator is appointed. The FTC says debt settlement companies who sell by phone may not collect until there is an agreement on a debt and the debtor makes one payment under the settlement.
Canceled debt can be taxable income unless an exception applies. Even if the creditor did not send the Form 1099-C, you may be required to report the income on your tax return.
Using chapter 11 as an alternative requires an understanding of the costs. Gaining the protection of the bankruptcy court requires an initial filing fee. The filing fee for Chapter 11 is $1,738. The Senate in 2026 passed an extension of the small business reorganization provisions in the bankruptcy code, including a limit of up to $7.5 million in debt. As of this writing, that bill has not become law. You want a lawyer who is comfortable in bankruptcy court.
When your bank account is frozen, many things grind to a halt. After checking for the court order issued, you need to get the court case papers. If you don’t understand the court process, you want to talk to a lawyer before payroll day arrives.
So check your prospective lawyer out with the Alaska bar, make sure you understand what the fee is for, and get it in writing. Hire someone you understand, whose personality you feel good about. And look up the court deadlines.
