2026 Best Business Debt Settlement Lawyers in Alabama
Reviewed by NYCCriminalAttorneys.com Blogging Team · Last updated
Bottom line: The best business debt settlement lawyer in Alabama is a debt relief attorney who can negotiate merchant cash advance balances down, defend lawsuits and file bankruptcy. The first place to start is the Alabama State Bar Lawyer Referral Service: the first 30-minute consultation costs no more than $50.
Top Business Debt Settlement Firms Serving Alabama in 2026
But using a settlement company instead of a lawyer to deal with merchant cash advances can leave you worse off than when you started. Debt settlement companies are not lawyers and cannot represent a business in court. If you are sued, the debt settlement company has no legal ability to intervene. A debt settlement firm charges a substantial upfront fee and is usually not eager to issue refunds if they drop the ball. Debt relief firms tend to be eager to sign clients on, not so willing to follow through once the money starts flowing.

Your Business Accounts Will Freeze
If your merchant cash advance lender has an assignment of your bank account or receivables, chances are when the funders stop getting their percentage, your business accounts will freeze. Then the situation gets much worse. The funders will treat the missing percentage as a defaulted payment, and the contracts can add fees of: insufficient funds, about $35 per instance; stop payment penalty, $500-$5,000; and default fees, $2,500-$5,000.
A UCC-1 lien can be more powerful than a judgment. A judgment lets a funder freeze your bank account. A UCC lien freezes incoming cash before it hits the bank. Funders also send a copy of their lien to your customers and credit card processors and direct them to pay the lienholder instead of you. How does the lender know who pays you? It could just copy your customer list, trade references or bank statement you provided when you applied. If you gave it direct access to your bank account, it might look there, too. The slow-down of receivables can be a death blow for a small business.
Some merchant cash advance contracts can contain a confession of judgment clause. Sign this, and you are not even entitled to defend a lawsuit. The contract is so one-sided that New York state outlawed confession of judgment provisions for out-of-state business owners in 2019. Funders were getting around the law by filing confessions of judgment in states like Illinois, Utah and Texas. Most of the time, however, the funder simply files suit.
In Alabama, creditors usually have six years to sue you on a loan or contract. If the creditor sues and wins a judgment in one state, it can often send the judgment to any other state where you own property to seek payment. A judgment in Alabama becomes a lien on your property if the creditor records the judgment with your county probate court. The lien is good for 10 years. Once they have a judgment, they can garnish up to 25% of your weekly disposable pay.
Disguised Loans
A true merchant cash advance is not a loan, though they act very much like one. The funder is actually buying a percentage of your company’s future receivables. The less business you do, the less the funder can collect. Some sellers of a true merchant cash advance can gross a profit of up to 200% or more on the transactions. A loan with that kind of interest would be highly usurious. But many funders, alas, do not know the difference between a cash advance and a loan, and they have poorly drafted contracts. A lawyer can often spot which merchant cash advance contracts contain disguised loans and sue to void the contracts.
Brokers who sell merchant cash advances do not lend money. They are only paid on commission from the funded money. They do not care if you sink or swim. But they lie all the time. Here is a common one: “This advance is only temporary. We’ll try to get you a traditional loan next month.” The loan never comes. If you used brokers who stacked advances on top of each other for their commission and lied to you, a lawyer can file third-party complaints against the brokers.
Merchant cash advances are usually personally guaranteed. Even if a personal bankruptcy wiped out your obligation, the business would still owe on the contracts. On the other hand, a business bankruptcy can wipe out the debt, but will not end your personal obligation. A homestead exemption in Alabama can protect up to $18,800 worth of equity. But in June, 2026, the homestead exemption rose to $56,400 for those age 62 or older or disabled.
You might be able to keep your business running through a Subchapter V of Chapter 11 of the bankruptcy code. It is only available if the total amount owed is $3,424,000 or less. The U.S. Trustee Program appoints a trustee who works with you and your creditors to develop an agreed plan of repayment. Your plan should be ready within 90 days.
Debt settlement is great for some, but terrible for others. A lawyer can review your financial situation and help you come up with solutions tailored to your needs and explain the pros and cons of each. If your creditor forgives or settles $600 or more of a debt, it may have to send you and the IRS a Form 1099-C.
Once your 30-minute consultation is done, if you continue to work with the lawyer, the two of you negotiate the fee. But be sure to get the fee agreement in writing before any more work starts. If the lawyer takes a contingent fee, the written fee agreement must state the percentage being charged and how the fee is calculated.
