Top 3 Business Debt Settlement Firms for Columbus (2026 Rankings)

It may seem like a good idea to use a debt settlement company to get relief from your business debt, but using a debt settlement company is not always the best solution for you. Debt settlement companies cannot offer legal advice, and they cannot represent your business in court if necessary. The right business debt lawyer can negotiate the balance down to a lower payoff, defend lawsuits to buy time, sue to void the contract, or file bankruptcy.

UCC Lien Method

A funder may file a UCC lien once you default. This freezes your receivables, before the money ever reaches your bank account. Alternatively, once they have judgment, the creditor can freeze your bank account. However, the UCC lien method is quicker and more effective.

Card processors (e.g. Square, PayPal, Stripe) and your customers are usually identified in bank statements and customer lists. Thus, the lender or its attorney can probably discover who pays you and send them a copy of the UCC lien, often within a day or two of it being filed. That letter will tell your customers they must pay the lender instead of you. This is embarrassing and may cost you business. This can be incredibly disruptive to your cash flow.

Funders often include a confession of judgment (COJ) in the agreement, where you sign away your defense. New York banned COJs against out-of-state owners in 2019. But in reaction, funders have started filing COJs in Texas, Illinois, Utah, and elsewhere. Most still file regular lawsuits, though. Once they have judgment from another state, the funder can domesticate that judgment in Ohio to reach assets here. This tactic is becoming more prevalent as the number of defaults increases. Under Ohio law, a creditor generally has six years to sue on a written contract. An attorney defending the suit here can buy you time to raise settlement funds, and file counterclaims.

Debt settlement companies, for their part, often discuss savings, halving payments, and one escrow payment. However, they hide the large upfront fees they charge for these services. These fees may be non-refundable. Meanwhile, your accounts and receivables can get frozen with little or no progress in your case. Stopping payments may also leave you vulnerable to late fees, penalties, and damage to your credit score. Meanwhile, funder contracts often have stop payment fees (from $500 to $5,000) and default fees (from $2,500 to $5,000).

Merchant Cash Advance (MCA) Is Not a Loan

A true merchant cash advance (MCA) is not a loan. The funder in fact purchases your future receivables. As a result, it gets paid back only as money comes in through the merchant account. If that doesn’t happen, then generally no payments are due to the MCA. That makes it very different from a loan, which must be repaid in full, no matter what. MCA profit between 100% and 200% would be clearly usurious if the transaction were a loan, since most states have usury rates that fall far below those figures. However, many contracts are badly drafted, and in the hands of a good lawyer this creates a way to argue that the contract is void from the get-go.

The brokers who arrange these advances only earn a commission, and do not care whether you repay the MCA. Frequently they stack several advances at once. One of the most common lies is that an MCA is a short-term measure and a “regular” loan will soon follow, which is usually untrue. Some lawyers have in fact filed third-party complaints against brokers in an effort to make them pay for the harm to their clients.

People tend to think of settlements in percentage terms. So a forty-percent settlement means forty percent of the outstanding balance is paid back and sixty percent is forgiven. Most MCA agreements carry a personal guarantee, and so any settlement should be clear that it resolves the guarantee as well.

Bankruptcy is the last resort. Although a personal bankruptcy discharges your guarantee, the business itself remains liable. Conversely, a business bankruptcy leaves your personal liability on the guarantee intact. For debts of $3,424,000 or less, there may be a Chapter 11 procedure known as Subchapter V, which may be simpler and more efficient.

How the Fee Is Figured

Ohio caps fees for debt-adjusters, but this does not cover lawyers. If you pay a lawyer on contingency, which means the fee depends on what they get for you, then get the contingency in writing. It should be signed by you and the lawyer and show exactly how the fee is figured. If the contract says the fee is “nonrefundable,” the law requires you to also be given notice in writing that you may in fact get back all or part of it if the lawyer does not finish the job.

If a business debt is forgiven, that is generally considered taxable income. The creditor may send you a 1099-C form. But there are exclusions from this if the debt is discharged in bankruptcy or you are insolvent at the time. The exclusions are reported on Form 982.

So before you hire anyone in Columbus, first ask these questions. Are they able to defend a lawsuit, deal with UCC liens, review the contract and file bankruptcy if needed? Did you read the fee agreement, and how do they get paid? It is important to act before your receivables and bank accounts are frozen.
