Bottom line: You may be looking for a ranked list of the best MCA defense lawyers in Fresno, but there isn’t one. The right defense lawyer is one who handles MCA cases regularly in California, can take legal steps in time before the deadline, and is licensed by the California State Bar. Before hiring any lawyer, check them out on the State Bar’s Attorney Search website, and if you don’t know where to start, consider contacting the Fresno County Bar’s referral service. The initial consultation will cost $50 for up to 30 minutes. The lawyer referral fee does not cover the cost of any follow-up services, such as appearing in court on your behalf, that may be needed after the initial consultation.
Top MCA Defense Firms for Fresno Businesses - 2026
People often ask a lawyer who already handles other matters about their MCA case. But they don’t realize it is not the same kind of law. A general business lawyer may never have handled an MCA case or may never have done so in California, which has specific rules. The law is also subject to frequent changes. Without the right experience in this kind of case, the lawyer could do more harm than good.
Important: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company that works with a nationwide network of licensed attorneys - and that distinction matters. Their attorneys handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution for Fresno business owners. Their network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of whether your business operates on Blackstone Avenue or in the Fresno industrial corridor - and the evolving appellate case law that is reclassifying MCAs as loans subject to interest rate caps.
Where Delancey Street separates from every other firm on this list is MCA-specific legal firepower. Their attorneys don’t just negotiate - they challenge. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the California Secretary of State, and use both California’s SB 1235 disclosure violations and the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent in funder negotiations. For Fresno businesses - from agricultural operations in the Central Valley to restaurants in the Tower District - Delancey Street delivers attorney-coordinated defense with no upfront fees.
Best for: Fresno business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens who need immediate attorney-coordinated defense

California Law
Since January 1, 2023, California no longer allows lenders to use confessions of judgment: A confession of judgment cannot be entered or enforced in any California superior court. With older cases, MCA judgments arising before that date may still be enforced. Many MCA agreements designate New York law and New York courts or arbitration, so a Fresno business can be sued in New York. New York changed the law in 2019 and no longer allows confession of judgment against out-of-state defendants.
The California Department of Financial Protection and Innovation (DFPI) is the state regulator that handles merchant cash advance businesses, and since December 9, 2022, California law requires that MCA providers disclose their costs clearly. Since October 1, 2023, the DFPI can investigate suspected unfair, deceptive or abusive practices. This is mostly a matter for regulation, and if you think a contract is unfair, deceptive or abusive, you can report it to DFPI. The DFPI is not saying the rules get you off the hook for repayment.
How Fast It Can Turn into Legal Trouble
When you are having trouble with an MCA agreement, it is easy to underestimate how fast it can turn into legal trouble. The daily payment is missed or late, then the repeated debit attempts start to happen. That can kick off overdraft fees, calls from the funder, demand letters, and within days or weeks you can find yourself facing a lawsuit or arbitration. After a judgment, your bank account can be frozen or levied.
If you are sued in California, you generally have 30 days from service to respond, and failure to do so can lead to a default judgment. This is why you should seek help as early as possible if you are served with legal papers.
You may think that if you ignore the papers you’ve received about a lawsuit, the lawsuit will “go away.” It doesn’t. It is much harder to get a judgment reversed than to defend the lawsuit.
In defending the lawsuit, the right kind of lawyer asks whether the funding arrangement is really a loan. Whether your advance is a loan depends on the language and context of the agreement. For example, if the provider has recourse, meaning it can come after you for repayment regardless of how your business performs, that may point to a loan. A true merchant cash advance, however, is more like a contingent payment from sales. But just because the provider claims it’s not a loan doesn’t make it not a loan. The issue of what the cash advance is--whether it’s a loan or something else-- is at the center of litigation over how much you must pay back.
You may have some specific defenses in your case, such as improper service of legal papers, or if the lender ignored your account reconciliation and continued to take the same amount each day. The funder could also have known the business already had many advances, which is called stacking. In practice, many cases end in negotiated settlements, in which the business pays less than the full amount and stops fighting the claim. In other cases, a bankruptcy filing can stop the collection process.
Many MCA agreements include a personal guaranty that puts the owner at risk of collection from the owner’s own assets. A UCC lien filed on business assets can block other business financing. Many MCA contracts require arbitration, and an award can be turned into a court judgment. The law changed on July 1, 2025, and debt collection law (the Rosenthal Act) may cover some commercial debts owed by individuals such as a personal guarantor to merchant cash advances. The law can apply to commercial debts of $500,000 or less. It’s important to know your situation.
Hire a Lawyer with Relevant Experience
Has the lawyer ever handled an MCA case in California? If so, how many and when? Does the lawyer handle cases in the local superior court or have lawyers qualified to practice law in this court? Does the lawyer know which laws affect merchant cash advances in California? Is the lawyer licensed and in good standing by the California State Bar and not facing any pending disciplinary action? Then ask: Do you charge a flat fee or bill by the hour? How soon after you are retained will you start work on my case? What are the major deadlines for my case?
In California, attorneys are generally required to put the fee terms in writing and give the client a signed copy if the total fees are likely to exceed $1,000, but this rule does not apply if the client is a corporation. Still, you should get the fee terms in writing anyway before signing a retainer.
Before a first consultation, you should gather all the written paperwork related to the merchant cash advance:
Your original funding agreement and addenda,
the ACH authorization signed at the start, and
all the emails or letters between you and the lender or the broker.
Also, gather the last three months of bank statements and keep a record of voicemails and text messages. Don’t sign anything new before the lawyer has a chance to review your case.
Don’t close the bank account to try to dodge further automatic withdrawals. That may be seen as a breach and that breach may trigger the personal guaranty. Also, don’t lie to your bank, and don’t try to stop the authorized ACH debits by falsely claiming they are unauthorized. Also, don’t try to dodge collection by moving assets out of reach or setting up a new company.
If you are fighting an MCA contract in Fresno, how the case comes out depends on many things.
