2026 Best MCA Defense Lawyers in Jacksonville, FL

Bottom line: There is no trustworthy list of the best merchant cash advance defense lawyers in Jacksonville. The best lawyer for you is one who is a Florida-licensed business litigator who handles MCA disputes regularly. The Jacksonville Bar Association referral service can set up a consultation for you. The deadlines in merchant cash advance disputes are short, so you will need to find the right attorney fast.

Top MCA Defense Firms for Jacksonville Businesses - 2026

If you fail to file an answer within 20 days of service of a lawsuit, you are at risk of having a default entered against you. It can be possible to set aside a default, but the process is technical. If you are a company or LLC, you must hire an attorney to respond to a lawsuit in federal court in the Middle District of Florida. There are other clocks. If you get served with a notice of a New York judgment recorded in Florida, you have 30 days to challenge it. When your bank account is garnished, you have 20 days after notice to move to dissolve.

The Jacksonville Bar Association Lawyer Referral Service, (904) 399-5780, sets up a consultation with a member lawyer for a $50 administrative fee. If you are outside a local referral area, the Florida Bar statewide service can help.

Delancey Street

Attorney-Coordinated MCA Defense & Settlement - $100M+ Settled Nationwide

Let’s be clear: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company - and they work with a nationwide network of licensed attorneys who handle the actual fighting. COJ challenges, usury defenses, UCC lien disputes, funder negotiations, settlement execution - all of it, on behalf of Jacksonville business owners. Their attorney network is built around New York’s dual usury framework - which controls the vast majority of MCA contracts, whether your business is in Downtown Jacksonville or on the Northside.

Here’s the difference: Delancey Street’s attorneys don’t just negotiate - they go to war. They file motions to vacate confessions of judgment. They raise criminal usury defenses when effective APRs blow past 25%. They dispute overbroad UCC-1 filings with the Florida Department of State. And they use the NY Attorney General’s $1 billion Yellowstone Capital settlement as a weapon in funder negotiations. Over $100M in commercial debt settled. No upfront fees. Results-based pricing.

Best for: Jacksonville business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens who need immediate attorney-coordinated defense
Total Settled: $100M+
Focus: MCA Defense & Settlement

CuraDebt

25+ Years in Business Debt & Tax Resolution - IAPDA Certified

Let’s be straight: CuraDebt is not a law firm and they don’t handle MCA defense. They’re a Florida-based debt resolution company with 25+ years of experience in business debt, consumer debt, and IRS/state tax resolution. If your Jacksonville business is dealing with both MCA debt and tax problems, CuraDebt can handle the tax side while a firm like Delancey Street fights the MCA battle. But they won’t challenge COJs, raise usury defenses, or file legal motions against funders. That’s not their lane.

Best for: Combined business debt and tax resolution - IRS/state negotiations, multi-layered financial situations (not MCA-specific defense)
Years in Business: 25+
Tax Resolution: Yes (IRS & State)
MCA Defense: No

Before you hire a lawyer, check their profile on the Florida Bar website. It tells you whether they are eligible to practice law here, and whether they have been sanctioned in the past ten years. Look for board certification in Business Litigation by the Florida Bar. That shows they have at least five years practice and real business-litigation experience, and have passed a tough peer review and written exam. At the first meeting, ask how much of the attorney’s practice is focused on merchant cash advance cases, and whether they use a written fee agreement.

A Loan or a Real Sale

Legal questions in merchant cash advance disputes depend on whether the contract is an actual sale of future receivables for a cash advance, or is in reality a loan. MCA firms are careful to structure their contract as a real sale. If it is not a loan, then the firm isn’t a lender, and usury laws do not apply. If a court calls a merchant cash advance agreement a loan, knowingly charging over 25 percent per annum is criminal usury in Florida, and such a loan is unenforceable in Florida courts.

A court deciding if a contract is a loan or a real sale will consider who bears the risk if receivables fall; whether the contract or account reconciliation actually works; if the term for performance is open-ended; and whether the financier can collect from an owner’s personal guarantee anyway. An express statement that a financial transaction is “not a loan” is not controlling. In 2025 a bankruptcy court in Orlando held that two cash advances made in Florida were really loans, despite the disclaimers in the contract.

Most merchant cash advance agreements you sign choose New York law. Florida courts can refuse to enforce a choice of law clause in a cash advance contract, if it offends Florida’s strong public policy against usury, but the issue depends on the facts and the court’s analysis.

Beware of any attorney who promises that the Florida merchant cash advance disclosure law will end the agreement, or stop collection, or forgive the debt, on its own. Only the Attorney General can enforce it, a private lawsuit cannot. And even if a contract runs afoul of the law, the court will not void the agreement. The Florida disclosure law on merchant cash advance agreements applies to contracts signed and closed after January 1, 2024, that are worth $500,000 or less. Still, you can use a violation as leverage in negotiating a settlement.

The Funder Has Won Judgment

In Florida confessions of judgment signed in advance are void, and New York barred them against out-of-state debtors in 2019. If a New York court issued a judgment based on a confession of judgment, it can still be recorded in Florida. After a New York judgment has been recorded here, the court clerk mails notice to the judgment debtor. For the next 30 days nothing can be enforced. Within the 30-day notice period, your lawyer can sue to contest the original court’s jurisdiction or the validity of the judgment. Florida’s recordation law specifically authorizes a lis pendens in that case, and the court must stay enforcement until the lawsuit is resolved. But the original case’s merits are not reheard.

Before judgment a merchant cash advance funder will typically collect only through the daily debits that you authorized. A frozen account usually means the funder has won judgment and has served a writ of garnishment on your bank. Your creditor is required to serve you notice from the garnishment. Your 20 days run from that. If the creditor never gives you this notice, the clock never starts. Florida’s exemption law does not protect a business itself.

If you signed a personal guaranty, the lender is usually within its rights to go after you. Florida protects a homestead and some property held by married couples. Generally, retirement accounts may be covered, but these are personal assets, not the company’s.

The best option depends on your own business goals and where you stand in the dispute. Many disputes ultimately settle in a way that reduces or resets repayment, in return for dismissal. A lump-sum buy-out, or a discounted payoff, can also be negotiated. In Subchapter V bankruptcy an automatic stay immediately halts debits, lawsuits and garnishments. Florida bankruptcy courts have been receptive to restructuring merchant cash advance claims. Debtors filing as a small business have qualified for Subchapter V if they owe $3,424,000 or less, as of early October 2026. Congress has voted to restore the cap to $7.5 million but only for cases filed after the change becomes law, so time matters.

Before the first meeting, put together the best case you can for the lawyer. Round up the contract, emails, texts and any recorded calls with the broker. You should have your reconciliation request and their reply. Meanwhile, never ignore a New York summons. Don’t tell your bank authorized debits were not authorized. Don’t move money into a new company or family member’s account. A bank account frozen because of a merchant cash advance is an emergency. You should move faster than you feel like.
