Bottom line: There isn’t one best attorney for merchant cash advance lawsuits in Las Vegas, or anywhere else, either. What you’re looking for is somebody who handles them on a regular basis and is willing to read through everything you have before the next hearing deadline. The Nevada State Bar’s referral service is a good place to start, and at $45 for the first consult, it’s a cheap way to get started. Sometimes you might have to cast your net more widely than just looking in Las Vegas itself -- especially because so many MCA cases against businesses are heard in New York -- but it’s worth doing the legwork to get the right information from someone who’s been there before.
Top MCA Defense Firms for Las Vegas Businesses - 2026
Because MCA arrangements are sold as the purchase of future receivables, not a loan, that changes things a lot. On top of that, though, the ACH debits happen daily instead of monthly, and often all of this gets wrapped into contracts that say the usury laws don’t apply at all. And just to add even more string for the bow, most contracts you’ll see will also have a personal guaranty, a UCC-1 filing, and even a confession of judgment in some agreements. Many lawyers who specialize in another area of law will be glad to represent you in a cash advance lawsuit but they’re at a severe disadvantage, especially if they’re not familiar with commercial law. And because an MCA is different from a bank loan or other business debt, look for somebody who knows how to litigate the terms and how to argue a point of cash advance law.
Important: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company that works with a nationwide network of licensed attorneys - and that distinction matters. Their attorneys handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution for Las Vegas business owners. Their network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of whether your business operates on the Strip, in Henderson, or out in Summerlin - and the evolving appellate case law that is reclassifying MCAs as loans subject to interest rate caps.
Where Delancey Street separates from every other firm on this list is MCA-specific legal firepower. Their attorneys don’t just negotiate - they challenge. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the Nevada Secretary of State, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent in funder negotiations. For Las Vegas businesses dealing with stacked MCAs - common among hospitality companies near the Strip, restaurants along Fremont Street, and convention service providers across Clark County - Delancey Street coordinates multi-funder settlements that address all advances simultaneously.
Best for: Las Vegas business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens who need immediate attorney-coordinated defense

Largest U.S. Debt Settlement Firm - A+ BBB Rating - 550,000+ Clients
Important: National Debt Relief is not a law firm and is not an MCA defense specialist. They’re the largest debt settlement company in the United States - over $1 billion in debt settled, 550,000+ clients served. They handle general unsecured business debts - credit cards, vendor accounts, lines of credit - but they do not challenge confessions of judgment, file usury defenses, or dispute UCC liens. If your Las Vegas business debt is primarily traditional unsecured debt and not MCA-specific, they’re a strong option. New York Law
You might be wondering why New York came up earlier; it’s because many merchant cash advance agreements have you choose New York law and venue for your case. That can even happen if you are a company based in Nevada. That’s a serious problem because it means that New York procedure matters to a Vegas business who’s looking for merchant cash advance help. So if your MCA agreement does this, you might also need to look for a lawyer who’s both licensed in Nevada and in New York to be able to protect your rights. And if your contract requires a New York court, you must consider all New York State laws and procedures, including the recent elimination of out-of-state confessions of judgment in 2019.
There are more differences in states’ law than you might expect here. In Nevada, for example, you can agree to any interest rate, so usury laws aren’t a problem. New York’s way of ruling on whether an advance is really a loan is that the court looks to see if there is a reconciliation, a fixed end date, and if there’s recourse if the business fails. Not every MCA is really a loan, even if it looks like one on the surface.
When You Get Sued for a Cash Advance
A missed payment can quickly become a default notice, and in some cases a funder’s lawyer will then sue or arbitrate within just a few weeks of your missed payment. The most common and costly mistake you can make is to ignore the papers that come, and it lets a funder get a default judgement that can be enforced with a bank freeze and levy. Having an MCA didn’t mean you broke the law, and you might have valid defenses to the claims.
You need a good MCA lawyer to check your confession of judgement for filing defects and math errors, protect your accounts from improper ACH debits without creating new liabilities, challenge improper UCC liens, and limit your personal liability as much as possible. It’s tempting to stop ACH payments all at once or close your business bank account when you want to fight an MCA suit, but that’s not a good idea. Doing that on your own can be a breach of contract, and might trigger the personal guaranty. And even if you do fight back, lots of disputes end up settling in the middle with a reduced payoff amount and a released lien anyway. And it’s also worth saying that in some cases a business bankruptcy can be a better option than even settling.
An online form letter or a pseudo-legal argument aren’t going to work; and it’s pretty risky to tell the bank that authorized debits are actually unauthorized, so you should avoid that one. And even worse, some people will try and move their assets to a new company. If that happens, it can end up being considered a fraudulent transfer.
Find a Merchant Cash Advance Attorney
You can reach the Nevada State Bar’s referral service mentioned earlier at 702-382-0504. It’s free to look, the first consult costs $45 non-refundable, and you can talk for up to 30 minutes, with no obligation to keep the lawyer if you don’t want to. All the listed lawyers are pre-screened for experience and have malpractice insurance too.
At the first meeting, make sure you ask:
how many MCA cases have you done that are just like mine;
If a bank restraining notice comes, how fast can they file to object and try to remove it? Merchant cash advance cases are a narrow and specialized field, so don’t be shy about asking.
Fees can be negotiated with each lawyer. Some fee plans are done on a flat rate depending on the specific work, like a document review or a motion to vacate a judgement. Others are done on an hourly basis with a retainer you might need to top up later. It’s important to get this in writing and agreed upon before signing any contract, as litigation can be expensive and unexpected costs can arise.
Before you call anyone, gather up all the agreements, bank statements from the last 3 months, all letters, texts, voicemails, everything -- and check for confessions of judgement or arbitration clauses in there. Ask for time to read everything, and don’t sign anything new with the funder.
