How divorce works in California.

California is a pure no-fault state. You do not have to prove your spouse did anything wrong, and it does not matter if they refuse to agree - "irreconcilable differences" is the only ground you need, and one spouse can end the marriage alone. What the law does require is that you meet the residency rules, respect the waiting period, and get the paperwork right - and that is where having experienced counsel on your side makes the difference.

FROM THE NOTES

Nobody has to prove fault, and nobody has to agree - one spouse can end a California marriage alone.

Residency. To file for divorce in Los Angeles, you or your spouse must have lived in California for the last 6 months, and in Los Angeles County for the last 3 months, immediately before filing (Family Code §2320). If you don't qualify yet, you can file for legal separation now and amend to divorce once the clock runs - a move that also gets your case started sooner. This is exactly the kind of sequencing an experienced divorce lawyer sets up on day one.

The 6-month clock. Your marital status cannot end until at least 6 months and 1 day after your spouse is served or appears in the case (Family Code §2339). No judge can waive it. That does not mean your divorce takes six months of work - an agreed case can be fully negotiated, signed, and submitted long before the date arrives. It means the earlier the case starts, the earlier the clock does.

Divorce, legal separation, or annulment. Legal separation divides property and sets custody and support without ending the marriage - used for religious reasons, health insurance, or the residency play above. Annulment declares the marriage void, and is far narrower than people hope. For most people in Los Angeles, dissolution - divorce - is the vehicle. We'll tell you honestly which one fits your situation.

WHO GETS WHAT · COMMUNITY PROPERTY

Who gets what - California's community property rule.

Everything either of you acquired during the marriage - salaries, the house, the 401(k) contributions, the business you built - is presumed community property, and the community gets divided equally. What you brought into the marriage, inherited, or received as a gift stays yours as separate property. The rule sounds simple, but in practice the entire fight is over which side of the line each asset lands on - and that is the fight where experienced counsel earns their keep.

Family Code §760 / All property acquired by a married person during the marriage, wherever it sits, is community property. It is not a negotiating position - it is the presumption you start from.

The date of separation moves the line. Community property stops accruing on the date of separation - a complete and final break in the marriage, shown by what you said and what you did after (Family Code §70). In Los Angeles, where a bonus season, a vesting date, or a film residual can land on either side of that date, separation-date disputes are worth real money. We document that date early, before the other side rewrites the story.

Mixed assets have to be traced. A down payment from an inheritance on a house you both paid the mortgage on, a separate business that grew during the marriage, a pension earned partly before the wedding and partly after - these are tracing and apportionment problems with decades of case law behind them, and the spouse whose lawyer knows that math keeps more.

California courts decide legal and physical custody on the child's best interest - health, safety, welfare, and each parent's ability to share. In LA County, contested custody goes through mandatory free mediation with Family Court Services before a judge hears it. Parents who arrive prepared - with a parenting plan, a schedule, and a documented history - walk out with more. We build that record from the first week.

A formula - fed by the numbers you prove

Child support runs on the statewide guideline formula (Family Code §4055): both parents' net disposable incomes and the timeshare, computed by court-certified calculators. The dispute is rarely about the formula itself - it is about the numbers that go into it, because self-employment income, entertainment-industry earnings, RSUs, bonuses, and "creative" expense claims all move the result. We make sure the income that goes into the calculation is the real income.

Fourteen factors the judge must weigh

Long-term spousal support is not a formula. Judges weigh the Family Code §4320 factors - the marital standard of living, earning capacity, contributions to the other's career, age and health, the length of the marriage, documented domestic violence, and the expectation that a supported spouse becomes self-supporting within a reasonable period (generally half the length of a shorter marriage). Every one of those factors is an argument, and we make them all.

The lower earner is not defenseless

Family Code §2030 lets the court order one spouse to pay the other's attorney fees so both sides can actually litigate. If your spouse controls the money and is counting on you running out of it, we bring that motion rather than letting you accept a bad deal because the funds ran dry. And if you're the earner, we make sure a fee request doesn't become a blank check.

THE PAPERWORK · FL-100 TO JUDGMENT

Forms, fees, and the new joint petition.

A California divorce starts with the FL-100 Petition and the FL-110 Summons; the responding spouse has 30 days to file the FL-120 Response or risk the case proceeding by default. The first-paper filing fee in LA County is $435 per side. Then come the documents that actually decide cases: the preliminary declarations of disclosure, where every asset, debt, and income stream gets sworn to under penalty of perjury.

Agreeing couples can now file one joint petition - form FL-700 - and pay one $435 fee instead of two.

The joint petition for dissolution took effect January 1, 2026, and most firms haven't caught up to it. If you and your spouse agree on the terms, filing jointly removes the served-party dynamic entirely - nobody is the respondent, nobody gets papers handed to them at work - and cuts the filing cost in half. We'll tell you in the first call whether your case qualifies, and whether it's actually the right move.

THE MONEY

Anyone who quotes you a number for a contested divorce before hearing your case is guessing. What we can tell you honestly: the court charges $435 to file, Los Angeles divorce attorneys bill several hundred dollars an hour, a genuinely uncontested case with an agreement runs a small fraction of a contested one, and a contested case costs whatever the two of you decide to fight about. Does it matter who files first?

Not legally - California is no-fault and the petitioner gets no preference. Practically, filing first sets the tempo: it fixes the earliest possible end date, puts the automatic restraining orders in force before assets move, and lets you choose the moment rather than react to it. What are the automatic restraining orders (ATROs)?

Standing orders printed on the summons in every California divorce. Once the case starts, neither spouse may take the children out of state without consent, transfer or conceal property, change insurance beneficiaries, or make extraordinary expenditures without notice. No. California requires only one spouse to declare irreconcilable differences. If your spouse refuses to respond, the case proceeds by default; if they respond and fight everything, it proceeds as a contested case. They can make it slower and more expensive - they cannot make you stay married.

Not for divorce yet - Family Code 2320 requires 6 months in the state and 3 months in the county. But you can file for legal separation immediately and amend the petition to dissolution once you qualify, which also gets the case moving now. This is a routine sequencing strategy, and we set it up regularly.
