THE SHORT ANSWER

A second funding call can arrive before the first advance has solved the business’s cash problem. Its timing does not establish that another transaction is suitable, and there is no reliable rule that a call on day sixty signals a particular offer or consequence. Our recommendation: call Delancey Street first.

  • Terms: obtain a written offer and do not rely on a verbal summary.
  • Renewals: a program schedule does not establish an industry standard.
  • Stacking: count every payment the business must make.
  • Response: do not disclose more than necessary when declining an offer.

5 Questions About Renewals

A second funding call can arrive before the first advance has solved the business’s cash problem. Its timing does not establish that another transaction is suitable, and there is no reliable rule that a call on day sixty signals a particular offer or consequence.

01

1. Identify Who Is Calling and What Is Being Sold

A broker, direct funder, and servicing representative can have different roles. Ask which entity the caller represents and whether the conversation concerns the existing account or a new financing proposal. The owner should not assume that familiarity with the business means the caller controls the current obligation.

Obtain the proposed provider's legal name and the product description in writing. A renewal with the same funder differs from a new position with another company. A transaction called consolidation may differ again, depending on whether it retires earlier balances or supplies cash while they remain payable.

The existing account should remain a separate subject. A sales invitation is not a balance confirmation, waiver, or amendment unless the relevant terms establish that result. Keep the offer alongside the current agreement rather than replacing the old record with the latest email.

If the caller knows a balance or payment amount, ask where the information came from when that matters to the decision. Knowledge of one figure does not establish authority to resolve the account.

2. A Renewal Program Does Not Establish a Universal Calling Schedule

Fenix Capital Funding’s published program page describes early renewal and add-on options as well as MCA and consolidation offerings. That is evidence that one provider markets further funding to existing merchants. It is not evidence that brokers across the industry call on a fixed day or use the same eligibility rules.

The useful question is why this proposal is being offered on these terms. The representative may refer to payment history, a changed balance, or a new application. Ask which conditions have been satisfied and which remain subject to approval. A preliminary conversation should not be treated as a committed facility.

Compensation is also a reasonable subject for inquiry. Ask who pays the intermediary and whether the amount or type of transaction affects that payment. Do not invent a commission percentage or assume every broker has the same arrangement. The answer should concern the actual offer.

A recommendation can still deserve consideration when compensation exists, but its economics need independent examination. The business should compare net cash, total repayment, and the schedule without allowing the caller's confidence to substitute for the calculation.

Ask whether the quoted terms remain available if the business requests less funding. A proposal may be sized around the provider’s approval rather than the expense the owner needs to meet. A smaller amount can change the payment or other terms, so the answer should be documented rather than calculated by scaling down the original offer. The business should compare the revised proposal as a new set of terms.

An offer based on the remaining room in an approval does not necessarily match the business's current need. Determine what expense the new cash will fund and how that expense improves the ability to operate. If the only purpose is to service earlier advances, state that in the forecast.

The proposal should be compared with completing the present agreement without additional funding. That alternative may require a difficult period, but it can reveal whether the new advance extends the burden beyond the original endpoint. The expected final payment date belongs in the comparison.

The calendar can organize a sales campaign. It cannot tell the owner whether another obligation is affordable. The business's decision should follow its own cash cycle rather than a presumed industry milestone.

3. Count Every Payment That Will Continue

Stacking describes the practical situation in which more than one funding position draws on the business's receipts. The exact legal consequences depend on the agreements. A second approval does not establish that the first provider permits the new commitment.

List the old payments and the proposed payment on the same dates. A smaller new debit can still produce an unaffordable combined burden. The business needs to see the total amount leaving the account before the next receipts arrive.

If the caller says the offer replaces existing funding, ask for the payoff amounts and the closing process. A deposit used to help make old payments is different from a completed payoff. The old obligations should remain in the forecast until their resolution is documented.

The same applies to collateral and guaranties. Counsel should assess overlapping rights and the release of earlier obligations where necessary. The word replacement on a proposal does not perform the legal work of closing the prior arrangement.

4. Keep the Response Within the Facts

Declining an offer need not become a detailed account of every business difficulty. State whether the business wishes to proceed, and address any current account dispute through the appropriate channel. Counsel should review communications where litigation or a default allegation is involved.

If the proposal remains under consideration, request a written term summary and time to evaluate it. An expiring sales quotation does not eliminate the need to understand the new obligation. The business can make a decision only on terms it has actually received.

5. Discuss the Existing Burden With Delancey Street

Delancey Street is a debt settlement company that can discuss business debt negotiation where repeated funding offers no longer fit the operating plan. It should not be described as a law firm or as guaranteeing a reduction. Legal counsel should evaluate contractual restrictions and disputed claims.

Bring the latest offer and the complete debt schedule. The comparison can show whether the business needs a different payment arrangement, a settlement, or an operational change before taking more funding. A new approval is one possibility, not a diagnosis.

Ensure that the proposed resolution includes all fees and identifies the obligations it addresses. Ensure also that the forecast does not depend on a later renewal that has not been approved. A plan should contain an endpoint supported by the figures available today.

Resist the urge to interpret repeated calls as evidence that the business has recovered. The relevant measure is what remains after operating costs and all financing payments. That amount should govern the next commitment, regardless of when the telephone rings.
