2026 Best MCA Defense Lawyers in Wisconsin
Top MCA Defense Firms for Wisconsin - 2026
So how do you judge who is the best? Here is one rule to follow. You can evaluate your MCA defense lawyer at the first meeting, from how they review the contract and which parts they check first.
Delancey Street
Here’s what you need to know: Delancey Street is not a law firm. They coordinate with a nationwide network of licensed attorneys who do the actual fighting - COJ challenges, usury defenses, UCC lien disputes, funder negotiations. This is what they do. Doesn’t matter if your business is in Milwaukee, Madison, Green Bay, or Kenosha - your MCA contract is built around New York’s dual usury framework, and that’s where the defense starts.
Their attorneys file motions to vacate COJs, raise criminal usury defenses, dispute UCC-1 filings with the Wisconsin Department of Financial Institutions, and use the NY AG’s $1 billion Yellowstone Capital settlement as precedent. Over $100M settled. No upfront fees. No gimmicks.
National Debt Relief
Not an MCA defense specialist - and they’ll tell you that straight up. They handle general unsecured business debt. No COJ challenges, no usury defenses. But if you’ve got traditional unsecured debt on top of your MCA problem, they’re a proven option in Wisconsin.

CuraDebt
Not an MCA defense specialist either. They handle business debt and IRS/state tax resolution. If your Wisconsin business has tax problems stacked on top of MCA debt, CuraDebt works best alongside a dedicated MCA defense firm.
The Contract Governs Your Rights and Obligations
In merchant cash advance cases, the contract governs your rights and obligations, so always start there. The funder probably chose New York law and New York court, because they want you to feel you can’t beat them at home. But a good lawyer will know how to hit them with New York rules in New York court.
If the MCA funder took a fixed daily ACH debit regardless of your sales, that is the strongest sign you were taking a loan, not selling a revenue stream, so always save your bank statements to prove payments never varied with volume.
Then there is the reconciliation clause, which lets you reduce payments when revenue drops. This is often useless, because the window to make your claim may be only 3 days, and even then the funder can say no for any reason they like. So keep a diary of your lost sales, so you can document each request that the funder ignored.
A true receivables purchase should have no end date. The deal ends when the merchant has sold all the revenue needed to fund the advance. A fixed term, such as a payoff deadline or an estimated 6 month schedule, looks like a loan.
It gets better. New York’s criminal usury cap is 25% APR, so if the deal is recharacterized as a loan and not a purchase of revenue, the entire contract can be voided. So if you got $100,000 and had to repay $135,000, that means your factor rate was 1.35. Over six months, the factor rate converts to a rough APR of 70 percent. This is the secret weapon you can bring to bear against the MCA funder. If you hit that funder with recharacterization and New York’s 25% APR cap on criminal usury, you may knock him flat on his back. Wisconsin’s own 12% interest cap does not cover loans to corporations or LLCs, or loans of $150,000 or more.
You’re best off hiring a lawyer with forensic accounting experience, and making them calculate the exact APR from the fees, the term and all the collateral costs. One quick rule of thumb is that a 1.40 rate over 4 months is about 120 percent APR, because you pay 40 percent in 4 months. It really hurts when you can show the judge and the funder that you are repaying the equivalent of a loan at triple digit interest.
The next thing to look for is a UCC filing. The funder may have taken a blanket lien on all your company assets, using a UCC financing statement as if they were taking a loan security interest. But if they were really buying receivables, they would not typically need that, so that is another big hole in their story, and it also lets you check to see if they have perfected the lien to make it ahead of other creditors.
Personal guarantees are scary, because the funder can pursue the owner’s personal assets. But a good lawyer will double check what the guarantee covers. In some cases, it applies only to the merchant’s truthfulness in the application or cooperation with the funder, not the full repayment balance. If the merchant cash advance lender starts to call the guarantor for the full balance, that is a sign it thinks the deal is a loan, and the individual guarantor may have greater civil usury defenses than the corporate debtor had.
The most dangerous clause is the confession of judgment. It lets the lender enter judgment against you, without filing any lawsuit, giving you notice, or hearing your defense. So search the MCA contract for ‘confess’ or ‘cognovit’. If the note has a confession of judgment clause, check the date you signed the note. If it was signed after June 18, 1972, that term was made void by Wisconsin law. In New York, confessions of judgment must be filed in the county where the debtor resides or has a place of business.
The contract may say you can be in default for taking another MCA, for any adverse change in your business, even for seeking legal counsel. None of those clauses have anything to do with your revenue, so you may have a defense. If the contract calls disputing the agreement or hiring a lawyer a default, that may be unconscionable and against public policy.
The last clauses to check are jury waiver and arbitration. A waiver means you can’t choose a jury trial, and have to face a judge. Both the jury trial waiver and the arbitration clause can be challenged as unconscionable. Arbitration may seem like a bad choice, but some arbitrators scrutinize unfairness more carefully than court judges.
Check That Your Lawyer Is in Good Standing
Before you hire a lawyer, use the Wisconsin Court System phone number 877-315-6941 to check that your lawyer is in good standing, and that they have never been disciplined or lost their license for any violations. Also check the public list of disciplined lawyers on the Wisconsin court site.
Always get a written fee agreement. The lawyer has to state the scope of the work and the basis for payment, except where the total charge is expected to be $1,000 or less. Lawyers have to put contingent fee agreements in writing, which must be signed by you, and must clearly state how the fee will be calculated.
After your lawyer reviews the contract, you will know how many of these red flags you have, which defenses can apply, what your settlement leverage looks like, and which court is best for the fight. Every red flag is both a legal defense and a bargaining chip to level the playing field.
If you spot any of these red flags, then act. Find a lawyer with MCA experience, answer within 20 days, document all the flaws you find in the contract, because the more you find, the less likely the funder will be to litigate and the more likely to settle for a fraction.
