2026 Best MCA Defense Lawyers in Tulsa, OK
Top MCA Defense Firms for Tulsa Businesses - 2026
Personal referrals aren’t easy to come by (even for lawyers), so your next best bet is to use the referral system of the bar association for Tulsa County (918-587-6014). There’s a $25 charge for the first 30 minutes. Another option: the Find a Lawyer directory is published by the Oklahoma Bar Association. But the OBA doesn’t endorse or certify the lawyers listed. Also, a lawyer can elect whether to show up in this directory.
Delancey Street
Here’s what you need to know: Delancey Street is not a law firm. They coordinate with a nationwide network of licensed attorneys who do the actual fighting - COJ challenges, usury defenses, UCC lien disputes, funder negotiations. This is what they do. Their attorneys use Oklahoma’s 6% usury cap, the state’s COJ restrictions, and New York’s dual usury framework. They raise criminal usury defenses, dispute overbroad UCC-1 filings with the Oklahoma County Clerk, and use the NY AG’s Yellowstone settlement as precedent. Over $100M settled. No upfront fees. No gimmicks.
National Debt Relief
Not an MCA defense specialist - let’s be clear about that. They handle general unsecured business debt only.

CuraDebt
Not an MCA defense specialist. If your Tulsa business faces both MCA debt and Oklahoma Tax Commission or IRS obligations, CuraDebt can address the tax side.
Respond to Any Court Summons
There are a number of reasons why it’s important to contact an MCA lawsuit lawyer as soon as possible. The biggest reason is to be sure you respond to any court summons that is sent to you, for ignoring them can lead to trouble you don’t want or need, like a default judgement. The time to answer is measured in days from the date when you are served, and it varies by state. New York State, where many MCA lawsuits are filed, generally gives you just 20 days to respond if served in person and 30 days otherwise. Once a finance company has a judgment, they can use bank restraints and levies to freeze and take money from your accounts. If you run a business and sign a personal guarantee, the funder will most likely sue you personally, too.
A personal guarantee puts your personal bank accounts and other assets on the line after there’s been a judgment against you. Whether the guarantee can be enforced, what it can reach, and how far it reaches, is defined in large measure by the wording of the guarantee and state law. A good reason to talk to a lawyer.
Before there’s a judgment, a funder’s pressure is probably most felt through continued ACH withdrawals and UCC notices sent to customers or payment processors. If there’s a restraint on your account, talk to a lawyer immediately about getting it released as part of a settlement or on an application to vacate the judgment.
Merchant Cash Advance
An MCA lawsuit is a breach-of-contract suit a lender files when a borrower stops or slows down the daily/weekly payments. A merchant cash advance is a lump-sum payment to a business in exchange for a portion of its future receivables. The funds are usually collected by automatic daily or weekly ACH withdrawals. Funders call this a purchase of future sales, not a loan, so they argue that the state’s usury limits don’t apply, so they can charge a lot for their money.
The mark of a really good MCA defense lawyer is one who asks whether the deal is really a loan. In court, the analysis looks past the label sellers put on the agreements they’re pushing and at the reality of repayment terms, among other things. Fixed term? Reconciliation? Is repayment effectively guaranteed regardless of business performance? If so, the courts may rule it is actually a loan subject to usury limits. It’s worth noting that many agreements let you request lower payments, also known as reconciliation, if your sales fall. If your requests were denied or ignored, it’s something your lawyer may want to know.
A competent MCA lawyer will also check whether you signed a Confession of Judgment. New York law since August 2019 forbids filing one against an out-of-state debtor. Oklahoma law requires a debtor to personally appear in court to confess judgment. COJs signed by New York businesses or filed in other states that allow them can still be good, but have a lawyer review any you signed to find out if it’s valid. Beyond that, as of August 2026, Oklahoma does not have special rules or licensing for the merchant cash advance industry. Lawyers also check that a lawsuit is brought in time. Oklahoma law requires a creditor suing on a written contract to do it within five years after the claim arises.
In 2024 the Federal Trade Commission won a judgment against a merchant cash advance operator named Jonathan Braun for $20.3 million. The New York Attorney General announced a settlement with Yellowstone Capital in January 2025. None of this wins your lawsuit, but it tells you that courts and regulators take abuse of small businesses through merchant cash advances seriously.
A Meeting to Introduce Yourself to the Lawyer
The value of a meeting to introduce yourself to the lawyer and get an idea of what he or she thinks can be surprising, but you’ll get more from it if you bring copies of your merchant cash advance agreement, the summons or court filings (if you received those) and any relevant correspondence between you and the MCA lender. Your bank statements and ACH withdrawal history are important. If you signed a Confession of Judgement, that too. List all of the merchant cash advances you have, including the totals, because many sued business owners stacked MCA’s. Did you ask for reconciliation of anything? Provide this, too. Don’t make financial moves that can be construed as hiding assets.
Ask upfront how the lawyer charges for helping you. In Oklahoma, contingent fee deals must be in writing, signed by you, and say what expenses you pay even if you lose the case.
You could wind up settling, possibly for a reduced lump sum or an extended payment schedule. If so, all the more reason to have a lawyer involved. Any agreement must be in writing, and say if the case is dismissed, the personal guarantee is released, the UCC lien is terminated, and if there’s been any judgment already issued, that’s vacated or otherwise satisfied.
Settlement can work if your business survives once the daily withdrawals stop; be honest with yourself. If it can’t go on at all, or if your debts far exceed what it can possibly pay, talk to a lawyer about bankruptcy. For cases filed since June 21, 2024, the small-business debt limit under Subchapter V is $3,424,000.
If you put your company up for sale after a suit is filed, it’s possible, but disclosing the lawsuit is crucial, and usually you also need a negotiated payoff. As for finding a lawyer, Legal Aid Services of Oklahoma can help eligible low-income folks and seniors, at 1-888-534-5243 or 918-584-3338.
Consider meeting with several lawyers to be sure you find someone whose experience and expertise is relevant and you’re comfortable with. Never ignore a court summons or request for contact from the other side.
