Colorado Springs MCA Defense
Top MCA Defense Firms for Colorado Springs Businesses - 2026
If you want to check to see if someone’s allowed to practice law in Colorado, use the state’s attorney search. Make sure the attorney you’re speaking with is still listed as active and in good standing. Registration numbers in the 600000 range belong to non-lawyer licensed legal paraprofessionals, not attorneys.
Respond to the Complaint
You must move quickly in Colorado. In a district court case, you have only 21 days from the date of service to respond to the complaint. Once a summons is served, find out which court has the case, the case number, who’s named and the deadline to respond. You may be named on the guarantee, so both the business and you may be in the suit. Be prepared to respond even if you’re talking about settling: that does nothing to extend the deadline or release frozen funds.
Colorado’s county courts hear money claims only up to $25,000, so bigger MCA suits go to district court. Look over the complaint to make sure the claimed amount is what you owe, and no payments are missing from their books. Another thing to check is if the way you received the summons counts as proper service in Colorado.
The Written Agreements and Payment History
A good MCA lawyer starts by reviewing the written agreements and payment history with you. Depending on the case, they might also explain your reconciliation rights, balances, or fees, advise on any outstanding guarantees, negotiate a written settlement, defend a lawsuit, or examine a judgment, bank restraint or UCC filing. But no attorney can promise a reduction in payment or dismissal of the whole case.
If you have three or four business funding companies, put them side by side and see what they’re pulling from the same receipts and how much is left for rent and payroll. Make a list: who advanced you, how much you took, what is claimed to be still owed, how often it debits, and the total it all takes out, whether you have any guarantees, any UCC filings, or defaults or deadlines.
Sometimes an MCA firm says, “take another advance and we’ll fix the others”. Make sure you can look back and see which older MCAs get paid off, which stay open, and the full cost and daily or weekly withdrawals once everything is clear. Reconciling, negotiating, or settling debt is not the same as taking a new advance.
You may have heard merchants cash advance agreements described as buying future receivables or an advance on the business’s sales. The label doesn’t settle anything. Whether it’s really a loan and if it’s subject to certain lending laws depends on governing law and on who carries the risk of loss and how things are handled if you’re not able to pay. A factor rate isn’t an APR.
When it comes to repayment, there are three questions. What does the agreement require? What has the funder actually pulled from your account so far? What did they do when the sales dropped? Keep the agreement, the full transaction history and every reconciliation email together in one folder.
If the lender or funder sends a default notice, it can lead to demands, a lawsuit or other collection depending on the agreement and the law. Start with the notice itself. Which clause of the agreement does it rely on? What do the company’s payment records actually show? Are there guarantees, UCC papers, notices sent to the bank, processor or customers? Before you stop payments, sign a new agreement or accept a settlement, think through what comes next.
The Colorado Revised Statutes forbid knowingly charging over 45% APR on a loan. That’s criminal usury, which is a Class 6 felony in Colorado. This assumes that the MCA is treated as a loan. Not all merchant cash advances fall outside Colorado’s usury law. It’s very important to know that a suspected violation in itself does nothing to freeze time or erase the balance.
Confessions of judgment let MCA funders get a judgment without first going through an ordinary lawsuit where the law allows it. But their presence in the agreement does not mean the MCA company is allowed to use it. In New York, for instance, they can only be filed in the county the debtor lived in at the time of signing or when it’s filed. Having it in the paperwork means it’s very important to get it and the docket reviewed now.
The FTC has gone after merchant cash funders who crossed the line. In June 2022 the Federal Trade Commission forced a lender called Richmond Capital Group (RCG Advances) to leave the industry and vacate judgments against customers. In February 2024 a court ordered its operator to pay $20.3 million for deceiving small businesses and illegally seizing property.
Fee Basis
Make sure you’ll know who’s handling your case and for what. Rule 1.5(b) from the Colorado Rules of Professional Conduct requires an attorney, when entering a new matter, to tell the client in writing the fee basis or rate and what’s involved, soon after or when they start. According to Clio, Colorado lawyers overall averaged $321 an hour as of 2025. And ask who the responsible lawyer is for the case and which businesses or business owners are covered.
You can ask for a review while you’re still up to date but the payments are becoming unaffordable. Be ready to bring along every piece of paper for every advance. If the lawyer’s office is elsewhere than your case is, you must also talk about the involvement of another lawyer called local counsel, and who will argue in the courtroom. And speaking with a lawyer does not freeze time, delay a court deadline, remove a restraint, or suspend automatic payments.
Don’t wait until a deadline has run.
