Best Companies After MCA Default
Top Companies to Help After MCA Default - 2026
Which Form of Help You Actually Need
Before you call someone for help with an MCA default, think about which form of help you actually need. If your goal is to make it easier to pay, talk to a firm that changes existing payments. If you want a reduced payoff, talk to a company that negotiates settlements. If you just want to swap your debt for new financing, compare refinancing offers. If you need a broader package of debt help, look for a restructuring expert.
Slate Capital Management describes advisory work and creditor negotiations, and companies that focus on settlement offers include Coastal Debt Resolve and Business Debt Ninjas. Value Capital Funding describes refinancing, while Second Wind Consultants provides broader financial restructuring services. Other firms that also advertise settlement include Clear Biz Debt and Rise Alliance. Some firms advertise specific services, but nothing substitutes for getting proposals in writing and then choosing based on your needs.
Once you have missed payments, the funder may move quickly, but the law limits how they do it. In New York a confession of judgment can only be filed where the business or owner lived or had an office at signing or filing. In Texas, funders can no longer use confessions of judgment since September 2025. In arbitration, ask if a lawyer will appear for you. New York’s attorney general has sued Rapid Ruling, saying 97 percent of its cases in its first three years went ahead without the small business appearing, so ask who represents you, because a negotiation service is not automatically legal representation.
Restructuring a loan can mean that while the funder keeps the original amount and payoff balance, the debt is rescheduled, so relief is in the payment plan not the total amount. Ask for the new payment schedule and make sure it is one you can handle. A monthly cut may be because you are paying off the obligation for longer.
A settlement firm negotiates with funders to cut the payoff. Some programs use escrow accounts with weekly deposits. While your money is in the account, no payments go to the funder, but this can increase the risk of legal action as the funder sees this is not a payment it has accepted. Remember, advertised percentages are not guaranteed payoffs on all debts or for all clients. Offers change until the funder accepts it in writing, so compare the payoff amount plus all program fees to your current payoff balance so you can estimate how much you save, assuming the funder agrees.
If you are looking for relief from daily ACH withdrawals on an MCA debt, check whether refinancing is the right answer. With MCA refinancing, you swap one set of daily deductions for a new loan, which can be hard for some borrowers to qualify for. Ask for the total to be repaid plus fees and whether you will need collateral, personal guarantees, and of course, whether they will pay off all the advances.
If you are stuck with several kinds of business debt including MCAs and are seeking a broader restructuring, watch out for the full package of what you are getting. Is a turnaround or Article 9 strategy right for you? How would an asset sale or transfer be set up to help you? Would you get to keep ownership and would contracts remain intact? And whatever the final plan, ask how it treats any personal guarantees, which do not come off automatically when you settle or restructure the corporate debt.
Ask each shortlisted firm for specific advice based on your debt levels and existing cashflow, because that way you can compare their approaches. Ask which creditors they were able to get on board with the proposal, and which are still negotiating. Find out what happens if one creditor is not ready to agree. Beware of claims that a particular result can be guaranteed before the adviser has seen your figures. Also look out for providers that encourage you to skip the written contract or cannot explain their fees. And ask for evidence of results.
Debt help firms charge different fees. Ask for a written fee schedule, then ask when each charge is earned and collected, and of those charges, how much goes toward fees and how much toward the funders, and finally, what happens to any unused funds if you leave.
When a debt is too much to handle, you are not limited to the help of a debt help firm. New York’s Attorney General in January 2025 reached a settlement with a group of companies related to Yellowstone Capital that canceled over $534 million of debt from merchant cash advances that worked like loans. In New York, charging over 25 percent interest a year on a loan can be a criminal felony if done by someone not legally authorized to make loans. In California, since October 2023 unfair practices have been banned, so complaints can be filed with the Department of Financial Protection and Innovation.
You can also consider a Subchapter V case. As of June 21, 2024, Subchapter V small business cases can have debts up to $3,424,000. Lawmakers passed H.R. 7730 to raise this to $7.5 million. The law is awaiting President’s signature as of October 1, 2026, so check the limit that will apply to you. Whichever route you take, if business debt is forgiven, the cancelled debt is generally taxable as ordinary income unless an exclusion applies, such as bankruptcy or insolvency, which covers only the amount you were insolvent just before.
Take Stock of Your Current Cash Flow
First, gather your current balances and payment histories and take stock of your current cash flow. Then, pick the kind of help you are looking for. Next, get written proposals from companies on your short list, and only decide after you see their proposals in writing. Finally, before treating a debt as resolved, get signed documents, and if possible, have a business attorney review the release terms.
