2026 Best MCA Defense Lawyers in Indiana

Bottom line: If an MCA company has sued your Indiana business, yes, you need a lawyer. Immediately. But not all lawyers are created equal. Your attorney must have experience defending businesses against merchant cash advances. Sometimes an attorney has represented your business in the past for completely different issues. This might make sense for disputes about other issues. However, with cash advance contracts, because the issues are so specific, it’s vital to have a lawyer who knows how to sort and prioritize the intricacies.

Top MCA Defense Firms for Indiana Business Owners - 2026

In Indiana, the best MCA lawyer for you will have a track record of handling cash advance agreements successfully; they should have an Indiana bar number that checks out in the state Roll of Attorneys search. Finally, get the fee agreement in writing so nobody gets confused, and hire them before your deadline for answering the court summons passes.

Delancey Street

Attorney-Coordinated MCA Defense & Settlement - Serving Indiana Business Owners - $100M+ Settled Nationwide

Important: Delancey Street is not a law firm. They’re a specialized MCA debt settlement company that works with a nationwide network of licensed attorneys - and that distinction matters. Their attorneys handle COJ challenges, usury defenses, UCC lien disputes, funder negotiations, and settlement execution for business owners across all 50 states, including Indiana. Their network is built around New York’s dual usury framework - which governs the vast majority of MCA contracts regardless of where your Indiana business operates - and the evolving appellate case law that is reclassifying MCAs as loans subject to interest rate caps.

Where Delancey Street separates from every other firm on this list is MCA-specific legal firepower. Their attorneys don’t just negotiate - they challenge. They file motions to vacate confessions of judgment, raise criminal usury defenses when effective APRs exceed 25%, dispute overbroad UCC-1 filings with the Indiana Secretary of State, and use the NY Attorney General’s $1 billion Yellowstone Capital settlement as precedent in funder negotiations. Over $100M in commercial debt settled. No upfront fees. Results-based pricing.

Best for: Indiana business owners facing active MCA defaults, COJ filings, frozen bank accounts, stacked advances, or UCC liens who need immediate attorney-coordinated defense
Total Settled: $100M+
Focus: MCA Defense & Settlement
Attorney-Led: Yes
COJ Challenges: Yes

Respond to a Cash Advance Court Filing

When your business gets sued for a cash advance, the procedure differs slightly by state and case. However, your attorney is your best source for a case-specific answer. In most states, your business must respond to a cash advance court filing within 20 to 30 days of receiving the court documents. Especially during the holidays and the busiest months of your industry, it is easy to lose track of business mail and notifications. It is important to react quickly, but you must approach your answer strategically, as well.

Generally, if your business ignores a summons from an MCA company, a default judgment is entered. That can enable the court to take action against your business for the amount claimed in the MCA company’s Complaint. In other words, unless you answer the Complaint, the court will resolve the dispute without your input, and most likely in favor of the cash advance company. Your MCA provider can pursue any of a number of drastic options after obtaining a judgment. They might freeze your business’s bank accounts, enforce any lien it has on your equipment, try to collect on your personal guarantee, or contact your customers. Most judgments also become public, so they may make it difficult to get financing in the future. On top of this, it can be hard to undo what a creditor has done once you’ve lost in court; setting aside a court’s decision usually needs special evidence, like proof that you were never properly informed about the court process.

Your Contract Is a Loan

Frequently, in order to work around legal problems, cash advance companies actually set up their contracts to make sure they are not legally considered loans. For the MCA provider, calling the contract an advance, rather than a loan, gets around specific state requirements and protections that govern most loans. The court might rule that your contract is a loan, and therefore subject to much stricter regulations, if your advance provider takes a specific amount regardless of your revenue; if it isn’t truly exposed to loss; and if you signed a personal guarantee and a confession of judgment.

It can matter a great deal if a court views an MCA agreement as a loan rather than an advance. Often, merchant cash advances have wildly higher effective interest rates, in the triple digits, while New York caps loan interest at 25% per year; and in Indiana, above 72% a year is a felony loansharking charge - though only if a court treats your contract as a loan.

The agreement between you and the advance company should say what you get and what the advance provider gets back from the transaction. That usually comes down to the percentage of your future revenue in exchange for upfront funding. One strategy for cash advance providers to maximize their profits is to ignore a merchant’s efforts to work together to make a payment that fits a merchant’s current earnings. Many cash advance companies do exactly this in order to keep their finances moving. In those cases, it is vital to have the necessary evidence. If you have been asking the advance company to check your account, and they refuse to respond, that shows that the provider is treating the sum you owe as a fixed amount, not a share of sales. It is a good idea to document each effort to get the funder to respond by keeping written copies of requests, and send them to your lawyer as soon as you can. Any evidence that the provider took more than it should, charged you unexplained fees, or misrepresented the deal terms can help.

Many MCA providers make merchants sign a confession of judgment (COJ). Normally, a lender can’t get a judgment without letting you know first and letting you speak up at a hearing. But a confession of judgment lets a lender do an end-run around that legal principle. Because of the potential for abuse with confession judgments, Indiana state law says that confessions signed before the claim arises are void. However, an Indiana appeals court has allowed a valid New York confession judgment to be enforced here. New York passed a new law in 2019 preventing creditors from filing confessions against people who don’t live there. But an older confession of judgment may still cause you problems. Sometimes, if the advance company played hardball and the confession judgment was set up wrong, your lawyer might still get it vacated.

If the company served you at an old address or person who didn’t have authority, or a lawsuit is served on your business after you closed or dissolved it, the whole case and judgment may be thrown out. In Indiana, the MCA company must file its case on a written contract about money within six years of when the debt went overdue.

Personal guarantees can be a big problem with cash advances. Most include one. But some don’t cover the entire balance due: a guarantee can cover only specific bad behavior. And personal guarantees can be unenforceable for the same reasons a contract is unenforceable.

Your First Visit

Bring your merchant cash advance contract(s), including supporting documents and correspondence. Collect bank statements, records of deposits and withdrawals, communications by letter or email to the MCA provider, etc. Bring copies of everything to the lawyer on your first visit. You don’t want to do anything that looks like trying to hide money. Don’t move money to relatives or friends, empty accounts, or start new ones. These make it look like you’re trying to defraud your creditor. Don’t talk to the funder! Anything you say can be used as proof you owe the entire balance - even if you were just hoping to start a negotiation. Let your lawyer do it.

When you check out a lawyer, remember that Indiana lawyers have just one bar number for the whole time they practice in the state. If you sign a contingent fee agreement, it has to be written, signed by you, and state what the percentage is and how any expenses will be paid. To initiate a complaint about an Indiana attorney, you would send a Request for Investigation form to the Indiana Supreme Court Disciplinary Commission, which oversees the state’s attorneys. Its number is (317) 232-1807.

Negotiation and litigation are often more like hand in glove than they are at odds. Litigation can be a compelling reason for a cash advance company to negotiate - you can protect your rights and defend yourself until settlement becomes a more attractive alternative. Even if you decide to settle, the settlement agreement is another contract which may contain a confession of judgment, and so you should be just as careful with it. Make sure you review the language, and hire an attorney to review it, before you sign. Never sign a document when someone is telling you you must sign to get something done. Don’t get a cash advance to pay off a cash advance. It is almost always a mistake.
