Hunterdon County Domestic Assault Lawyers

October 23, 2020 Hunterdon County Criminal Lawyers

Disagreements can rapidly escalate in marriages, and dating or similar relationships. Criminal charges coming under the umbrella of domestic assault come about when things reach the point of getting physical. If you got charged with simple assault or aggravated assault in Union Township, Raritan Township,  Flemington, Readington or another municipality in Hunterdon County, you definitely need to take your case seriously. Enlisting the services of a skilled attorney is an especially wise option.

Where are  Hunterdon County Domestic Assault Offenses Heard?

The court that has jurisdiction over your assault case depends on whether you are facing the disorderly persons offense for simple assault or an indictable crime for aggravated assault. Simple assault charges can be dealt with in municipal courts like the ones in Bethlehem, Clinton Township, Tewksbury or East Amwell. Third and second degree crimes (like aggravated assault) can only be heard at the Hunterdon County Superior Court in Flemington.

Will My Domestic Assault Matter Be Decided Simultaneously With  The Restraining Order I Am Facing?

No. Charges for domestic assault are presented in criminal court, whereas a Hunterdon County restraining order is handled  in the Family Division of the Superior Court. Two separate proceedings need to be conducted to decide whether the temporary restraining order becomes final and the other proceeding is to decide guilt or innocence for assault.

What Kinds of Penalties do I Face If I Am Convicted Of An Assault On My Husband/Wife, Boyfriend/Girlfriend or Other Domestic Relation?

The penalties for simple assault that can be imposed in Alexandria, Lambertville or Delaware Valley Joint Municipal Court include a fine of up to $1,000 and up to 6 months behind bars. Fourth degree aggravated assault brings a fine of up to $10,000 and 18 months in prison. The sentence can include up to 5 years and a maximum fine of $15,000 for third-degree aggravated assault. A second-degree aggravated assault is the most serious variety of N.J.S.A. 2C:12-1b charge someone can face. The prison term can be as much as 10 years and the potential fine is $150,000.

Can A Domestic Assault Conviction Effect My Immigration Status?

Yes, it most certainly can. Your status in the United States is likely to be effected if you get convicted of domestic assault. Your Green Card could be revoked and/or removal proceedings filed because many assault charges are considered aggravated felonies that call for ICE involvement.
