If you’re in the military, you know that a court martial can damage and even end your career. You risk losing pay and your rank. You may even face a period of incarceration. When you’re the subject of a court martial, you might worry about how to minimize the damage and save your career.

Types of court martial proceedings

What happens at a court martial

A court martial begins when a military officer authorizes charges. This is called preferring charges. From there, you have an arraignment. This is where you’re formally told of the charges against you. The court asks you if you want to plead guilty or not guilty.

Before the trial, your attorney has the option to file pretrial motions. They can use this process in order to discover the government’s evidence against you. During this time, plea negotiations can continue.

Trying the case

If you choose to go to trial, you should know that the jury’s verdict doesn’t have to be unanimous. Only 2/3 of the jury needs to believe in your guilt in order for them to find you guilty of the offense. The trial proceeds a lot like a trial in a civilian criminal court.

Both sides have the opportunity to make an opening statement. Your attorney can cross examine the state’s witnesses and call witnesses of your own. You can admit pieces of evidence if the court rules allow for it. At the end, your attorney can make a closing statement to the jury. If you’re convicted, you must be prepared to make your case about why a particular sentence is the most appropriate.
