The Oakland Criminal Court Process
In the aftermath of an arrest, you are probably wondering what the series of events are that you or your loved one is supposed to go through. First, after a person is arrested and booked, they are most likely to be given the option to bail out of holding. Some individuals might even be released on their own recognizance (abbreviated OR) without paying any money. On the other hand, defendants that are considered high-risk, such as murder suspects, are typically kept in holding pending the outcome of their criminal case.
Any defendant that is released, either on bail or OR, are obligated to show up to all of their court appearances. For some, the defendant’s attorney may appear on their behalf, and that is sufficient to meet the conditions of the release. The court issues a bench warrant for defendants who don’t show up. This makes them vulnerable to being arrested at any point in time.
For a defendant to get their bench warrant recalled, they would have to request a court hearing for this purpose and appear personally. Again, the judge may be satisfied if the private attorney appears instead. Even then, the judge is at liberty to decide whether the defendant will be allowed to remain out-of-custody for the rest of the case.
A public defender is assigned to any criminal defendant who cannot afford to hire a private lawyer.
After the arraignment, where the defendant is formally presented with his or her charges, the pretrial phase of the case begins. The lion’s share of cases never reach the trial stage at all. Both the defense attorney and prosecutor can agree to a plea agreement. In such agreements, the charges are usually reduced or dismissed in exchange for a guilty plea.
A preliminary hearing prior to trial is a right afforded to defendants facing felony offense charges. In this hearing, the prosecution reveals all of its evidence, and the judge determines whether the state has enough proof to move forward with prosecuting the case. The state usually wins the preliminary hearing, since the burden of proof is low. Nevertheless, they are a rich opportunity for the defense to get an early look at the state’s prosecution strategy in action.
Defendants who are indicted by grand jury are not eligible for preliminary hearings.
If the defendant is ultimately convicted, the next step is sentencing. In some cases, defendants may be able to avoid incarceration if they get are offered probation instead. In such scenarios, they would be required to follow all the terms of probation or risk being remanded to jail.
